HJR 19 has passed the Texas House. The Senate needs to be encouraged to pass the constitutional amendment rather than just a statutory bill. Time is short. If the Senate adjourns today and does not come back until Monday, the measure may die because of a lack of time to address it. The Senate needs to be encouraged are the key words Today and now are mine.

It did not take long for cities and other political subdivisions to wade in with amendments to try and water down protection the people of Texas would get from strong eminent domain legislation. Time to write, and call your local representatives and tell them to support the original bill as written. Arlington Texas is attempting to add amendments to the bill because of their attempt to use eminent domain to acquire land to build a new Cowboy Stadium. If every political subdivision is allowed to exempt their pet projects, we are no better off than we were under the SCOTUS...

AUSTIN -- State Rep. Lois W. Kolkhorst (R-Brenham) is among lawmakers calling on Gov. Rick Perry to add eminent domain issues to the current special session. Kolkhorst joined fellow lawmaker Rep. Frank Corte (R-San Antonio) in filing House Joint Resolution 19, which is a proposed amendment to the state constitution intended to limit a governmental entity's power of eminent domain.
