Pinellas Pasco Judge Greer set October 15, 2003 at 2:00 p.m. for her feeding tube to be removed. There's something wrong with Florida's exit protocols and the way the courts handle new information re: criminality (misrepresentation, attempted murder, etc.) affecting a case. There was no living will, only the assertion of a very suspect, so-called husband, his brother, etc. that Terri would not want to live on life support. Terri is not on life support, she is not comatose or PVS and she is not living "artificially". She does get sustenance from a feeding tube but only because she has been denied rehabilitation by her so-called husband after he won a malpratice lawsuit three years after her collapse (cause unknown but probably due to strangulation or physical abuse, or both) which is why Terri needs an army of supporters to spread her story from coast to coast. Terri has retained rights that are being sidestepped because she is disabled and has been denied rehabilitation! The technologies of rehabilitation have greatly improved exponentially yet Judge Greer has not let Terri have a chance to learn to eat or to be able to learn to speak/communicate again. Also new information bearing on the case which shows criminality on husband's side has not been considered by the 2nd District Court of Appeals who handed down Mandate for termination of Terri's feeding based upon testimony of criminal husband and brother as above stated. Who is next?

The Judge to watch at the moment is Judge Lazzara.

St. Pete Suicide Concert is set for Saturday night - TONIGHT.

You may be interested to learn that Judge Lenderman who has ties to Hospice is the Judge who ordered that the "live" suicide on stage WAS ILLEGAL AND ORDERED THEM TO NOT DO IT in St. Pete, FL.

If assisted suicide is illegal in the State of Florida, I don't see how starving Terri is no different than assisted suicide by this terminally ill person on stage.

Either assisted suicide is okay for none or fine for all so to speak for the sake of discussion.

Maybe in the scheme of things, Judge Lenderman's injunction against the live suicide will end up helping Terri. The rock band leader is a Tourtelot, one of the largest real estate company's offspring. This is beyond embarassing for daddy Tourtelot.

TAMPA - Attorney General Charlie Crist on Friday said he won't get involved in the case of Terri Schiavo, a brain-damaged woman scheduled to have her feeding tube removed this month.

A federal judge had asked Crist to address the question of the constitutionality of Florida law dealing with the right of severely incapacitated people to refuse artificial life support, which is the issue at the center of the Schiavo case.

Crist ruled the law constitutional, but said he wouldn't get further involved.

A federal judge has set an Oct. 10 hearing in a lawsuit filed by Schiavo's parents, Bob and Mary Schindler, against their son-in-law, Michael Schiavo. The Schindlers want to block the Oct. 15 removal of the feeding tube that has been keeping their daughter alive.

Terri Schiavo, 39, suffered severe brain damage more than a decade ago and remains in what doctors call a "persistent vegetative state." A Circuit Court judge last month ordered the removal of her feeding tube.

Thank you for helping me understand this. I just wasn't sure if what I was reading was completely against Terri or not. I hope that Lazzara decides that Judge Greer has not acted in the most prudent manner. Terri hasn't had the chance to be rehabilitated. She should be given the opportunity. Does anyone have an idea of whether Lazzara has the authority to remove Schiavo as Terri's guardian? He made it sound like he does, because he asked the lawyers to be prepared to argue whether a guardian ad-litem should be appointed at the Oct.10 hearing.

In the two earlier starvation/dehydration attempts, a judge ordered the feeding tube re-inserted. Who was this judge? How was he involved in the case? Can he be contacted again? In the earlier starvation orders, was George W. Greer the judge who rendered the death decision? Do Crist and Bush have political ties to George W. Greer? These questions need to be answered for us to evaluate what sinking options we might have.

Michael Schiavo berated Jeb Bush in the press. Greer dissed Jeb Bush in the press as well.

Greer is a liberal. Schiavo is a liberal.

Conservatives DO NOT support euthanasia and the 'right to die' movement.

Obviously, Jeb has a strategy and this strategy involves not letting the press know key information.

