George Pataki once again has blinked. He had the chance to take out controller Alan Hevesi, who has once again been forced to pay back money he stole from the State of New York for his wife's chauffeur but instead is hiding behind the pronouncements of Federal Prosecutor David Kelly, who has stated "that there is sufficient evidence for an indictment . . .but not sure of the rules of evidence that would be used in a State Senate trial."
