When Matthew Sweetwood agreed to surrender his handguns and purchaser identification card 11 years ago after he and his wife filed domestic violence complaints and sought restraining orders against each other, the Millburn resident never thought it would take more than a decade to get them back. Yesterday, the state Supreme Court granted him the opportunity to regain his right to own a gun. The court said a 2004 law that prevents someone from buying or possessing a firearm if other weapons were seized or surrendered under a domestic violence prevention act would not necessarily bar Sweetwood from purchasing or...
  • Schools' duty to guard kids doesn't end at last period, N.J. justices rule in case of boy

Even after the final bell rings, a school has an obligation to make sure the children in its care are heading home safely, the state Supreme Court ruled yesterday in a unanimous decision that is expected to affect schools across New Jersey. The court found that just as schools are responsible for students' safety during classes, they also must protect them from danger as they are dismissed -- especially young kids like the 9-year-old Pleasantville boy at the center of the case, who was struck by a car after school and paralyzed. "As the school-time trustees of our most cherished...

State Supreme Court Justice Roberto A. Rivera-Soto on Friday denied misusing his position to assist his son in a dispute with another teen on their high school football team. Rivera-Soto "insisted at all times that (the) matter be treated in the ordinary course," according to a legal brief filed in response to an ethics complaint brought against him May 11. "His intent at all times was to avoid any appearance of impropriety," the brief said. "To the extent any person understood (Rivera-Soto's) actions in any different light, (he) regrets that understanding." Rivera-Soto, the first Hispanic on the state Supreme Court,...

Schlafly points out (paragrph 15 of her column) that the of New Jersey Supreme Court justices who broke the law and let Lautenberg on the ballot WERE APPOINTED BY "Republican" CHRISTIE TODD WHITMAN. : "The New Jersey story gives us a bitter lesson in how Republicans are betrayed by RINOs (Republicans In Name Only)." If Lautenberg hadn't been let on the ballot, THE GOP WOULD HAVE A LOT STRONGER CHANCE OF RETAKING THE SENATE. THANKS, CHRISTIE TODD - YOU JERK. Will We Let Judges Fix Elections? • Cause of NJSC Decision and Democratic Nonsense Tied to Moron Particle Exposure

Personal Research | way back in Oct. 2000 | me
Back in Oct. 2000, I published my original research. Here it is again, in a slightly revised form, in light of the current goings on: I have been conducting subatomic research, and with the heralded discovery of a hitherto unknown particle, I believe I have discovered the cause of rampant liberalism in the Senate and key states of the union. Have you ever wondered why some people seem to support a liberal socialist viewpoint, without being able to back up their argument with facts? Well, now we know. I have dubbed the responsible particle the "Moron." In key states like...

Given the outcry directed at the U.S. Supreme Court after it ended the 2000 Florida recount, we'd understand if the Justices aren't too keen on getting involved in another election dispute.

But when it comes to the Republican appeal yesterday of the New Jersey Supreme Court's decision to allow a late switch on the state ballot, we don't think they have much of a choice. Article I, Section 4 of the U.S. Constitution specifically delegates to state legislatures, not to state governments as a whole, the authority over the "times, places and manner" of holding Senatorial elections. As such, the "equitable powers" invoked by the New Jersey court to "liberally construe" this particular law simply do not exist.

  • Judicial impeachment in NJ

I don't know the pertinent NJ laws, but it seems to me that the NJSC has provided clear grounds for their impeachment for grossly violating their oaths of office. Is impeachment brought by the House of Representatives in the General Assembly? If so, are there enough Republicans and outraged Democrats in the NJ House to bring articles of impeachment against the justices? I'd think that many legislators would be incensed by this usurpation of their constitutional prerogatives. If I'm right about this, do any of our NJ FReepers know their state Representatives well enough to put this idea in their...
  • The Law Is In My Mouth Alert: New Jersey Court Overturns Ouster of Gay Boy Scout - August 5, 1999

TRENTON -- Equating the Boy Scouts with such public accommodations as restaurants, libraries, schools and theaters, the New Jersey Supreme Court ruled Wednesday that the organization's expulsion of a gay Eagle Scout in 1990 violated the state's antidiscrimination law. In a unanimous 7-to-0 decision, the court first rejected the Boy Scouts' arguments that it is a private organization and that its decision to remove the scout, James Dale, was protected by the First Amendment. The court also dismissed the Scouts' contention that homosexuality is immoral, comparing that view to discrimination against women and blacks. After saying Mr. Dale's dismissal was "based on...

  • Crossfire's Novak on NJSC Ruling: PA Gov. Schweiker Should Replace Fisher in GOP PA Gov. Ballot Slot

Posting this belatedly, but toward the close of the show when discussing the NJ decision, Novak half-jokingly proposed that since Fisher is so far behind in the Pennsylvania Governor's polls, maybe Governor Schweiker, who has turned out to be somewhat of a hero after the Pennsylvania mine situation, should replace Fisher on the ballot.
