Less than a week after a Del Rio-based federal judge ruled against Texas in the ongoing fight over the state’s razor wire, the 5th U.S. Circuit Court of Appeals paused that decision while it reviews the case. The 5th Circuit Court of Appeals on Monday temporarily halted a lower court order that gave Border Patrol agents legal cover to continue cutting concertina wire that Texas has installed on the banks of the Rio Grande. U.S. District Judge Alia Moses of Del Rio on Wednesday ruled against Texas Attorney General Ken Paxton’s office, which wanted the judge to order Border Patrol...

A Stanford dean has been placed on administrative leave after she participated in interrupting a prominent guest speaker and lectured him on progressive gender ideology in front of the audience that came to see him.Recently at Stanford University Law School, Kyle Duncan, a Trump-appointed federal judge, was fulfilling an invitation from the school’s Federalist Society when a group of student protesters interrupted his speech, shouting over him and refusing to let him continue. They claimed Duncan was transphobic and homophobic, based on past decisions in which he refused to grant transgender status to convicted male sex offenders.Duncan was appointed by...

The wife of Rep. Jeff Duncan, R-S.C., has filed for divorce, alleging he had at least one affair during their marriage. In the Friday filing at a courthouse in Laurens County, Melody Duncan, who has three adult children with the congressman, accused her husband of having multiple extramarital affairs and leaving their home to live with another woman. Duncan, who touts himself online as a "strong advocate for life and traditional family values," has been married to Melody since December 1988. The filing, which came around noon on Friday, listed Duncan's paramour as Liz Williams, who is reportedly a lobbyist...

The Stanford College Republicans are calling on Stanford Law School to remove a DEI dean after she disrupted a conservative judge’s speaking engagement. Associate Dean for Diversity, Equity, and Inclusion Tirien Steinbach sided with hecklers by accusing Judge Kyle Duncan of “disenfranchisement” during his Mar. 9 engagement. Duncan, a U.S. Circuit Court judge appointed by former President Trump, spoke on “Guns, Covid and Twitter” as part of an event hosted by the Stanford Federalist Society. Protesting students, according to Campus Reform, took issue with his stances on voter ID laws and transgender youth.

Last week, students at Stanford Law disrupted a Federalist Society event that featured U.S. Circuit Court Judge Kyle Duncan. Duncan was prevented from speaking by unruly protesters and berated by the school's associate dean of Diversity, Equity, and Inclusion. Now, some of the protest leaders, many of whom shared the names and pictures of Federalist Society members online and in posters, are unhappy because the Washington Free Beacon published their names. "NEW: The same students who plastered the names and faces of the Stanford Federalist Society all over the school are now demanding anonymity from the Free Beacon. They say...

As you know, Appellate Court Judge Kyle Duncan was invited to speak at Stanford by the school's chapter of the Federalist Society. He was ambushed by the fascists by the Stanford Chapter of the National Lawyers Guild When I arrived, the walls were festooned with posters denouncing me for crimes against women, gays, blacks and “trans people.” Plastered everywhere were photos of the students who had invited me and fliers declaring “You should be ASHAMED,” with the last word in large red capital letters and a horror-movie font. This didn’t seem “collegial.” Walking to the building where I would deliver...

A federal judge appointed by former President Trump was ambushed by about 100 student protesters and a woke diversity dean who derailed his talk at Stanford Law School and accused him of causing “harm” to students. Tirien Steinbach, the school’s associate dean for diversity, equity and inclusion, subjected U.S. Circuit Judge S. Kyle Duncan to a lengthy harangue and made it clear to him his presence on campus was unwelcome, video of the event shows. “It’s uncomfortable to say this to you as a person. It’s uncomfortable to say that for many people here, your work has caused harm,” Steinbach...

The judge in the picture above in Kyle Duncan. He is a sitting judge on the 5th Circuit Cour of Appeals. The hideous creature on the right is Tirien Steinbach. She is the Dean of Diversity, Equity and Inclusion at Stanford University (did you even know there was such a thing?) Duncan was invited by the Stanford Chapter of the Federalist Society to give a speech on guns, COVD mandates and Twitter. As he was to being speaking he was ambushed by the hideous creature who then spouted off about how terrible Duncan was. But she then launched into an...

On Monday the 5th U.S. Circuit Court of Appeals denied the Navy's request to reinstate the U.S. Navy's COVID-19 vaccine requirement. In November, dozens of U.S. Navy SEALs claimed they were wrongfully denied COVID vaccination exemptions on religious grounds. The suit, which lists 35 unnamed service members, argues that that the Defense Department's mandate violates their First Amendment rights. While the percentage of vaccinated active duty personnel in each service is at 95 percent or higher, the number of unvaccinated personnel is close to 30,000. The Navy itself has previously said that it has not granted an exemption to any...

In U.S. Navy Seals 1-26 v. Biden, (5th Cir., Feb. 28, 2022), the U.S. 5th Circuit Court of Appeals refused to grant the Navy a partial stay of an injunction issued by a Texas federal district court protecting 35 special warfare personnel who object on religious grounds to complying with the military's COVID vaccine mandate. The court said in part: Defendants have not demonstrated “paramount interests” that justify vaccinating these 35 Plaintiffs against COVID-19 in violation of their religious beliefs. They insist that “given the small units and remote locations in which special-operations forces typically operate, military commanders have determined...

President Biden’s much-touted vaccine mandate for businesses with 100 employees or more met a roadblock on Saturday when the U.S. Court of Appeals for the Fifth Circuit Court issued a temporary stay blocking the mandate while considering a permanent injunction. The ruling from a three-judge panel on Saturday resulted from a stay sought by the states of Texas, Utah, Mississippi and South Carolina, as well as several businesses that opposed the Biden plan. The states and businesses filed a petition of review of the agency action, which goes directly to a federal appeals court instead of a one-judge federal district...

Texas will again be allowed to implement its temporary ban on abortion, the Fifth Circuit Court of Appeals ruled Tuesday afternoon. Per the order, any abortion "not medically necessary to preserve the life or health" of the patient must be halted as part of the state's directive suspending "non-essential" medical procedures amid the coronavirus pandemic. The ban was briefly lifted on Monday evening when a lower court ruled the suspension of abortion services was unconstitutional and in violation of Supreme Court precedent, including Roe v. Wade, the 1973 decision that legalized abortion nationwide. "I thank the court for their immediate...

Judge Stuart Kyle Duncan, who was appointed to the Fifth Circuit Court of Appeals by President Donald Trump, struck back against transgender insanity on Wednesday in a court case. Norman Varner, a man who pleaded guilty to child porn charges in 2012, has since come out as transgender. He now demands special rights due to his gender transition, which he announced in 2015. He demanded that the court use female pronouns to address him, and call him by his preferred name of “Katherine Nicole Jett.” Duncan was having none of it while writing his majority opinion about the case. “Norman...

This will be a weekly post. Count is now at 33. Kyle Duncan was confirmed to the 5th circuit, that makes 15 Appeals Court judges confirmed thus far. Also, the Rules committee voted to alter the cloture rules this week, which, if approved by the full Senate, will speed up confirmations. The Senate was dealing with the Secretary of state and ambassador to Germany nominations. Supposedly, McConnell plans a string of judicial confirmations next week. We'll see.
