Notice: Continuation of the National Emergency Relating to Cuba and of the Emergency Authority Relating to the Regulation of the Anchorage and Movement of Vessels

On March 1, 1996, by Proclamation 6867, a national emergency was declared to address the disturbance or threatened disturbance of international relations caused by the February 24, 1996, destruction by the Cuban government of two unarmed U.S.-registered civilian aircraft in international airspace north of Cuba. In July 1996 and on subsequent occasions, the Cuban government stated its intent to forcefully defend its sovereignty against any U.S.-registered vessels or aircraft that might enter Cuban territorial waters or airspace while involved in a flotilla or peaceful protest. Since these events, the Cuban government has not demonstrated that it will refrain from the future use of reckless and excessive force against U.S. vessels or aircraft that may engage in memorial activities or peaceful protest north of Cuba. On February 26, 2004, by Proclamation 7757, the scope of the national emergency was expanded in order to deny monetary and material support to the repressive Cuban government, which had taken a series of steps to destabilize relations with the United States, including threatening to abrogate the Migration Accords with the United States and to close the United States Interests Section. Further, Cuba’s most senior officials repeatedly asserted that the United States intended to invade Cuba, despite explicit denials from the U.S. Secretaries of State and Defense that such action is planned. Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I am continuing the national emergency with respect to Cuba and the emergency authority relating to the regulation of the anchorage and movement of vessels set out in Proclamation 6867 as amended and expanded by Proclamation 7757.
This notice shall be published in the Federal Register and transmitted to the Congress.

Executive Order: Implementation of the Protocol Additional to the Agreement Between the United States and the International Atomic Energy Agency for the Application of Safeguards in the United States of America

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the United States Additional Protocol Implementation Act (the “Act”)(Public Law 109-401) and section 301 of title 3, United States Code, and in order to facilitate implementation of the Act and the Protocol Additional to the Agreement between the United States and the International Atomic Energy Agency for the Application of Safeguards in the United States of America (the “Additional Protocol”), it is hereby ordered as follows:
Section 1. The Secretaries of State, Defense, Commerce, and Energy, the Attorney General, the Nuclear Regulatory Commission, and heads of such other agencies as appropriate, each shall issue, amend, or revise, and enforce such regulations, orders, directives, instructions, or procedures as are necessary to implement the Act and United States obligations under the Additional Protocol.
Sec. 2. The Secretary of Commerce, with the assistance, as necessary, of the Attorney General, is authorized to obtain and to execute warrants pursuant to section 223 of the Act for the purpose of gaining complementary access to locations subject to regulations issued by the Department of Commerce pursuant to section 1 of this order.
Sec. 3. The Secretaries of State, Defense, Commerce, and Energy, the Attorney General, the Nuclear Regulatory Commission, and heads of such other departments and agencies as appropriate, are authorized to carry out, consistent with the Act and in accordance with subsequent directives, appropriate functions that are not otherwise assigned in the Act and are necessary to implement the Act and United States obligations under the Additional Protocol. The Secretary of State shall perform the function of providing notifications or information to the Congress when required by the Act.
Sec. 4. This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
Sec. 5. This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity, by any party against the United States, its departments, agencies, instrumentalities, or entities, its officers, employees, or agents, or any other person.

Two ton explosives cache found in Salah ad Din province
Multi-National Division North PAO
BAYJI, Iraq Iraqi Police, Sons of Iraq and Coalition Forces discovered a 4,400 pound cache of explosives, in Salah ad Din province during a joint operation, Feb. 6.
Iraqi Police and SOI noticed freshly disturbed dirt off an unimproved road. Coalition Forces investigated the site with IP and SOI assistance. Buried under a hidden tarp were 40 bags filled with a mixture of ammonia nitrate and cocoa powder, each weighing approximately 110 pounds or 50 kilograms. This mixture is commonly used as a homemade explosive commonly used by al-Qaeda in Iraq.
The Iraqi Police and the Sons of Iraq are committed to bringing stability to their country, said Lt. Col. William W. Prior, commander of the 4th Battalion, 9th Infantry Regiment. They prove this on a daily basis. Today they were able to make a significant impact in securing their country, their homes and their families.
Additionally, IP, SOI and CF consisting of 1st Battalion, 327th Infantry Regiment and 4th Battalion, 9th Infantry Regiment cleared several villages in the area.

Sons of Iraq turn in cache
Multi-National Division Baghdad PAO
BAGHDAD Members of the the Sons of Iraq, turned in a weapons cache to Coalition Forces near Mushada Feb. 6.
The contents of the cache included 67, 80mm projectiles; eight 90mm projectiles; miscellaneous ordinance; four speed-bump-type unfinished improvised-explosive devices; and five homemade rocket launchers.
The contents of the cache were turned over to Multi-National Division Baghdad Soldiers from the 1st Battalion, 14th Infantry Regiment, 2nd Stryker Brigade Combat Team.
An explosive ordnance disposal detachment was able to successfully recover and destroy the contents of the cache.
This is part of Operation Phantom Phoenix — the on-going offensive operation to kill or capture al-Qaeda and Shia/Sunni extremists, to deny them rest and sanctuary in Baghdad, and the surrounding rural areas.

