Under President Obamas new policy, however, if the state that has just attacked us with biological or chemical weapons is in compliance with the Non-Proliferation Treaty, explained Gates, then the U.S. pledges not to use or threaten to use nuclear weapons against it.
Imagine the scenario: Hundreds of thousands are lying dead in the streets of Boston after a massive anthrax or nerve gas attack. The president immediately calls in the lawyers to determine whether the attacking state is in compliance with the NPT. If it turns out that the attacker is up-to-date with its latest IAEA inspections, well, it gets immunity from nuclear retaliation. (Our response is then restricted to bullets, bombs and other conventional munitions.)
However, if the lawyers tell the president that the attacking state is NPT noncompliant, we are free to blow the bastards to nuclear kingdom come.
This is quite insane. Its like saying that if a terrorist deliberately uses his car to mow down a hundred people waiting at a bus stop, the decision as to whether he gets hanged or 100 hours of community service hinges entirely on whether his car had passed emissions inspections.
Apart from being morally bizarre, the Obama policy is strategically loopy. Does anyone believe that North Korea or Iran will be more persuaded to abjure nuclear weapons because they could then carry out a biological or chemical attack on the United States without fear of nuclear retaliation?
The naivete is stunning.

Scanner has had packages all night and an attack on the electrical room of some place, that was “take this to blackout”, and not another word was heard on it. [San Diego]
I hate these new radios, that allow the police scanners to blackout some of their broadcasts and control who they go to.
The schools are getting a lot of calls, having incidents and intrusions into them at night, and the cops go all out on the first hint at a school.
I noticed yesterday that there were more than the usual number of school bus accidents, all reading “and the vehicle struck the bus.” [Yahoo news alert]

Second time it got hit in two weeks

Shots were fired overnight at the National Museum of the Marine Corps in Triangle, Va. — the second time the facility has been targeted in a month.
The shooting incident occurred just hours after the FBI linked a shooting that took place overnight Monday at a Marine recruiting center in Chantilly, Va., with two similar cases in the commonwealth — including an earlier incident at the museum.
Authorities are investigating to see if the most recent shooting also is linked.
Staff came into work Friday morning at the museum and found new bullet holes, a public information officer at the museum told Fox News.
No artifacts were damaged and no one was hurt, the officer said
Ballistic evidence showed the same weapon was used in three previous shootings, the FBI said Thursday.

Armed gunmen seen in Vekol Valley along I-8 may be Mexican assassins

On Monday, a Pinal County, Ariz. sheriff’s deputy spotted two Hispanic males armed with long rifles along Interstate 8 in the Vekol Valley. The men were hiding in the bush next to the road, and fled when the deputy spotted them. As they fled, one suspect dropped a backpack containing a loaded magazine and .223 caliber ammunition. Other evidence discovered at the scene indicated that a load of marijuana had recently been transferred to a vehicle. Law enforcement was unable to catch the fleeing gunmen.

Mesa Aviation Company and CEO Charged with Violating the Arms Export Control Act
PHOENIXA federal grand jury in Phoenix returned a two-count indictment against Floyd D. Stilwell, of Phoenix, Arizona, and Marsh Aviation Company, of Mesa, Arizona, for a violation of the Arms Export Control Act and Conspiracy.
The indictment alleges that beginning on and before November 2005 and continuing up to February 5, 2008, Stilwell, Marsh Aviation, and others contributed to the export of T-76 military aircraft engines from the United States to Venezuela for use by the Venezuelan Air Force. The T-76 engines are a designated item on the United States Munitions List which under the Arms Export Control Act makes it illegal to export without a license or written authorization from the Department of State. The T-76 aircraft engine was designed for the OV-10 Bronco Aircraft which is a Light Armed Reconnaissance Aircraft specifically suited for counter-insurgency missions.
Additionally, the indictment alleges that Stilwell and Marsh Aviation Company furnished assistance to members of the Venezuelan Air Force, including training in the assembly, testing, repair, maintenance, modification, operation, and use of the T-76 military aircraft engine, without having obtained the necessary license or written authorization from the Department of State. As a result of the indictment, Stilwell and Marsh Aviation were summoned to appear in court.

A conviction for a violation of the Arms Export Control Act carries a maximum penalty of 10 years, a $250,000 fine, or both. A conviction for conspiracy carries a maximum penalty of five years, a $250,000 fine, or both. However, in determining an actual sentence, Judge Paul G. Rosenblatt will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.
An indictment is simply the method by which a person is charged with criminal activity and raises no inference of guilt. An individual is presumed innocent until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.
The investigation preceding the indictment was conducted by the Federal Bureau of Investigation, U.S. Immigration and Customs Enforcement, and the U.S. Department of Defense, Defense Criminal Investigation Service. The prosecution is being handled by David A. Pimsner, Assistant U.S. Attorney, District of Arizona, Phoenix.
