Judge orders DOJ to give Comey lawyers grand jury material — calls out ‘disturbing pattern’ of ‘missteps’
The New York Post ^ | By Samuel Chamberlain and Priscilla DeGregory

A federal judge ordered prosecutors Monday to turn over secret grand jury records in the case against former FBI Director James Comey to his legal team Monday, calling out “a disturbing pattern of profound investigative missteps, missteps that … potentially undermine the integrity of the grand jury proceeding.”

And one legal expert said the bombshell decision could spell disaster for the prosecution against Comey and potentially be a huge embarrassment for the whole Department of Justice.

In a 24-page ruling, US Magistrate Judge William Fitzpatrick accused the feds of flouting attorney-client privilege to secure an indictment of President Trump’s longtime nemesis, ripped interim US Attorney for the Eastern District of Virginia Lindsey Halligan for “fundamental misstatements of the law” to the panel, and flagged unexplained irregularities in the grand jury transcript.

Because of an incompetent prosecution, Comey is likely to walk on his traitorous deeds.

Pam Bondi should be fired for this alone. Without consideration to any of the other good reasons.

Because of an incompetent Democrat Magistrate Judge (not really a Federal Judge), Comey is likely to walk on his traitorous deeds.

Fixed. Please dump your defeatist predispositions.

Fitzpatrick's order has temporarily been stayed:

Right — this judge absolutely has it in for the prosecution... and because of that, they’ll be tied up in appealing these outrageous rulings .... likely for years.

In fact, I will go as far as this: I surmise that the gameplan here is to delay, delay, delay until the next Presidential election in the hopes of getting a wholly new DOJ that will refuse to pursue this case.

When an attorney acts in an unlawful conspiracy, the privilege is pierced.

Maybe she knew she couldnt succeed for whatever reason and let someone who has no business trying this case take the fall.

I havent read the details of the case. Dont know the issues. I just know Trump publicly called Bondi out for doing nothing

On May 9, 2022, William E. Fitzpatrick was sworn in as a Magistrate stooge in the Alexandria division of the United States District Court for the Eastern District of Virginia.

In 1998, stooge Fitzpatrick joined the United States Attorney’s Office for the Eastern District of Virginia and was assigned to the Alexandria Division’s Narcotics Unit.

In 2001, stooge Fitzpatrick transferred to the United States Attorney’s Office for the District of New Jersey, where he remained until 2018. He returned to the US Attorney’s Office for the Eastern District of Virginia in 2019, serving initially as the Chief and Deputy Chief of the Special Assistant United States Attorneys Unit and then as Chief of the Financial Crimes and Public Corruption Unit. stooge Fitzpatrick has served as an adjunct professor at George Mason University Law School and Saint Joseph’s University.

stooge Fitzpatrick was selected for an eight-year term by the United States district judges of the Eastern District of Virginia on the recommendation of a volunteer merit selection panel comprised of lawyers and other citizens from Northern Virginia.

Smells REAL Swampy to me. The chief stooge of the ED of Virginia is a Dubya stooge [2018 - present] - the one with the most say in Fitzwilliam’s appointment.

ED Virginia: 1 Dubya stooge, 1 Clinton stooge, 3 Trump judges, 2 Benedict Obama stooges and 4 Biden stooges.

Looks like a 7 to 3 vote for a Swamper. One of the Biden stooges wasn’t appointed till 2023.

Alexandria: 1 Clinton stooge, 1 Trump judge, 2 Biden stooges.

Well Michael Cohen was not allowed to testify against Trump because Cohen was Trump’s lawyer, don’t you remember that? Cohen was never even questioned. Oh wait... maybe I’m wrong about that.

This is a corrupt judge and not all the fault of Bondi or the government. This is what we will see in all future indictments of Democrat deep staters — judges that are biased toward the democrats

However, in response to an appeal by interim US Attorney for the Eastern District of Virginia Lindsey Halligan, US District Judge Michael Nachmanoff [Biden judge] ordered a stay of Fitzpatrick’s order.

“The Magistrate Judge’s new order is contrary to law and the government should be allowed to object to the order,” read the appeal, which added that Fitzpatrick “may have misinterpreted some facts he found when issuing the latest order to release the grand jury materials to the defendant.”

Nachmanoff gave the Justice Department until 5 p.m. Wednesday to file its full brief objecting to Fitzpatrick’s order, with Comey’s side having until 5 p.m. Friday to respond.

Gads - even a Biden judge can’t stand the stench from stooge Fitzpatrick.

Thanks...I hadn't bothered to check who had appointed Nachmanoff.

Intentionally incompetent prosecution is an old lawyer trick going back at least as far as Ancient Rome, to get politically connected and monied suspects off.

Man, you need to keep your mouth shut until you familiarize yourself with the facts of what is actually transpiring.

I know exactly what is happening.

An incompetent prosecutor left room procedurally and in technicalities to allow the case to be nit pic’d.

Didn’t follow established DOJ procedures.

Allowed an overlap in subpoena into privilege territory, without preparing an argument as to why it’s allowed as an exception.

They KNEW they had to get this one right and called it in.

That judge issued an order at 10:58 AM for the DOJ to release all grand jury information to the defense by 3:00 PM on the same day when usually the other side of the case has 14 days to respond or object.

No way that holds up.