Coalition forces capture Special Groups leader, detain four total suspects
BAGHDAD, Iraq Coalition forces captured a suspected Special Groups leader and detained three other suspects late Thursday during operations to disrupt criminal networks in the Mashru area, south of Baghdad.
The targeted individual was reportedly a deputy for Special Groups criminal elements in Wasit Province. Reports also indicate he was an associate of several senior-level criminal element leaders involved in attacks on Iraqi Security Forces and Coalition forces.
Intelligence led ground forces to the target area where they captured the wanted individual and the three other suspected criminals without incident.
“Coalition forces will continue to apply pressure on the criminal networks that are not honoring al-Sayyid Muqtada al-Sadr’s ceasefire pledge,” said Lt. Michael Street, MNF-I spokesman. “Those who honor his pledge are contributing to a safer Iraq.”

GAINESVILLE, Va. Prince William County police are searching for two tanker trucks that were stolen from a construction company lot in northern Virginia.
Officer Erika Hernandez says police received a report shortly after 6 a.m. that the trucks had been stolen overnight from the gated lot of construction company S.W. Rodgers in the Gainesville area.
A Homeland Security officials told FOX News their national operations center is monitoring the situation “very closely,” but it remains a local matter, adding there are no credible threats.
Hernandez says the trucks contain burnt oil. Both have Virginia tags, with license plate numbers TU-92271 and TW-47607.
Police say it’s not clear why the trucks were stolen.

BATON ROUGE, La. Baton Rouge police say a woman shot some people and then shot herself Friday morning at the Louisiana Technical College in Baton Rouge.
Few details were available. Corporal L’Jean McKneely said he did not know how many people were shot or whether there were any deaths.

BATON ROUGE, La. Baton Rouge police say a young woman killed two female students at Louisiana Technical College, then killed herself.
Sergeant Don Kelly said police don’t know the women’s names or ages, or whether the killer was also a student at the school.
He said the first two women killed apparently were in their seats in the second-floor classroom.
The incident occurred shortly after 8:30 a.m.
Kelly says Baton Rouge police got many cell phone calls saying people had been shot.

ALEXANDRIA, Va. (AP) — A tanker truck caught fire this morning on the Capital Beltway in northern Virginia, forcing authorities to close all lanes between Eisenhower Avenue and Telegraph Road.
Fairfax County fire department spokesman Dan Schmidt says crews arrived at the scene about 9:35 a.m. and found the vehicle on the shoulder of the highway completely engulfed in flames. Schmidt says firefighters put out the fire by spraying foam on the truck. He says it’s not clear what started the blaze.

American al-Qaida member missing?

Where is accused terrorist Adam Gadahn?
Thats what Taliban sources along the Afghan-Pakistan border are wondering about the American-born al-Qaida member. Gadahn, known as Azzam al-Ameriki (Azzam the American), joined al-Qaida in 2003 and has appeared in several bombastic al-Qaida videos since then. Federal prosecutors indicted the Californian for treason in October 2006, and he’s now on the FBI’s Most Wanted List.
U.S. intelligence officials have heard the same rumors, but tell NBC News that they have no information to suggest Gadahn is dead. They specifically deny that Gadahn was killed in the same Predator missile attack that killed al-Qaidas #4, Abu Laith al-Libi, last week near the town of Mir Ali in Pakistans North Waziristan province. Gadahn was visiting Mir Ali at the time, according to a local man who describes himself as a friend of Gadahns.
Jihadist sources on the Pakistan side of the border are telling local journalists they are worried. One who described himself as a very close friend of Gadahn said the 28-year-old California native had until recently been spending most of his time in the populated areas of South Waziristan, near the towns of Wana, Azam Warsak and Shahkai.
The same friend said Gadahn had left for North Waziristan a week before the Predator attack in Mir Ali, where he was supposed to attend an important meeting. The friend said that, after the Predator attack on January 31, they lost all contact with Gadahn.
“All our friends are worried about him but so far we could not make any contact with him. We had sent two of our friends to Mir Ali to locate him and provide us with details about him,” the supposed friend explained.
He added that other militants who traveled with Gadahn also were missing.
The self-described friend said Gadahn and his comrades may have decided to remain silent due to security reasons, or perhaps Gadahn was killed in the attack
Both intelligence and law enforcement sources says they have heard the same reports, but they tell NBC News they do not believe that Gadahn was killed in the Predator attack. However, they note that they are having difficulty determining the identities of the 13 people killed in the attacks.
Gadahn was last heard from on January 6,when a jihadist website posted several links to a 50-minute video featuring Gadahn, released by the media arm of Al-Qaida. Gadahn delivered most of the statement in English, but spoke in Arabic on several occasions to deliver Koranic recitations, religious rhetoric, and messages to Arabic speaking persons. One of these Arabic statements called on Muslims to greet President Bush during his January trip to the Middle East with “bombs and booby-traps.”
Gadahn also suggested the U.S. had lost in both Afghanistan and Iraq. How, Americans might ask, is it possible that the strongest and best-equipped army on earth has been defeated by lightly-armed mujahidin? The answer is self-evident: Right triumphs over might! he said.
The U.S. government is offering a $1 million reward for information which leads to Gadahns capture.
