WASHINGTON – A U.S. senator has weighed in on the continuing controversy over Barack Obama's eligibility for office by saying he has never seen proof the new president was actually born in Hawaii.

"Well, his father was Kenyan and they said he was born in Hawaii, but I haven't seen any birth certificate," Sen. Richard Shelby, R-Ala., told constituents in Cullman County. "You have to be born in America to be president."

The 1940 census is due to be released to the public in 2010.

Not exactly, according to a friendly librarian I spoke to. It'll be 2012. Apparently the statute states that a census can only be released to the public 72 years after it is taken.

Actually it has always been done under the executive branch, but what O contemplates is much more White House control over the methodology. Of course, there may well be litigation over that because the techniques used may violate the statute governing the census taking or even violate the constitutional mandate for an "Enumeration" and representives apportioned by "Numbers." (The Left has in the past been pushing the use statistical estimates, i. e., "fudging.")

Oh. I guess you're right. Without doing more dogged research, it looks like the 1930 was released in April 2002, one genealogy site says it was released in 2005. Whatever.

As to the executive branch, I confess to not wanting to look it up and only remembered a smidgeon of what I read about that. Now genealogyfootprints says the 1940 won't be released until 2015. Another one hopes it will become public in 2012. But the bone of contention or controversy over it is as you said.

I won't be on it until the 1950; they do mess some up and miss some people. I think some people actually hid from the census takers but doubt it was over their immigration status. People not liking government nosing around isn't new :-)

I was sure glad when the 1930 did become available for my research. The 1910 was the best if I got the year right. It told how many children the mother had and how many were living. That made it easier to track distant cousins, etc., one of whom I've lost but know she probably was still living in 1910 and actually helped me solve another riddle until I finally found another missing one. That branch of the family eluded me for years!

Lots of provisions in the constitution allow Congress to pass legislation to define how particular constitutional powers should be executed. The "full faith and credit" clause allows Congress to define by statue how states recognize or not recognize the official acts of other states. In particular the "Defense of Marriage Act" specifically allows states to not recognize "same sex marriages recorded in other states.

True, but irrelevent. What you cite is is delegated power. "Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof."

But nowhere are they delegated the power to define the terms in the Constitution.

They were given the power to define who is, or can be, a naturalized citizen. (ie. "Congress shall have the power ... to establish an uniform Rule of Naturalization"), but not to define who is, or who is not a "natural born citizen". They apparently realized that after passage of the 10th amendment, as replaced the 1790 law which purported to do just that.

What you trolls don't seem to grasp and probably don't care, is that we know nothing about this clown. He is supposed to be potus and we don't even have a valid BC from him. Where he was born is up for debate as is who was his father just to scratch the surface of our many questions.

It just never ends with this clown and if you can't see our concern for that maybe a trip down to visit your brothers at the DU would be better venue for you rather than continually trolling this site.
