The Supreme Court’s delays in deciding Donald Trump’s immunity case are creating a crisis — a collision between a Justice Department tradition and the necessity of an informed electorate. On one hand, voters deserve a verdict in the trial accusing Trump of attempting to interfere with the lawful transition of power after the 2020 election. On the other, the Justice Department customarily respects “election year sensitivities” — not initiating legal actions that could affect an election in the months immediately before it. This looming conflict was easily avoided. Unfortunately, however, the court’s radical conservative majority rejected three sensible ways to...

A federal judge on Wednesday found that the “selective prosecution” of far-right groups without charging their far-left counterparts for the same acts is “constitutionally impermissible.” U.S. District Court Judge Cormac Carney of southern California therefore dismissed charges against two men from the “white nationalist” Rise Above Movement (RAM) who violently clashed with members of the far-left group Antifa at three southern California pro-Trump events in 2017. In his 35-page order, the judge stressed the importance of equal protection under the law. He said that although the two men may have been involved in violent acts, prosecutors were wrong to exclusively...

TALLAHASSEE, Fla. — A federal judge on Thursday struck down key provisions of a 2021 Florida election law championed by Gov. Ron DeSantis and, in a remarkable move, ruled the state must get court approval for the next 10 years before it enacts further changes in three areas. Chief U.S. District Judge Mark Walker, in a blistering 288-page decision, said the law placed restrictions on voters that were unconstitutional and discriminated against minority citizens. Those included limits on drop boxes used for mail-in voting, on giving items to voters waiting in line and new requirements placed on voter registration groups....

For decades, a debate over lifetime appointments in the federal judiciary have pitted those who value freedom from political influence against those who see a need for accountability. The former want to continue the tradition, and the latter want either term limits, retention elections, or a combination of both, as many states have in place now. No serious effort has been made to propose such a system, but perhaps an “exit interview” by the New York Times’ Adam Liptak of retired appellate jurist Richard Posner will prompt one. And it should, as Posner inadvertently makes the best possible case for...

Harsh Politically Motivated Criticism By Hillary Clinton and Republican Establishment Shows Why They Are Not Honest With The American People About Our Legal System and Judges Washington, D.C., Today, Larry Klayman, a former prosecutor for the U.S. Department of Justice who was on the trial team that broke up AT&T, and founder of Judicial Watch and now Freedom Watch, issued this statement in response to the overly harsh and dishonest criticism leveled against Donald Trump over federal judge Gonzalo Curiel’s alleged bias and prejudice against him. Klayman has this to say: “This harsh criticism, designed to inflame Latino-Americans, and influence...

(Jan. 6, 2012)— At approximately 3:05 ET, Atty. Orly Taitz contacted The Post & Email following the hearing scheduled for today in Taitz v. Fuddy in the First Circuit Court in Honolulu with Judge Rhonda Nishimura. Astoundingly, although we are told that Nishimura was aware that Taitz was not available on January 26, 2012 because of a ballot challenge hearing in Atlanta, GA, she scheduled a hearing on the subpoena issued by the court in Georgia for the very same day. Taitz said that because of the Motion for Reciprocal Subpoena Enforcement filed with the Hawaii court, Judge Nishimura was...

Liberals have stacked courts for years So their latest criticisms over Conservative committee appointments is bizarre Lorne Gunter, The Edmonton Journal Published: Friday, February 16, 2007 You've got to hand it to the federal Liberals. Not even defeat chastens them. In power or out, they still maintain that everything they do is objective, pure, enlightened, and altruistic. The most recent example: accusations that the Conservative government is politicizing the appointment of judges, whereas they never did. This would be rubbish whether the Liberals believed their own accusations or not. But it would less ridiculous if they saw through their...

Government prosecutors took an unusual series of legal actions late Monday, seeking to prevent the case of two pro-life supporters of James C. Kopp from going to trial before a federal judge in Buffalo. In Buffalo, they filed court papers to drop the charges they filed last year against Loretta Marra and Dennis Malvasi of Brooklyn, who are accused of helping Kopp avoid capture by the FBI after the sniper murder of an Amherst physician. In New York City, they filed a new, greatly reduced criminal charge against Marra and Malvasi. Essentially, prosecutors asked to have the case moved from...
