Why Is George Pataki Undercutting the GOP?

George Pataki once again has blinked. He had the chance to take out controller Alan Hevesi, who has once again been forced to pay back money he stole from the State of New York for his wife's chauffeur but instead is hiding behind the pronouncements of Federal Prosecutor David Kelly, who has stated "that there is sufficient evidence for an indictment . . .but not sure of the rules of evidence that would be used in a State Senate trial." Pataki needed to say the words, "He must go now" - so that underdog Chris Callaghan can win as controller, but he can't bring himself to say it since he would no longer be in the spotlight. The damage that Pataki continues to do to the New York State GOP is unbelievable! The RNC is giving Callaghan money so he may actually win. However, there are still New Yorkers, especially in the People's Republic of NYC, who would rather die than vote for a Republican.

George is still hoping to be able to secure deals, and for him and his friends to still be able thim to broker deals in the future, for his NY cronies, which will depend on working with and support from influential NY Dimorats.

His priority and focus on his cronies were the death of the GOP in New York, but he and his friends will continue to be deal brokers with the new powers.

That guy [Hevesi] has a commercial out in which he's weeping rivers about how he's a good man who just made a mistake. I believe an orchestra consisting entirely of small violins was playing in the background

The GOP may still hold the NY State Senate, and if that is true then "bi-partisan deals" will continue to be the grease that gets things done in NY State government, and Pataki and his cronies will not be absent, behind the scenes, to get some pieces of the action from time to time.

NY State Senate control can produce gridlock, unless Spitzer and the NY Assembly can "buy" cooperation from enough GOP State senators; the Assembly cannot veto the Senate and the Governor needs approval from both houses on most bills. The GOP State Senate leader will (continue to) look for who, on the GOP side, in the state they can secure something for, as the price of "bi-partisan" cooperation. Pataki and ole Al will not be far behind in the background.

Let's see if Callaghan can defeat him: he will need Demo voters to do so is the problem and too many of them are ideologues.

That guy Hevesi doesn't mention his rumored affair with a NYC councilwoman in those ads. He's just so devoted to his wife that he stole almost $200,000 in services from the taxpayers, though.

Hevesi will win tomorrow. This state is doomed.

You mean Melinda Katz - and I heard those stories many, many years ago and they finally showed up on Page 6 of the NY Post. Why weren't private detectives folowing Hevesi around

Hevesi, if he wins, is going to be a huge pain in the a*s for Spitzer.

Pataki is setting Spitzer up.

Yup.

Why weren't private detectives folowing Hevesi around

Callaghan can't afford it, and New Yorkers would probably vote for Hevesi anyway.

No way. Spitzer just says the voters decided Hevesi should remain in office and thus I'm doing nothing about it. Hevesi is a Democrat and Spitzer is a partisan hack who coddled Democrats as AG. Why would he stop coddling Democrats now?

the senate, if it remains in R hands, can impeach Hevesi. and they will. that's what puts spitzer in the box. does he ask Hevesi to resign? does he jump into the fray to support him?

Spitzer wants Hevesi to lose.

That is incorrect. Under Article VI, Section 24 of the NYS Constitution, the Democrat-controlled ASSEMBLY has the power to impeach, not the Senate. The Senate (plus the Court of Appeals Judges) try the impeachment - but the Assembly needs to act first. Do you seriously think Sheldon Sliver is going to start impeachment proceedings against one of his corrupt friends?

Short of that, Hevesi could be removed from office for misconduct or malversion as provided by the statute enacted under Article XIII, Section 5. But the removal statute enacted under that provision, Section 32 of the Public Officers Law, requires a recommendation for removal from the governor before the Senate can start removal proceedings. Do you seriously think Spitzer the partisan hack is going to start removal proceedings? He couldn't even muster up the strength to provide oversight over the Boys and Girls club that was funding Air America as AG - and that WAS his job (unlike the various witch hunts he started after Republicans in the business community).

Regardless of the method starting Hevesi's removal, both require a 2/3rds vote in favor of removal. The Republicans do not control 2/3rds of the State Senate.

If you vote for Hevesi, expect Hevesi to stick around for another 4 years. Do so at your own risk.

Democrats run the Assembly; the Senate is controlled by Republicans. A two-thirds vote of the Senate would be required to remove Hevesi from office. State law does not let the Senate initiate proceedings."

Absent a recommendation by the governor, the assembly would have to move first. you are correct, they won't. so that means Spitzer must deny the impeachment recommendation to the senate, thus it is Spitzer who must act to save Hevesi.

I don't really care if the senate removes Hevesi, I want Spitzer to have to take the heat to save him, as his first act as governor.

Spitzer is not going to remove Hevesi. He will say the voters have decided Hevesi's fate. Period. And the lapdog NY media will just go along with it.

Even if he does try to remove Hevesi, Spitzer will replace him with another Democrat partisan hack anyway.

There is no upside to voting for a thief for Comptroller.

as Dicker said this morning, if Spitzer's first act as governor is to save Hevesi - his "reform" agenda is history.

Inaction on Hevesi won't be Spitzer's first act - especially since Pataki had time to act first and didn't. Spitzer will insist that the people have spoken, and it is not his place to judge the will of the people. And that will be the end of it, unless the Albany County DA indicts Hevesi. The lap dog media will buy the explanation.

Dicker is wrong. I see no harm to Spitzer's so-called "reform" agenda if he doesn't act to remove Hevesi.

By the way, if voting for a Democrat crook gets me something, I don't want it.
