The Biden administration’s effort to regulate pistol braces was dealt a blow Tuesday after a ruling by a federal appeals court cast doubt on its constitutionality. The Biden admin rule required gun owners to register pistol braces, which are accessories that can be attached to the rear of a gun to make it easier to aim and fire with one hand. Second Amendment proponents argued that the braces make handguns safer and more accurate. But gun control advocates argued the braces could be used to lengthen a concealable handgun, making it more dangerous. Two Texas gun owners, a gun rights...

This has been one of the busiest weeks in recent memory in terms of court hearings on Second Amendment issues. Not only did we have the Seventh Circuit’s oral arguments on a possible injunction against Illinois’ ban on so-called assault weapons and “large capacity” magazines and the Ninth Circuit’s hearing on California’s AB 2571, but another Ninth Circuit panel heard oral arguments in a challenge to the state’s ban on open carry on Thursday, and a three-judge panel on the Fifth Circuit also heard from both sides in a Thursday hearing to determine whether a temporary injunction halting enforcement of...

Last we heard from Harvard’s David Hogg, he was working on a paper on the Second Amendment for his constitutional law class. He’ll probably get an A+ for the same reason Harvard granted him admission over much more gifted young people. Hogg’s takes on the Second Amendment are universally terrible, but Keith Olbermann got triggered by a tweet Thursday that led him to lay down the hammer on gun ownership. House Judiciary GOP @JudiciaryGOP #BREAKING: The Judiciary Committee just voted to repeal the ATF’s unconstitutional ban on pistol braces. Big win for the Second Amendment. 1:10 AM · Apr 20,...

Rep. Matt Gaetz Rep. Matt Gaetz slammed the Biden admin and Democrats on Thursday over a rule requiring gun owners with ‘stabilizing braces’ to register, dispose of, or alter the brace. On January 13, 2023, the Attorney General signed ATF final rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces,’” amending ATF’s regulations to clarify when a rifle is designed, made, and intended to be fired from the shoulder. The final rule was published in the Federal Register on January 31, 2023.

"Washington Gun Law President, William Kirk, discusses now the third, of what will be many lawsuits to stop ATF's gross overreach with the publication of their new Pistol Brace Rule. Today we discuss the case of Firearms Responsibility Accountability Coalition v. Garland, filed in the U.S. District Court for the North Dakota. What make this case so unique however, is that 26 states have joined in as plaintiffs meaning that more than half the states in our country are now suing the Federal Government over this rule. Anewly published federal rule could soon make felons of hundreds of thousands of law-abiding Americans and violate the U.S. Constitution. The Biden administration claims adding a pistol brace to an otherwise legal pistol suddenly transforms it into an unlawful “short-barreled rifle.” A poorly argued DMN editorial claims the ATF’s pistol brace rule “is common sense.” But as Albert Einstein pointed out, in many cases common sense is “nothing more than a deposit of prejudices laid down in the mind before you reach eighteen.”

WASHINGTON, Jan 13 (Reuters) - The U.S. Justice Department announced on Friday a new rule targeting pistol attachments known as "stabilizing braces," implementing a key move in the Biden administration's efforts to beef up gun control regulations. A stabilizing brace is an attachment to a pistol that functionally turns it into a short-barreled rifle, similar to a sawed-off shotgun. Such weapons are considered particularly deadly as they offer the power of a traditional rifle, but are much easier to conceal. For decades, short-barreled rifles have been subject to strict regulations, including a law known as the National Rifle Act, which...

Led by Second Amendment advocate Rep. Richard Hudson, 141 Republicans (and likely more to come) are targeting a revived rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives backed by the Justice Department to turn AR-style pistols into expensive, hard to get guns. In a letter to Attorney General Merrick Garland and acting ATF Director Marvin Richardson, Hudson wrote, ..“This proposed guidance is alarming and jeopardizes the rights of law-abiding gun owners and disabled combat veterans across the country.”....He was joined by 140 other Republicans, including the No. 2 and No. 3 GOP leaders, Reps. In a 16 page draft copy of proposed rulemaking/guidance specifying “Objective Factors for Classifying Stablizing Braces”, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has proposed entering into rulemaking to delineate the objective factors considered when “evaluating firearms with an attached stabilizing brace to determine whether they are considered firearms under the National Firearms Act (‘NFA’) and/or the Gun Control Act (‘GCA)” and the Department of Justice’s plan to “subsequently implement a separate process for current possessors of stabilizer-equipped firearms to choose to register such firearms in compliance with the NFA.”While the proposed rulemaking/guidance has not yet been published...
