A right-wing group specializing in hidden-camera investigations will not be able to use the First Amendment to stop the federal government from accessing documents and communications related to the group’s apparent acquisition of a stolen diary belonging to President Joe Biden’s daughter. As Law&Crime previously reported, the FBI executed a search warrant in 2021 at the property of Project Veritas founder James O’Keefe, as well as from Project Veritas staffers Spencer Meads and Eric Cochran. The search warrants were granted in connection with the theft and sale of the personal journal belonging to Ashley Biden, the president’s daughter. Two people, Aimee...

New Mexico authorities on Thursday said they were working with police in New York state to obtain Alec Baldwin's cellphone after the actor failed to give up to despite a search warrant to seize it. The Santa Fe Sheriff's Office and New Mexico First Judicial District Attorney's Office are 'actively working' with the Suffolk County Sheriff's Department, New York, and Baldwin's lawyers to get any materials on the phone pertaining to their investigation, according to a press release. -snip- A lawyer for Baldwin did not respond to requests for comment as to why the actor has not yet handed over...
  • Alec Baldwin: Any suggestion I am not complying with a search warrant is a lie

Alec Baldwin has said any suggestion that he is not complying with a search warrant for his phone is a “lie” and feels the only way the death of Halyna Hutchins can be honoured is to “find out the truth”. Authorities in the US issued a warrant in December for the actor’s mobile phone to be seized and searched, as part of the ongoing investigation into the death of Hutchins. It is believed there may be evidence on the phone relevant to the incident in which a prop gun went off, fatally injuring the 42-year-old cinematographer on the Rust film...

The FBI raided the offices of President Trump's personal attorney Michael Cohen on Monday. The raid came after federal prosecutors in New York City obtained a search warrant following a referral from special counsel Robert Mueller, Cohen's lawyer told the New York Times. Mueller is investigating Russian interference in the 2016 presidential election, and related issues. NBC News confirmed news of the raid. The Times reported that FBI agents seized records relating to several issues, including a $130,000 payment Cohen has said he made to porn star Stormy Daniels. Daniels has said that money was given to her in exchange...

Working for the weekend. Things are moving quickly, and that includes working over the weekend in the newly re-opened probe of Hillary’s schlock, homebrew e-mail server. The FBI told NBC on Sunday evening that while the rest of us were watching football, it was getting a search warrant to do another deep dive into you-know-what: The warrant came two days after FBI director James Comey revealed the existence of the emails, which law-enforcement sources said were linked to Weiner’s estranged wife, top Clinton aide Huma Abedin.
  • ‘Get a Warrant’: Judicial Engagement Results In Huge Win For Digital Privacy

Can cops simply take your cell phone and browse through it to their hearts’ content after they arrest you? Today, in Riley v. California, a unanimous Supreme Court answered that question with a resounding “no.” It’s not only a victory for digital privacy, but an example of the kind of judicial engagement that we desperately need to protect our liberties from unreasonable government interference. In Riley, the Court addressed the question of whether the Fourth Amendment’s warrant requirement applies to cell phone searches. In two separate cases, individuals were arrested and searched by police. The police took their cell phones...
  • Should Congress Impeach Eric Holder?

Eric Holder -- Obama's Attorney General -- should be impeached by the Republican House of Representatives. Without a doubt, Holder's obvious perjury in lying to Congress is the most serious offense. But to understand one of Holder's underlying offenses (in a long string), one must know the difference between "good law" and "bad law." Under the letter of the law, the search warrant for Fox News reporter James Rosen's emails appears proper. But the Attorney General defied U.S. Supreme Court precedents. In March 1971, The New York Times received a copy of the secret Vietnam War "Pentagon Papers," 7,000 pages...

The Supreme Court ruled on Monday that police cannot put a GPS device on a suspect's car to track his movements without a warrant. The high court ruling was a defeat for the Obama administration. The high court ruled that placement of a device on a vehicle and using it to monitor the vehicle's movements was covered by U.S. constitutional protections against unreasonable searches and seizures of evidence. A majority of the court acknowledged that advancing technology, like cell phone tracking, gives the government unprecedented ability to collect, store, and analyze an enormous amount of information about our private lives....

Celebrity-Crazy If anyone doubts that America's corporate media are celebrity-crazy, just look at the hours and hours that television devoted to the recent arrest of Michael Jackson on child molestation charges. The known facts of the case can be stated in less than three minutes. Three search warrants were executed. Police have not said what, if anything, they found. Multiple charges of child molestation were filed. Jackson posted a $3 million bond. Arraignment is set for Jan. 9. End of story. Whether he's guilty or innocent of these particular charges, his own statements and eccentric behavior have raised suspicions in...

Judges throw out odor-based drug bust By JANET ELLIOTT AUSTIN -- Where there's smoke, there may not be fire, the Court of Criminal Appeals concluded Wednesday in ruling that the odor of marijuana didn't give Abilene police officers probable cause to enter a home. "The odor of marijuana, standing alone, does not authorize a warrantless search and seizure in a home," wrote Judge Charles Holcomb in a 6-3 opinion. "This case is about the right of citizens to be left alone in the privacy of their homes," wrote Judge Cathy Cochran in a concurring opinion. The court upheld a Taylor...

ISPs Seek to Void Ruling on Police Searches Mon May 13, 7:27 PM ET SAN FRANCISCO (Reuters) - Web giant Yahoo! Inc. and several Internet trade associations filed papers Monday seeking to overturn a court ruling which they said could fill the offices of Internet companies with police officers overseeing the execution of search warrants. In an amici curiae brief filed with the 8th Circuit Court of Appeals in St. Louis, the Internet group said a Minnesota court ruling requiring police officers to be physically present for search warrants would threaten client privacy, slow the searches and disrupt business. "A...

'Living in a police state' By JOHN WISELY and STEPHEN W. HUBER, April 24, 2002 The state Legislature has given police power to search your home without telling you why Two new laws, which took effect Monday as part of anti-terror efforts, also shield from public scrutiny the reasons for police searches. Defense lawyers and civil libertarians are outraged at the laws, which make search warrants and supporting documents such as affidavits non-public records. "If you think the police did secretive work before, just wait," defense attorney William Cataldo said. "It gives more power to the ignorant and more power...