Perhaps Jeb feels this case is better off being dealt with on the federal level.

Greer is a liberal

There was some speculation that Greer may be Republican because of his close friendship with the Pinellas Co. Republican Sheriff. No one could ever verify Greer's party affiliation. I immediately assumed that he was Democrat but could never verify that.

And while Greer and Schiavo attacked Bush for his letter, Bush has not replied to them; in fact, he seemed to accept their criticism.

There are rare occasions when Republicans are liberals (Jeffords, Snowe). Jeb Bush is a conservative and Greer is without a shadow of a doubt a liberal. If he is a Repubican, he is not a conservative Republican and is a disgrace to the Republican party.

I doubt seriously Greer is a Republican.

Greer was a county commissioner before he was a judge. I have been unable to find out his party when he ran for county commissioner. This tidbit of information is unavailable. However, I like you think he is a Democtat appointed by the late popular Governor Lawton "Walkin' Lawton" Chiles. People in FL just idolized Chiles.

Crist's memorandum is quite fair and detailed, IMHO. In stating that the statutes are constitutional, he also gives Anderson/Schindlers points to address.

He brings up relevant factors, that they "will not always reach the same balance."

And in this same paragraph, "... factors will vary depending on who brings the challenge to the guardian's decision, whether the challenger is able to litigate it appropriately, and whether there are facts (such as suspect motives by guardian and challenger) that militate for independent representation for the patient. Because these factors will vary, the best solution is to leave the question about appointed representation to the discretion of the trial judge, subject to appellate review. Id at 32.

"For these reasons, the Florida Statutes are constitutional."

Cruzan v. Harmon was Terri in reverse. The parents asked the hospital to remove their daughter's nourishment. The hospital refused. This was back in 1983-1989. One difference is that Terri showed "a little improvement" after therapy, and Nancy Beth Cruzan showed none.

Gray v. Romeo was the right of privacy - to refuse treatment. 1988

I hope Judge Lazzara will see that Judge Greer has had tunnel vision, & that there has been no oversight of Michael as Terri's guardian. Too, if memory serves me, there are supposed to be ethics committees involved in the decision.

Folks, we're on the countdown to Judge Lazzara's courtroom on October 10th. Attorney General Crist has found Florida's statutes to remove Terri's feeding & hydration tubes to be constitutional - but what he said, & how he said it, may be an opening for Terri's parents to challenge her husband, Michael (guardian), and Judge Greer (surrogate).

Opinions, ideas?

I hope that you are correct, but I am by nature a pessimist. And this poor soul has been jerked around by the injustices of "FL law" for so long that I have no hope left.

"What looks like a stone wall to a layman may be a triumphal arch to a lawyer." That was once said of the Sherman Antitrust Act of 1890. Maybe this is true of Crist's brief. But as a lawyman, it looks like a stone wall to me, and FL looks like not a haven of retirement, sun, and fun, but a bastion of never-ending injustice.

I hope I am wrong about FL and what the governor calls "our courts," implying that they are above reproach.

umm, I'm an optomist. My "better half" is a pessimist. We balance each other quite well because we respect one another's opinions. What one doesn't see, the other might.

As Crist said, cases differ. We have to come up with evidence, and some of that cannot be proved.

My big question is why Judge Greer dismissed affidavits of care-giver personnel? Why would he favor Michael, his brother & sister-in-law, one of whom has a vested interest (both monetary & personal) in Terri's death, over the testimony of 4 close blood relations, plus at least one friend? Why did Greer not take into consideration Michael's sworn testimony in the malpractice trial?

How many Freepers are there in the Florida area when these "judges" reside and do their business?

What would happen if a large group picketed outside the Courthouse, the hospice or whereever Terri is and maybe the Capitol Building?

If nothing else it should draw the press - maybe. Some good, large signs stating the facts would certainly embarrass me if I were the judge - that this situation has gone this far.

Any thoughts?
