Trump can push Kavanaugh across the finish line and in a very Trumpian way. 1) Mention casually and in a campaign speech that if the Senate doesn't confirm Kavanaugh, he has other nominees in queue and the next one is someone the Democrats *really* won't like. 2) Invite Larry Klayman to come visit the White House, through a side entrance to make it look like Trump is hiding him clumsily. 3) Invite Janice Rogers Brown to make the same visit only she arrives through the front door. 4) Invite Judge Roy Moore to visit the White House through the side...

A Virginia school district says that a Bible verse engraved on bench memorializing a deceased student must be removed because it is not legal. Charlotte County School Superintendent Nancy Leonard said that the school board determined that the engraving on the bench was illegal because it violated the U.S. Constitution’s Establishment Clause, which states that the government cannot “establish” a state-sponsored religion. “We found that the memorial bench that we currently have is not legally compliant because of the Establishment Clause (in Constitution), because of the Bible verse,” Leonard told WAFF. The verse from Philippians 4:13 says, “I can do...

A Supreme Job Opening on Capitol Hill by John F. Di Leo Supreme Court Justice John Paul Stevens has announced his plans to retire, after some 35 years on the bench. Rather than focusing on the depressing aspects of this news, let’s focus on the bright side, and on the opportunities this will afford our country. The Vote We can take advantage of this news to (again) remind our friends who voted for Barack Obama in 2008 of the importance of their vote in presidential elections. We all know people who were so bored or angered by Senator McCain that...

Supreme Court » He promises to be tough but fair on nominee.Washington » Sen. Orrin Hatch, R-Utah, said after a private meeting with Supreme Court nominee Sonia Sotomayor on Tuesday that he likes her and is impressed with her skills, but he still plans to grill her during confirmation hearings. Hatch met with Sotomayor for nearly an hour in his office on Tuesday, the eighth speed date of the day for the 2nd Circuit Appeals Court judge whom President Barack Obama tapped last week for the Supreme Court. After the closed-door meeting, Hatch said he is keeping an open mind,...

SIERRA VISTA — As an Arizona ash grows at the Southern Arizona Veterans Memorial Cemetery, it eventually will provide shade for people as they sit on a concrete bench. The tree, bench and memorial plaque were dedicated Monday to honor the memory of Army Cpl. Casey Lee Mellen, who was killed-in-action on Sept. 25, while serving in Iraq. Not far from the tree and bench is the final resting place of the 21-year-old Huachuca City soldier. It was noted the tree can grow as high as 40 feet, and its canopy will provide shade for those who may want to...

Tuesday, August 2, 2005 School says bench stays where it is By Candice Cunningham Marietta Daily Journal Staff Writer MARIETTA - Despite one parent's questions about its "overtly religious" content and a possible constitutional violation, Marietta City Schools officials say they have no plans to remove a bench from the Marietta High School campus inscribed with the words "Jesus Loves You!" Marietta Superintendent Dr. Emily Lembeck said in a response letter to parent David Bernknopf on Friday that the bench would stay. "On the advice of legal counsel, there are no plans to do anything regarding the bench," Dr. Lembeck...

When Alabama Chief Justice Roy Moore refused a federal court order to remove a monument to the Ten Commandments from that state’s Supreme Court building, he became the central figure in a firestorm of criticism from the left. But his liberal critics weren’t alone. Conservatives also chided Moore, contending that his defiance of the order undermined the “rule of law” in America. Throughout history, the law has served several functions. In a free and morally upright society, it provides a framework within which the people can safely live their lives and pursue their dreams. In a dictatorship, however, it devolves...

Senate Democrats are preparing to once again filibuster President Bush's judicial nominees despite efforts by Senate Judiciary Chairman Arlen Specter (R.-Pa.) to extend an olive branch in hopes of reconciling differences. Liberal Sen. Chuck Schumer (D.-N.Y.) dismissed Specter's gesture Thursday and all but declared war on the nominees Bush resubmitted to the Senate last week. Hoping to avoid the so-called "nuclear" option that would change the Senate's filibuster rule, Specter said he would tackle the nomination of William Myers III to the 9th Circuit appeals court next Tuesday. Myers, by Specter's calculation, is only two votes shy of the 60...

