The registry process of New York’s SAFE Act allows for warrantless police searches into gun owners’ homes, a violation of the Fourth Amendment, according to plaintiffs of a lawsuit filed in U.S. District Court Eastern District. The law firm representing plaintiff Gabriel Razzano argues the registry process is “essentially secret and results in a mandatory, warrantless Penal Law 400 gun removal visit from police.”“The entire purpose of the registry is a sham to permit intrusions into a person’s home on consent without a warrant for a ‘gun removal,’” La Reddola, Lester and Associates said in a release. “The entire registry and...
  • The Second Amendment as an Expression of First Principles

We are currently mired in a frantic debate about the rights of gun owners. One example should suffice to prove that the debate has become hysterical: Second Amendment supporters, one prominent but less than articulate member of Congress alleges, have become “enablers of mass murder.” Special animus has been directed against so-called assault rifles. These are semi-automatic, not automatic weapons—the latter have been illegal under federal law since the 1930s—because they require a trigger pull for every round fired. Some semi-automatic firearms, to be sure, can be fitted with large-capacity magazines. But what inspires the ire of gun control advocates...

    D. C. vs. Heller has been called the most significant constitutional case of the year. It's easily that. It is also the most important Second Amendment case ever. If decided incorrectly, it may well over time affect our understandings of our rights under each of the others of the first ten amendments. *** With citations, the brief runs for 82 pages. With a single exception, it is powerful and convincing. Unlike the D.C. brief, there is little evidence of authorship by committee. Its bedrock principle is The Second Amendment Protects An Individual Right to Keep Ordinary Firearms, Unrelated to Government...

Jeff May is an Ojibwe indian from Minnesota. Readers Digest named him the 2006 Hero of the Year. I had never heard of Jeff May until I opened a letter from a listener yesterday. My guess is that you have never heard of him either. Here's the story. About two years ago a young male wearing a black trench coat walked into the Red Lake Senior High School in northern Minnesota. He was carrying not one, not two, but three guns. He started shooting and killed eight people, injuring seven more .... then Jeff May took action. A teacher? No...

RALEIGH, N.C. -- Federal agents seized what they believe were six land mines from a storage unit leased by a Raleigh man and former Fort Bragg soldier who was arrested last week in Halifax County, Virginia, for having homemade bomb and an assault rifle. A search warrant made public Monday said the storage unit was one of two that contained explosives. The other unit was in Danville, Va. Christopher F. Kent, 29, was arrested Thursday in Virginia. Kent was detained when an investigator with the Halifax County Sheriffs Office encountered him inside a 1997 Honda Accord on the side of...

Justice Department's legal opinion on Second Amendment is "politically schizophrenic," Libertarians say WASHINGTON, DC -- The Justice Department's new legal opinion concerning the Second Amendment is "political schizophrenia at its worst," Libertarians say, because it asserts that individuals have a right to own a gun while pledging to enforce laws that infringe on that right. "This ruling is very good news - and very bad news - for gun owners," said Libertarian Party Executive Director Steve Dasbach. "The good news is that the government finally recognizes that the Constitution protects individual Americans' right to own a gun. But the bad...

Ladies and Gentlemen, I am annoyed. I humped/drug/carried an M-60 machine gun through the woods of North Carolina, Alaska, Panama, Georgia, and - well, you name it. It weighed 23.6 pounds (a number ingrained in my anatomy), plus 7 pounds/hundred rounds of ammo. I often went without food, in order to carry more ammo. So did my crew - we could live on short rations, but not short on ammo. Why, exactly, am I less trustworthy as a civilian to fire this pig? What have we lost, in the way of freedom, while I wasted my time defending it?
