On Tuesday the Supreme Court heard oral arguments in two cases whose plaintiffs contend that legislative redistricting which disproportionately favors the political party in charge of the redistricting process is unconstitutional. These cases present the starkest possible test of whether the Court’s new, supposedly originalist five-justice majority will restore respect for the Constitution or follow previous SCOTUS majorities down the path of judicial imperialism.
