Pinellas Pasco Judge Greer set October 15, 2003 at 2:00 p.m. for her feeding tube to be removed. There's something wrong with Florida's exit protocols and the way the courts handle new information re: criminality (misrepresentation, attempted murder, etc.) affecting a case. There was no living will, only the assertion of a very suspect, so-called husband, his brother, etc. that Terri would not want to live on life support. Terri is not on life support, she is not comatose or PVS and she is not living "artificially". She does get sustenance from a feeding tube but only because she has been denied rehabilitation by her so-called husband after he won a malpratice lawsuit three years after her collapse (cause unknown but probably due to strangulation or physical abuse, or both) which is why Terri needs an army of supporters to spread her story from coast to coast. Terri has retained rights that are being sidestepped because she is disabled and has been denied rehabilitation! The technologies of rehabilitation have greatly improved exponentially yet Judge Greer has not let Terri have a chance to learn to eat or to be able to learn to speak/communicate again. Also new information bearing on the case which shows criminality on husband's side has not been considered by the 2nd District Court of Appeals who handed down Mandate for termination of Terri's feeding based upon testimony of criminal husband and brother as above stated. Who is next?

palmer, since you don't know the whole story, here is the jist of it- This is the ROE V. WADE OF FORCED EUTHANASIA OF DISABLED PEOPLE

The State of Florida is Paving the Way to Get Rid its Burgeoning Elderly and disabled population - it divines whether the person had a wish not to have life-support, by hearsay, and then withdraws said support. Michael Schiavo and the Judge Greer both have served on the board of the hospice that poor Terri is being kept in. Terri has been denied rehab all of these years.

Most horribly, on October 15th, they are going to remove a fairly young woman's feeding tube, and REFUSE TO ALLOW THERAPY THAT COULD RE-TRAIN HER TO EAT WITHOUT THAT TUBE.

Several Doctors have said that with rehab, Terri could improve. Her spouse has not spent 1 cent of Terri's medical rehab trust (from a so-called malpractice case) on Terri's rehab. He has denied her rehab, even put her in a hospice. Terri is not certified terminal. Florida is seeking to bend the laws, and I think there is great collusion to use Terri Schiavo for that end. I have seen videos of Terri, and she is not in a persistent vegetative state. Nor is she in a coma. The judge in this case and Michael Schiavo's attorney both have been on the board of hospice that Terri is being housed in. Mr. Schiavo has a live-in girlfriend and 2 children by that woman now, and stands to gain financially from Terri's death.

Federal Judge Dismisses Parents' Lawsuit in Terri Schiavo Case

Capitol Hill (CNSNews.com) - A federal judge in Florida has refused to take jurisdiction over the case of a disabled woman whose husband is seeking to allow her to die of starvation and dehydration.

U.S. District Judge Richard Lazzara also refused to enter an injunction to order tests to determine if Terri Schindler Schiavo can swallow food on her own prior to next Wednesday's scheduled removal of her feeding tube.

"The motion to dismiss was granted," Pamela Hennessy, spokeswoman for the Terri Schindler Schiavo Foundation said in a telephone interview just after the hearing Friday afternoon. "He denied the injunction, as well."

As CNS News .com previously reported Pinellas-Pasco County, Fla., Circuit Judge George Greer set Oct. 15 as the day healthcare workers must remove Terri’s gastronomy or “feeding tube.”

Doctors say the 39-year-old woman, who suffered a brain injury in 1990 under questionable circumstances, is expected to die of starvation or dehydration within 10 to 15 days.

Terri's parents, Bob and Mary Schindler, filed the federal lawsuit Aug. 30 against Terri's husband, Michael Schiavo, his attorney, George Felos, and two of the nursing facilities where Terri was kept in the past.

The suit alleged violations of the Americans with Disabilities Act, the Emergency Medical Treatment and Active Labor Act, the Rehabilitation Act of 1973 and Terri's civil rights under the First, Fifth and 14th Amendments.

The action was filed after three of Terri's former caregivers submitted sworn affidavits claiming years of denied medical care, altered or destroyed medical records, and alleged attempts by Schiavo to kill his wife.
Though Schiavo has previously denied those charges, Felos has refused to discuss any aspect of the story with CNSNews.com since Sept. 16, when he falsely accused the news organization of misidentifying him in a story.

In a motion filed Monday, Felos asked the judge to dismiss the Schindlers' suit or find in favor of Michael Schiavo. Felos called the lawsuit "yet another attempt to find another forum to re-litigate what has been litigated many times before."

The motion also disputed the claims by Terri's family that Michael Schiavo stifled attempts to provide her with rehabilitation and other therapy. It was that motion that Judge Lazzara granted Friday.

Florida Gov. Jeb Bush had filed a brief with the federal court Oct. 8, suggesting that the judge gather more information before ruling.

"In light of the seriousness of this matter, and the inability to remedy an improper outcome, the governor has a strong interest in ensuring that Terri Schiavo's fundamental right to life is not deprived without due process of law," Bush wrote.

Unlike Terri's parents, Bush has conceded Judge Greer's determination that Terri would not want to be kept alive artificially. The governor argued that new tests should be administered to determine if Terri could orally ingest food and water.

"Neither oral feeding, nor the tests and therapy to accomplish oral feeding, would violate Terri's wishes. Only her wish to be free of artificial life support has been proved by clear and convincing evidence, not a wish to die," Bush stated in his 12-page brief.

