The Republic of Kenya Constitution was established and ratified on December 12, 1963. The Constitution itself state in Article 3:

"Article 3

This Constitution is the Constitution of the Republic of Kenya and shall have the force of law throughout Kenya and, subject to section 47, if any other law is inconsistent with this Constitution, this Constitution shall prevail and the other law shall, to the extent of the inconsistency, be void.

That settles that.

In August 1964, Kenya was an independent Dominion within the British Commonwealth. As of December 12, 1964, Kenya became a sovereign Republic within the British Commonwealth. It is clear to me, in the context of British colonial terminology, that Kenya could not possibly have referred to itself as a Republic in August 1964. Positing that he was born in Kenya and that his mother never bothered to register him as an American citizen born abroad, then there's no plausible case for him to be considered any type of citizen --- he would be in fact an illegal alien.

The claim that Kenya became a Republic in 1964 is false. The Republic of Kenya was formed on December 12, 1963 when its Constitution was ratified.
