Blogger admits Hawaii birth certificate forgery, subverting Obama claims (Uh-oh)

Jay McKinnon, a self-described Department of Homeland Security-trained document specialist, has implicated himself in the production of fraudulent Hawaii birth certificate images similar to the one endorsed as genuine by the Barack Obama campaign, and appearing on the same blog entry where the supposedly authentic document appears.

The evidence of forgery and manipulation of images of official documents, triggered by Israel Insider's revelation of the collection of Hawaii birth certificate images on the Photobucket site and the detective work of independent investigative journalists and imaging professionals in the three weeks since the publication of the images, implicate the Daily Kos, an extreme left blog site, and the Obama campaign, in misleading the public with official-looking but manipulated document images of doubtful provenance.

The perceived unreliability of the image has provoked petitions and widespread demands for Obama to submit for objective inspection the paper versions of the "birth certificate" he claimed in his book Dreams from My Father was in his possession, as well as the paper version of the Certificate of Live Birth for which the image on the Daily Kos and the Obama "Fight the Smears" website was supposedly generated.

Without a valid birth certificate, Obama cannot prove he fulfills the "natural born citizen" requirement of the Constitution, throwing into doubt his eligibility to run for President.

McKinnon, who says he is 25-30 years old, operates a website called OpenDNA.com and uses the OpenDNA screen name on various web sites and blogs, including his comments and diary on The Daily Kos. In recent years he has divided his time between Long Beach, California and Vancouver, British Columbia. He is a Democratic political activist, frequent contributor to the left wing Daily Kos blog, and a fervent Barack Obama supporter.

That is odd. I just did some searches on forms of ID and proof of citizen in the Federal government searches and a Passport is valid ID and valid proof of citizenship.

Yes, but since the passport has no physical description, the Notary did not regard it as sufficient ID.

The problem is— how did the zealot staffer get a copy of his sister’s birth certificate?

If it was in fact Maya's CoLB that was used, (a late FILED document, she was born in Indonesia)the 'zealot staffer' may be Maya herself. She works for the campaign, and almost all images released to the media that I have seen are originally credited to Maya Soetoro-Ng.

I gather that most of the controversy re dates and captions in relation to the images released are due to Maya.

Another one for under the bus coming up?

Ok, some research on whether a treaty can supersede a provision of the Constitution. Here is a link to an article with solid case references that discuss the subject. Some quotes:

By the supremacy clause, both statutes and treaties “are declared . . . to be the supreme law of the land, and no superior efficacy is given to either over the other. As statutes may be held void because they contravene the Constitution, it should follow that treaties may be held void, the Constitution being superior to both. And indeed the Court has numerous times so stated.

...

It need hardly be said that a treaty cannot change the Constitution or be held valid if it be in violation of that instrument.” The Cherokee Tobacco, 78 U.S. (11 Wall.), 616, 620 (1871)

...

In Power Authority of New York v. FPC, 247 F.2d 538 (2d Cir. 1957), a reservation attached by the Senate to a 1950 treaty with Canada was held invalid. The court observed that the reservation was properly not a part of the treaty but that if it were it would still be void as an attempt to circumvent constitutional procedures for enacting amendments to existing federal laws.

Justice Black in Reid v. Covert “... It would be manifestly contrary to the objectives of those who created the Constitution, as well as those who were responsible for the Bill of Rights—let alone alien to our entire constitutional history and tradition—to construe Article VI as permitting the United States to exercise power under an international agreement without observing constitutional prohibitions. In effect, such construction would permit amendment of that document in a manner not sanctioned by Article V.”

The bottom line is that a treaty cannot amend the Constitution. Citizenship specifically given in the 14th amendment cannot be repealed by a treaty with the Hauge.

On the other hand, citizenship given through statue can be overridden by a treaty (ie. born overseas).

As for a treaty overriding Congressional acts, the treaty and acts of Congress are on equal footing. When they conflict the one that was passed last is supreme. From another section of the same article:

What happens when a treaty provision and an act of Congress conflict? The answer is, that neither has any intrinsic superiority over the other and that therefore the one of later date will prevail leges posteriores priores contrarias abrogant.
