he U.S. Department of Justice on Tuesday sued the state of Oklahoma to stop implementation of a new law targeting undocumented residents. The suit in the Western District of Oklahoma follows a DOJ warning last week that it considered the law unconstitutional and a violation of federal law. Tuesday's filing restates that claim and asks for injunctive relief and for House Bill 4156, the legislation creating the law, to be overturned. “Oklahoma cannot disregard the U.S. Constitution and settled Supreme Court precedent,” said Principal Deputy Assistant Attorney General Brian M. Boynton, head of the Justice Department’s Civil Division, in a...

Thu, June 8, 2023 at 4:08 PM PDT·3 min read Jun. 8—A federal judge denied an Oklahoma death row inmate's request for new attorneys two months before his clemency hearing. Anthony Sanchez said in a video response posted online by his spiritual advisor, Rev. Dr. Jeff Hood, the ruling was a "devastating blow." "I'm having trouble understanding the idea of me not having the lawyers I want to represent me," Sanchez said. "I would rather do my own clemency myself than let Mark Barrett or Randy Coyne represent me. I am prepared to reject clemency...

A federal judge in Texas recently agreed with a federal judge in Oklahoma that the national ban on gun possession by cannabis consumers violates the Second Amendment. Kathleen Cardone, a judge on the U.S. District Court for the Western District of Texas, also concluded that the federal ban on transferring firearms to an "unlawful user" of a "controlled substance," first imposed by the Gun Control Act of 1968, is unconstitutional. The case involves Paola Connelly, who was charged with illegal possession of firearms under 18 USC 922(g)(3) after El Paso police found marijuana and guns in her home while responding...

I would agree if indeed the will of the masses violated the constitutional rights of an individual. However, I’m not sure how it’s an “individual’s constitutional right” to have a US court consider sharia or international law when adjudicating a case: CBN NEWS – A U.S. district judge permanently blocked an Oklahoma law forbidding courts from considering Islamic or international law when deciding cases. “While the public has an interest in the will of the voters being carried out, the court finds...

OKLAHOMA CITY (KOKH) — The 10th Circuit Court of Appeals let stand a lower court’s decision temporarily blocking Gov. Kevin Stitt’s ban on abortion care in Oklahoma during the coronavirus pandemic. This means abortion providers in the state can continue providing essential, time-sensitive abortion care. Abortion providers will now seek a preliminary injunction from the district court which will continue to block the ban from taking effect until the case concludes. “Today Oklahomans can breathe a temporary sigh of relief.