"While Terri may not be able to eat orally again, there is enough doubt as to her potential for that limited rehabilitation that to do otherwise deprives her of her life without due process."

Felos told the Tampa Tribune Wednesday that the governor is only partially correct.

"In general I agree with the governor's position. We as a society have a duty to bring the spoon to the mouth of the disabled person," Felos admitted. "But the whole factual basis of the governor's argument is false."

Felos claims, based on tests conducted several years ago, that Terri is incapable of swallowing food and, therefore, providing her nutrition and hydration through the g-tube is "artificial life support."

Greer ruled Monday that no new swallowing tests would be administered. The family has not yet announced whether they will appeal that ruling. Hennessy said Lazzara's dismissal of the federal lawsuit may not be subject to appeal.

If Felos' assessment is incorrect, the hospice workers responsible for removing the tube may have to choose between violating Judge Greer's order or Florida law. Under Title 46, Chapter 825, Section 102 (3)(a) of the Florida Criminal Statutes, the crime of "neglect of an elderly person or disabled adult" occurs as the result of:

"A caregiver's failure or omission to provide an elderly person or disabled adult with the care, supervision and services necessary to maintain the elderly person's or disabled adult's physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine and medical services that a prudent person would consider essential for the well-being of the elderly person or disabled adult."

Terri's parents have not yet said whether they might pursue criminal charges against the hospice workers if they attempt to remove the tube Oct 15.

Heavenly Father, we come before the Throne of Grace a very humbled people. We have come to know that our failure to elect those of moral character has torn at the fabric of our society. Your Word clearly states that if one cannot rule his family well, he is not fit to be in authority over others. And so we have come to know that those of immoral character have the authority to appoint judges, and it is those judges who are charged with the administration of justice. Thank You for those who rule well ... help us to rid our judicial system of those who do not.

Father, there are not enough tears or groanings to ask for forgiveness for what we have done. We who esteem the law, seemingly must stand by to see the immoral use of our justice system. Forgive us, I pray, for the loss of Your dear hand upon this country will be our doom. Were it not for You, Father, we would be without hope. I pray that You will break down that door and rescue her, for only You have the power to break through. We look to You, for we have nowhere else to go ... we plead to You because You have the power ... we worship You because You are God ... and we cling to the surety that tells us that in Your hand is the life of every living thing, and the breath of all mankind.

Father, we are in sackcloth and ashes, repenting of our sins of neglect ... lay not this against Terri, I pray, but save her, for Jesus sake, for the sake of her beloved parents, for the sake of humanity ... please, dear Jesus, in Your precious name, Amen ...

I found the article, and here is an excerpt that I think applies to this case:

Her case moved forward anyway, and on Sept. 13, 1990, the Florida Supreme Court handed down its ruling. It was stunning.

The court said a Florida resident has a "fundamental right to the sole control of his or her person" and "the constitutional right to choose OR refuse medical treatment, and that right extends to all relevant decisions concerning one's health." (emphasis mine)

As we can see from the guardian laws, this is a retained right, and cannot be delegated or refused by the court. Terri still has her right to choose or refuse, and it is not to be delegated to her guardian.

I am still so mad...but I will not stop praying for God's intervention.

744.3215 Rights of persons determined incapacitated.-- (

1) A person who has been determined to be incapacitated retains the right:

(a) To have an annual review of the guardianship report and plan.

(b) To have continuing review of the need for restriction of his or her rights.

(c) To be restored to capacity at the earliest possible time.

(d) To be treated humanely, with dignity and respect, and to be protected against abuse, neglect, and exploitation.

(e) To have a qualified guardian.

(f) To remain as independent as possible, including having his or her preference as to place and standard of living honored, either as he or she expressed or demonstrated his or her preference prior to the determination of his or her incapacity or as he or she currently expresses his or her preference, insofar as such request is reasonable.

(g) To be properly educated.

(h) To receive prudent financial management for his or her property and to be informed how his or her property is being managed, if he or she has lost the right to manage property.

(i) To receive necessary services and rehabilitation.

(j) To be free from discrimination because of his or her incapacity.

(k) To have access to the courts.

(l) To counsel.

(m) To receive visitors and communicate with others.

(n) To notice of all proceedings related to determination of capacity and guardianship, unless the court finds the incapacitated person lacks the ability to comprehend the notice.

(o) To privacy.

IMO, Terri has been denied these rights that she retains. How can ANY judge, I don't care at which level, NOT understand that they are removing Terri's retained right to (c),(d),(i), and (j). I just cannot fathom that these judges do not understand what the plain and simple meaning of these words are. The intention is clear! Terri has been deprived of these retained rights!!

That's wonderful, and as I suspected! I knew that God would allow Terri to communicate. Now we have to get back to that courtroom to make this all go away! I don't know which court, but if Terri can say yes and no reliably, then this is such a travesty of justice. Terri has a retained right to access to the courts. The court must see Terri for themselves!!She is still alive!! Why do they do this to her? (rhetorical)

Please, God, continue to intervene on behalf of Terri! We know that she wants to live! Please help the court see this!

Does anyone know if Terri has the ability to use her arms orlegs? If so, if she did not want to be fed and wanted to die, couldn't she have removed the tubes herself?

She does have some use of her arms and legs, though her muscles are not the greatest.

I just found out last you had been with this case for 4 months. I just checked and found out you are with Terri's family and helpers?? If so, can you elaborate on the above?
