Pinellas Pasco Judge Greer set October 15, 2003 at 2:00 p.m. for her feeding tube to be removed. There's something wrong with Florida's exit protocols and the way the courts handle new information re: criminality (misrepresentation, attempted murder, etc.) affecting a case. There was no living will, only the assertion of a very suspect, so-called husband, his brother, etc. that Terri would not want to live on life support. Terri is not on life support, she is not comatose or PVS and she is not living "artificially". She does get sustenance from a feeding tube but only because she has been denied rehabilitation by her so-called husband after he won a malpratice lawsuit three years after her collapse (cause unknown but probably due to strangulation or physical abuse, or both) which is why Terri needs an army of supporters to spread her story from coast to coast. Terri has retained rights that are being sidestepped because she is disabled and has been denied rehabilitation! The technologies of rehabilitation have greatly improved exponentially yet Judge Greer has not let Terri have a chance to learn to eat or to be able to learn to speak/communicate again. Also new information bearing on the case which shows criminality on husband's side has not been considered by the 2nd District Court of Appeals who handed down Mandate for termination of Terri's feeding based upon testimony of criminal husband and brother as above stated. Who is next?

This is amazing, sfrummygirl. Federal Court will not be a walk in the park for hubby and counsel. Governor Bush's brilliant counsel has made a distinction between putting someone out of their misery and just starving someone to death. BRILLIANT!!!!!

Theodore, I don't think that Crist is "on the side of" Schiavo, necessarily. In his filing, he is only stating his belief that the FL statutes are constitutional. Honestly, this legalese is very confusing to me so I could very well be totally wrong, but my thinking is that the FL laws seem to carry safeguards (clear and convincing evidence, what constitutes PVS, the right to challenge decisions on ending life support blah blah blah) but where the law falls down is that ultimately the JUDGE has final control and in this case the judge is mind-numbingly biased in favor of ending Terri's life. He did not reasonably weigh all the facts of the case. Crist even said in his brief, at least on one point, that the Schindler's don't seem to have a dispute with the statutes, but with the APPLICATION of the statutes by Judge Greer. Crist is just defending the constitutionality of the statutes, but does not offer an opinion on the merits of the case. Like I said, I could be totally wrong about this, but it seems to me that it boils down to judicial misconduct - the mis-application of the laws by Greer.

As far as Jeb is concerned, the only point he is addressing is the fact that Greer is not allowing Terri the right to try to take food and hydration by mouth. THIS is in violation of her right to life. He is not disputing Michael's right to remove the tube, but only that Terri needs to be allowed to try to eat and drink by mouth first.

While Terri may not be able to eat orally again, there is enough doubt as to her potential for that limited rehabilitation that to do otherwise deprives her of her life without due process. If the guardian and the courts refuse to entertain such an option, they are arbitrarily and capriciously depriving Terri of her constitutional right to life...."

My only concern now is that 'due process' part.

Due process could mean a jury trial and definitely includes ALL THE EVIDENCE including the secret fee petitions between J. Greer and hubby's attorney. Their conspiratorial actions will also be on the table. Due process will help Terri.

Terri is dead and her parents are sick. The fight is over money not whether she is alive. Do you know how many appeals this has been through. The parents are sick. Get a "Living Will.

I'm just bringing myself to read the part about Hugh Finn. This is one of the reasons I feel so strongly about Terri's case. I remember reading about Hugh Finn when it was happening, and the valiant attempt by Gov. Gilmore to save him. I couldn't believe it was happening. Now I feel guilt in not stepping into the fray myself. If I had known then what I know now, maybe......

Okay. I only got about half-way through the story on Hugh Finn, and I feel like I'm going to pass out, combination of anger, horror, and most of all, grief. How can people be so heartless, so monstrously cruel. I need to take a walk.

I am praying for you. I understand your horror and grief. I have experienced it after reading about not only Hugh, but also for Christine and some of the others.

This last weekend at church I had a woman put her arms around me and pray for me to be healed from the horrors of the reading I have done. I highly recommend this to you.

Also please pray for the UK, where right now a bill is in Parliament about the rights of those with mental disabilities. Scotland has already passed a similar bill and it is not pleasant to read the results.

Marian Sallery.

Marian was paralysed after a stroke in 1983 when she was 36 years old. Doctors told her parents that she was in PVS and would always be "a cabbage." They discussed, in her presence, withdrawing her food and fluids so she would die. Her parents refused. Marian was transferred to the Royal Hospital for Neurodisability in 1990, and subsequently to a Leonard Cheshire Home, where she lived happily until her death in 1994.

A post-mortem revealed that Marian had never been in PVS. Instead she had Locked-In syndrome, a condition in which the person cannot move or communicate but remains fully conscious and aware. Marian's mother says the doctors "stood by her hospital bed and told us we should live our lives and accept that she was dead. She would have heard everything."

Note that the doctors stated that Marian was "already dead" before the planned withdrawal of food and fluids. It needs to be argued in the strongest possible terms that living with a profound disability is not tantamount to death, and that most disabled people need protection from the harm of being assumed to be "as good as dead."

It should be noted here that the British Medical Association have argued that cases of withholding or withdrawing food and fluids should be extended to people with advanced dementia, or who have had a severe stroke.

Delegate Bob Marshall has a great page with lots of evidence on it about the Hugh Finn case. It reads like a rerun of Terri's story in reverse. Lies, deception, hate, and evil everywhere you look on the side of killing him.

I don't know how the evidence could be any more visible than it is in these stories. The evidence of the evil one behind the killing, that is. Every sign post points in that direction in huge, bright letters.

By far the worst thing I have read yet is the PBS documentary transcript of the killing of Nancy Cruzan. Every day they went in with cameras and spoke with her father and the staff. They stood there as she died, a woman who had smiled, eaten food, and responded with eagerness to her can of food being opened at bedside, before they removed her feeding tube.

They stood there and made comments about her appearance and the progression of her dehydration, in her presence, and for the camera.

It brought me to a depth of pain that I have rarely felt in my entire life, to think of Nancy lying there while they made her death into a documentary and spoke about her as if she were a table ornament.
