Pinellas Pasco Judge Greer set October 15, 2003 at 2:00 p.m. for her feeding tube to be removed. There's something wrong with Florida's exit protocols and the way the courts handle new information re: criminality (misrepresentation, attempted murder, etc.) affecting a case. There was no living will, only the assertion of a very suspect, so-called husband, his brother, etc. that Terri would not want to live on life support. Terri is not on life support, she is not comatose or PVS and she is not living "artificially". She does get sustenance from a feeding tube but only because she has been denied rehabilitation by her so-called husband after he won a malpratice lawsuit three years after her collapse (cause unknown but probably due to strangulation or physical abuse, or both) which is why Terri needs an army of supporters to spread her story from coast to coast. Terri has retained rights that are being sidestepped because she is disabled and has been denied rehabilitation! The technologies of rehabilitation have greatly improved exponentially yet Judge Greer has not let Terri have a chance to learn to eat or to be able to learn to speak/communicate again. Also new information bearing on the case which shows criminality on husband's side has not been considered by the 2nd District Court of Appeals who handed down Mandate for termination of Terri's feeding based upon testimony of criminal husband and brother as above stated. Who is next?

All Night Prayer Vigil in Support of Theresa Schiavo
On Thursday, October 9 at 8 PM Monsignor Thaddeus Malanowski will be holding an all night prayer vigil in support of Terri Schiavo at St. Lawrence Catholic Church, 5225 N. Himes Ave., Tampa Florida.
Monsignor Malanowski will have an all night adoration of the Blessed Sacrament, with hourly prayer, and will conclude with mass at 6:30 AM.
Please join Monsignor in prayer so that Terri Schiavos life will be spared.

Thanks so much for linking to Sarah Foster's article from worldnetdaily.com re: Jeb Bush intervening for Terri and her family, citing one reason the thousands of emails and phone calls from Floridians who in my opinion, presented Governor Bush with a convincing argument that Terri's basic human rights were being violated.
Thank you everyone who continued to make phone calls and email Governor Bush, increase public awareness and for alerting the media.

I am confused about the amicus curia briefs of Crist and Bush. How can Crist seem to be on one side and the governor seem to be on the other side? Please clarify.I am no legal expert, but as a layman, it would seem to me that Crist only argued that the State's laws are constitutional. He specifically said in his brief that he was not entering on one side or the other, but was merely pointing out that the constitutionality of those laws.
Bush, on the other hand, is also bound by his oath to defend that same constitution, and is doing his part by entering this case (if allowed by Lazzara) to argue in favor of the Schindlers.

Will Governor Bush's brief make any difference with this judge, you think? The judge asked Crist for a brief; did he ask Bush too? I am afraid the judge won't pay any attention to the governor's brief. Remember, George W. Greer said he was filing Bush's earlier letter in the trash can.

I think Jeb is saying they have legal grounds to allow Terri to try to eat and to receive therapy for learning to swallow.
I know it is painful to hope and seems wise to prepare for the worst, but it does look hopeful on legal grounds that perhaps Jeb has done something courageous and Godly here, to me.

I started to, and then I went back and read again what he actually said. I agree with what he said here:
"The support - caring even where there is no curing - affirms human solidarity in both directions: care-giver and care-receiver. The following leaves too much wiggle-room, and does not address the Constitutionality nor MORALITY of the State taking upon itself the role of God, acting as the arbiter of life and death in cases where the condemned is INNOCENT OF ANY CRIME.
"The Governor submits this memorandum to ensure that the Court consider the critical distinction between removing artificial life support and the deliberate killing of a human being by starvation and deydration. These are two different actions. The first is performed according to state law and is allowed under Florida's constitutional right to privacy. The second is prohibited by the right to life enshrined in the Florida and federal Constitutions. The Governor submits that REMOVAL OF THE FEEDING TUBE WITHOUT FIRST DETERMINING BY MEDICALLY ACCEPTED MEANS WHETHER THE PLAINTIFF CAN INGEST FOOD AND WATER ON HER OWN, WITH OR WITHOUT REHABILITATIVE THERAPY, CONSTITUTES THE DEPRIVATION OF HER LIFE WITHOUT DUE PROCESS OF LAW" [i.e, 14th Amendment law, I presume, which is not the higher law referred to in the Delaration of Independence, which stated that our right to life came from God and not the State.]
"....Services to rehabilitate Terri's swallowing musculature are necessary (without them, she will surely die), and so fall within that retained right....." Terri SHOULD be allowed the rehabilitation to try to restore her ability to swallow food, BUT HER LIFE SHOULD NOT HINGE ON WHETHER SHE CAN SWALLOW FOOD OR NOT. TERRI IS ALIVE AND CONSCIOUS! SHE IS GOD'S CHILD; SHE HAS COMMITTED NO CRIME, AND THE STATE HAS NO RIGHT TO MURDER HER. PERIOD!
It also does not address the issues brought forth in pc93's INCREDIBLE letter @ #1126 of this thread, to the Governor's office, one of which is that Terri's injuries were not investigated by the authorities. It does not address the fact that in spite of all the courtroom and media hype, TERRI DOES NOT FIT INTO THEIR CATEGORY OF 'UPPER BRAIN DEATH', NOR DOES SHE FIT INTO THE CATEGORY OF PVS.
It's a START, and may give us more time, and for that, I am grateful, but these other issues MUST be addressed, starting with WHY Terri's husband, with all the skullduggery brought up about this case, is not REMOVED from her guardianship until ALL of these issues are resolved. I did a little research at Blackstone's this morning, because I still had a link in my history file (my google is not working.) This is what it had to say about guardians, in part:

Great news! Worldwide freep for Terri Schiavo may help save her life. We've been praying as well.
See the flash movies at terrisfight.org. What an incredible effort by Americans and others to save Terri Schiavo.
Now her case is tied up in Federal Court, which is a good thing. Hearing's on October 10th. Governor Bush just filed a "friend of the court" brief on Terri's behalf. Everything's going her way after many frustrating years.

I don't know for sure, but it is my belief that God is working invisibly right now for Terri, and although Lazzara was appointed by Clinton, he may still be a good and fair judge. He seems to have been raised as a good Catholic. Perhaps if he wants an opinion of someone he admires, he may ask his missionary doctor brother, what he might do in a similar situation. If that's the case, I think Terri will be in good hands. His brother is sort of like a Mother Teresa to some Peruvians.
