  • Editorial: Don’t just deny Texas’ original action. Decimate it.

"...It is perfectly ordinary and appropriate for the justices to write an opinion explaining the various reasons why they are rejecting Texas’ request. Indeed, the minority of justices who think that the court is required to accept original actions like Texas’ may well write short opinions of their own or note that they think the case was properly filed. So there is nothing overreaching if a majority of the court explains why the case is meritless." "The justices’ decision whether to do that needs to account for this extraordinary, dangerous moment for our democracy. President Donald Trump, other supportive Republicans,...

The RNC shoots itself in the mouth Opponents of the Affordable Care Act and the Obama Administration really could not have had a better week. They did a tremendous job framing their constitutional argument against the statute to the public, the lawyers on their side were brilliant, and it appears that they had a receptive Supreme Court majority. It was an eleven on a scale of one to ten. Now this. The RNC released an advertisement (embedded in the story linked below) with audio from the halting beginning to Don Verrilli’s oral argument on the individual mandate to make...

Two Sandra Day O'Connors have served as Associate Justice of the US Supreme Court. It makes a world of difference which one President Bush chooses to replace. First, we look at the late O'Connor, the one who is retiring. The L.A. Times asserted this week that O'Connor “alone was in the majority of every one of the court’s 13 5-4 decisions this last term.” There are two tiny problems with this assertion. There were 24 such decisions this Term. And, Justices Souter and Scalia were in the majority in them more often than Justice O’Connor. See SCOTUSBlog for the facts....
