A judge denied a request by Arizona Democrats to halt a Republican-backed 2020 election audit in Maricopa County. Maricopa County Superior Court Judge Daniel Martin, who was assigned to the case on Monday after the first judge recused himself, also rejected on Wednesday a motion by Cyber Ninjas, the Florida-based consulting firm hired by the GOP-led Arizona Senate, to keep its audit policies and procedures under seal. The judge ordered that the documents be made public by noon on Thursday, barring action by a higher court.

Maricopa County Superior Court Judge Daniel Martin has dismissed a temporary restraining order aimed at pausing the Arizona Senate's recount of 2.1 million 2020 election ballots. Martin said the plaintiffs (Democrats) failed to show enough evidence that there would be harm to voters due to the audit procedures currently being used. “I will share with you all, I am not yet persuaded that there has been a showing that the rights of the voters in Maricopa County are being protected,” Martin said.

The Arizona Democrat Party and a Maricopa County Board Supervisor filed a complaint arguing the audit violates state law. Superior Court Judge allowed the audit to continue with a hearing set for Tuesday. In today’s hearing, plaintiffs in the case argued that Cyber Ninjas, the lead party in the audit, has not provided adequate proof of its ability to conduct a secure and confidential audit of the ballots. The Defendants argued that they have a right to protect their procedures and policies from review by the plaintiffs because, state Senate, has not been waived from privilege in the case.

PHOENIX (AP) — A judge hearing a challenge to voter privacy policies during the Republican-controlled Arizona Senate's recount of 2.1 million 2020 election ballots in the county that includes metro Phoenix said Tuesday he is not convinced voter secrecy is being upheld. The comment from Maricopa County Superior Court Judge Daniel Martin came at the end of a lengthy hearing where he also declined to extend a previous judge's order that auditors hired by the Senate comply with state voter privacy laws -- at least until he hears more at a hearing on Wednesday.
