Not even vending machines are outside the scope of Obamacare mandates. Under the bill's new labeling regulations nutrition information must be placed next to each slot of candy bars, chips, peanuts and cracker-jacks. Around 457 pages into Obamcare, section 4205 stipulates: "the vending machine operator shall provide a sign in close proximity to each article of food or the selection button that includes a clear and conspicuous statement disclosing the number of calories contained in the article."

New York City health officials won a big victory Wednesday when a federal judge upheld a regulation requiring some chain restaurants to post calories on menus and menu boards. U.S. District Judge Richard Holwell rebuffed a challenge from the New York State Restaurant Association, an industry trade group that argued that the rule violates the First Amendment by forcing restaurants to "convey the government's message regarding the importance of calories." The Department of Health and Mental Hygiene believes the regulation, which takes effect Monday, will help the city achieve its goal of reducing obesity. The judge agreed. "It seems reasonable...
  • Scandal Sinks Menu Labeling Supporters

Earlier this year, some of the most notorious food cops in the country (including Kelly Brownell and NYC Health Commissioner Thomas Frieden) attacked University of Alabama researcher and (at the time) Obesity Society president-elect Dr. David B. Allison for providing expert testimony to a federal court against mandatory menu labeling. The evidence he presented was damning. Rather than refute Allison’s claims, however, power-hungry health officials attacked his character. Now, evidence has come to light that challenges the reputability of the very same people who accused their colleague of bias. Today’s New York Sun reported that the one study which comprises...
  • Santa told to slim down for Christmas to 'set a good example'

Santa is being told to shift the pounds before Christmas - because the obese saint is failing to set a "good example" for children. The traditional children's hero, best known for feasting on mince pies left out on Christmas eve, has always sported a bulging midriff. But shopping centre bosses are giving the well-wisher his marching orders - to the nearest gym - to tackle the increasing problem of obesity. The revelation comes after a medical report earlier this month stated that by 2050 more than 50 per cent of Brits will be obese. Santa has been told he must...
  • New York City Reintroduces Calorie Rule

The Bloomberg administration, in its continuing fight against obesity, reintroduced a measure yesterday to force chain restaurants to display calorie information on their menus or menu boards, after a federal judge struck down a similar measure last month. Many chains, including McDonald’s, Burger King and Starbucks, already provide calorie information on their Web sites or on posters or tray liners. But health officials say customers rarely see this information before deciding what to order. The regulation would require the calorie counts to be posted as prominently as the price of each menu item. For many fast food outlets, that means...

WASHINGTON (AP) -- Kellogg Co., the world's largest cereal maker, has agreed to raise the nutritional value of cereals and snacks it markets to children. The Battle Creek, Mich., company avoided a lawsuit threatened by parents and nutrition advocacy groups worried about increasing child obesity. Kellogg intends to formally announce its decision Thursday. The company said it won't promote foods in TV, radio, print or Web site ads that reach audiences at least half of whom are under age 12 unless a single serving of the product meets these standards: -No more than 200 calories. -No trans fat and no...
  • Calling in Fat

Stomach aches, sore throats, and hacking coughs are standard excuses for calling in sick, but a recent report released by the Texas Comptroller of Public Accounts hints that employees' obesity may soon make the list. Using data from only a handful of companies in Texas, the study claims that obese employees cost state businesses billions, mostly in the form of health care bills, decreased productivity, and absenteeism. As a means of addressing the issue, the report concludes: "Ultimately, of course, only the individual can be held accountable for the lifestyle choices he or she makes." But take this lip-service statement...