Who sits on the Supreme Court for life may be more important than who sits in the White House for four years. With vacancies to fill among federal judges in general and vacancies expected to occur on the aging Supreme Court in particular, the stakes are very high in the judicial appointments made in the next few years. We and our children will be living with the consequences for a long time. This looks like an opportunity that may come just once in a lifetime to make judicial appointments that will stop the courts' dangerous pattern of continually eroding away...

Justices Uphold Lawyer Fees in Advocacy SuitsDefendants should pay if a public benefit results, even if there are no damages, panel says.By Maura Dolan Times Staff Writer December 3, 2004 SAN FRANCISCO — Lawyers for advocacy groups and others who file cases that achieve a public benefit should be rewarded by requiring defendants to pay their legal fees, a sharply divided California Supreme Court ruled Thursday. Justice Carlos R. Moreno, who wrote the 4-3 decisions in two related cases, said lawyers need incentives to bring lawsuits that generate beneficial changes but often produce little or no money in damages. The...

Imagine the unfairness when the UA men's basketball team plays Virginia this afternoon if the fans in Charlottesville were allowed to elect the referees. Now imagine the unfairness if judges in Arizona mostly were elected for their ideological purity by far-left liberals. Or far-right conservatives. Comparing judges to referees may appear to trivialize their role in our justice system, but both have at least one thing in common: They are supposed to be neutral. In Arizona right now, judges are as neutral as possible. That is because in 1974, voters decided that merit, not popular elections, should be the basis...

What mandate on moral issues, if any, did voters deliver to President Bush in the 2004 election? While liberal activists have attributed Bush's victory to homophobia, exit polls indicated that 35 percent of Americans favor gay marriage while another 25 percent support civil unions. Similarly, a majority of Americans favor restrictions on abortion, but not an outright ban. However, there is a consensus favoring the appointment of conservative judges who recognize that judicial restraint is itself a moral value. A September AP-Ipsos poll revealed that 56 percent of Americans prefer the appointment of conservative judges while only 37 percent prefer...

SAN DIEGO (AP) - The presiding judge of the San Diego Superior Court recused all 124 judges on the bench from hearing a lawsuit attempting to block write-in candidate Councilwoman Donna Frye from becoming mayor. Judge John Einhorn said he made the decision Wednesday because one of Frye's election rivals, incumbent Mayor Dick Murphy, was a judge for 15 years before he was elected mayor in 2000. Several judges have contributed to Murphy's campaigns, and Einhorn wanted to avoid any appearance of favoritism. Einhorn arranged with California Supreme Court Chief Justice Ronald George to have the case heard by Charles...

Teddy Kennedy used to oppose delays of judicial nominations, especially of women and minorities -- at least he claimed to. SEN. KENNEDY: "When the Founders wrote the Constitution and gave the Senate the power of advice and consent on Presidential nominations, they never intended the Senate to work against the President. . ."------ Republicans have often, and rightfully, denounced the efforts of Leftists to prevent a number of President Bush's quality judicial nominees from being confirmed. By blocking votes and dragging the nominees through the mud to make them look as bad as possible, Senate Democrats have delayed and denied...

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;" Judge Moore is about to be held in contempt of a court order demanding that he remove the statue of the Ten Commandments from in front of the courthouse where he has honorably served for years. This fact raises an interesting question, and exemplifies a blatant contradiction as well as our modern-day courts' insitence on trying to legislate from the bench. Our Congress is strictly and explicitly probitied by our Constitution from passing any laws prohibiting the free excercise of one's religion. If Judge...

A court in Germany has ordered a man to pay 75 euro for sitting on a park bench. The man was sitting on the bench in the Botanical Garden in Munich when he was approached by police. They told him he couldn't sit on the bench, next to a playground, unless he was accompanied by a child. He later received a letter telling him to pay a 150 euro fine, but went to court. The court heard the regulation had been established to protect playing children against drug addicts and prostitutes, who frequently come to the garden. But the man...
