President Donald Trump announced on Truth Social that he would rescind the force and power of any document signed by the autopen under the Biden administration. On Tuesday, Trump took to Truth Social again to delineate this guidance.

Any and all Documents, Proclamations, Executive Orders, Memorandums, or Contracts, signed by Order of the now infamous and unauthorized “AUTOPEN,” within the Administration of Joseph R. Biden Jr., are hereby null, void, and of no further force or effect. Anyone receiving “Pardons,” “Commutations,” or any other Legal Document so signed, please be advised that said Document has been fully and completely terminated, and is of no Legal effect. Thank you for your attention to this matter!

Former President Biden gave clemency to 4,245 persons, which included 80 pardons and 4,165 commutations. So, that's a whole lot of folks who could now be shaking in their boots.

As RedState reported, even before Trump moved to nullify any document or executive order that was signed by Joe Biden's autopen, there were major questions, and even a pending House Oversight Committee and Department of Justice investigations, on whether Biden was mentally capable of reviewing the documents that were signed, let alone authorizing the autopen's use.

So, Liz Cheney and Anthony Fauci, along with the autopen gatekeepers like former White House consultant Neera Tanden, Former White House Chief of Staff Ron Klain, Biden’s senior advisor Anita Dunn, and former personal attorney for Barack Obama, Robert Bauer, are possibly blowing up their lawyers’ phones with this news.

I see this case going all the way to the SCOTUS.

When I graduated OCS my commission was signed with an autopen. My high school and college diplomas were signed with an autopen. Judicial appointments and pardons are signed with an autopen.

The issue isn’t whether an autopen was used, but whether they were signed with Biden’s awareness and at his order.

It is well within any president’s power to cancel the executive orders and the proclamations of a predecessor.

But pardons? Nope. Such a move would go to the Supreme Court. Absent overwhelming evidence, Biden’s pardons will stand.

you are correct and he knows it also. So this is 1. Just a stunt or 2. A ploy to get a court to rule that it can not be done, so that in the future no future president can undo the pardons he gives out.

EOs - yes. Any president can undo the executive orders of a preceding president, since the current president runs the Executive Branch to which executive orders apply.

Pardons - no. The Constitution provides no mechanism for presidential pardons to be voided or canceled.

Yes. At the very least these people will need to pay a lot of lawyer fees to get these "Documents, Proclamations, Executive Orders, Memorandums, or Contracts" validated.

And that's their best case scenario.

It would have to be nothing less than Joe Biden clearly stating, “I never signed that pardon.”

Not some guy told some other guy.

Don’t get me wrong. I have no doubt that Biden was unaware of documents that contained his signature. But knowing is one thing. Proving it is quite another.
