Prospects for Constitutional Carry in 2022

At the start of 2021 there were 16 members of the Constitutional Carry club in the United States of America. They were:

2021 was a record year for Constitutional Carry. In 2021, five states joined the Constitutional Carry club, increasing membership from 16 to 21. The last and largest state to join the club was Texas. The four other states to join the club in 2021 were Tennessee, Iowa, Montana, and Utah.

Several other states are working to pass Constitutional Carry bills. Here are states and possibilities for Constitutional Carry in 2022.

The first in line, with bills that have passed both the House and the Senate, is Ohio. The bills in Ohio have differences, which need to be worked out. Ohio Governor Mike DeWine has been silent on Constitutional Carry. He may or may not sign a bill if one is sent to him. If he vetoes a bill, there may be enough votes in the Ohio legislature to override the veto. We should have more information on what is happening in Ohio by the end of January 2022.

Pennsylvania passed a Constitutional Carry bill through the legislature and sent it to Democrat Governor Tom Wolf. Governor Wolf vetoed the bill. Wolf is up for election in the mid-term elections in 2022. If a Republican is elected to governor in 2022, Constitutional Carry could pass in 2023. Expect Constitutional carry to be an issue in the Governor’s race.

I expect 2-4 states will pass Constitutional Carry (permitless carry) in 2022.

I’d consider it more of a gain to get the remaining may-issue states to shall-issue than to move shall-issue states to constitutional carry.

But I don’t see how we can get that through the remaining state legislatures.

There is a reasonable shot the “may issue” will be forced into “shall issue” by the coming NYR&PA Supreme Court case.

Correct.

I doubt the Supreme Court would have taken the case to keep the status quo.

The question is: How far will they move to restore Second Amendment rights?

The big change is the replacement of rabidly anti-Second Amendment Ruth Bader Ginsburg with pro Second Amendment Amy Coney Barret. That is an effective move of two votes.

We do not have to rely on Chief Justice Roberts, who seems to have moved, minimum to a swing vote, if not completely to the dark side.

The only reason the PA legislature passed it was to score political points with their constituents knowing Wolf would veto it. If they get a governor willing to sign it, no such legislation will be forwarded for signature.

It has been my experience that is not usually the case. Once Constitutional Carry is passed, it cracks a psychological barrier. Legislators are much more likely to pass it in the future.

How ironic is that that of all states, VT has been Constitutional carry for so long and the only one at that?

NH is currently working on getting rid of the last remaining impediments for purchasing firearms.

However, that is for NH residents. Don’t expect to be able to buy a gun if you are from a state that has restrictions. I have seen people in the store be turned down for a gun purchase when they show their driver’s license and it shows them from CT or MA. The gun stores will not sell to people from certain states.

Sales of pistols to out of State residents is not up to the states fedgov and the alphabet boys control interstate pistol sales and currently it is illegal as a federal felony to transfer a pistol from a FFL licence holder to anyone who is not a resident of their State. The only legal transfer is from one FFL to another of the pistol is to cross state lines. Here is the relevant USC code

I would hope you’re right, but having been born and raised in PA and having lived and worked there intermittently in my adult years, I remain cynical about the political machinations of the PA GOP. Their bluster when they’re out of power is matched only by their inaction when they’re in.

With Edwards gone, I think Louisiana is a “shoo-in” to pass it. Sure hope my home state “gets with the program” FINALLY.

In Florida I want to see them allow OWB carry.
In view of the hot weather in Florida most of the
year wearing concealing jackets and shirts and
uncomfortable IWB holsters is just silly.

We see security guards and others wearing large
guns and the ones civilians carry are much smaller.

Visible weapons is also a deterrent especially
when a woman is carrying it in an open OWB holster.

You are correct to remain cynical. I am cynical as well, and for good reason.

Second Amendment voters are reasonably good at holding state legislators to what they say.

Not perfect, but reasonably good. The only thing really pushing to prevent Constitutional Carry is Bloomberg money.

The data are against them. Even the Media is finding it harder and harder to make a case against it, now that 20 states have enacted it without ill effect.

It seems, once they vote for it, it is much easier for them to vote for it again.

Well not exactly. It takes four to grant cert, five to move the ball. OTOH, presumably the four are counting their votes.

If we can get another 2-3 states this year that’s good progress. I think a lot will depend on the midterm elections. If those go well as I expect they will, then impediments to constitutional carry in another 3-4 states will be removed and we should see another 3-4 states join club in 2023. At that point, we’ll have over half the country.

Only SCOTUS could force “shall issue” on my state (Maryland). I’m not confident that even that would work.
