Several teen girls who were caught on video attacking a group of Asian students on a SEPTA train in Philadelphia have now been charged with ethnic intimidation and other offenses. On Thursday, the Philadelphia District Attorney's Office approved aggravated assault, ethnic intimidation, criminal conspiracy, simple assault, recklessly endangering another person and disorderly conduct against the four suspects, who are all under the age of 17. One of the suspects was also charged with an additional count of robbery for trying to steal air pods from one of the victims, the District Attorney's Office said.

Allegheny County Controller Chelsa Wagner will stand trial again in Detroit next year on a felony charge of assaulting, resisting and obstructing a police officer, barring a plea deal, her defense said Friday. The decision by prosecutors to retry the case against Ms. Wagner comes exactly one month after the end of her first trial, when a Detroit jury could not reach a unanimous verdict on the felony — prompting the judge to declare a mistrial on that count. That same jury in November acquitted Ms. Wagner of misdemeanor disorderly conduct — which, like the felony, stemmed from an encounter...

Boston, MA – When Suffolk County’s district attorney-elect Rachel Rollins takes over the prosecutor’s office in January, criminals will no longer need to worry about being held accountable for many offenses – including resisting arrest. “It’s a recipe for disaster,” veteran Boston defense attorney, Robert Griffin, told the Boston Globe. “The problem is the message that you’re sending,” Griffin stressed. “You’re encouraging bad behavior. You’re telling people that we’re not going to do anything about this.” Rollins, 47, has been widely hailed – and widely criticized – for her well-publicized “Charges to be Declined” list, which she has featured on...

There’s a buzz around this year’s Masters. Tiger Woods is back. “This might be the wildest year in Masters history,” CBS Sports reports. But the biggest news out of Augusta National this week is this: A popular, stupid beer catchphrase has been banned. Shout “dilly dilly” at the Masters and you’ll hear “doobie doobie doo” as a security guard sneaks up to eject you. That’s according to Bryce Ritchie, an editor at golf magazine Bunkered.

A female protester on the streets of Portland, Oregon, got an agonizing lesson about the hazards of disrespecting law officers and not following orders. The woman was marching during the liberal city’s “Not My Presidents Day” protest Monday when she approached officers in riot gear and began displaying the middle finger right to their face. The police took her to the ground, but seemingly that wasn’t enough of a warning to change her ways. With the help of other protesters, the woman got up and went right back to getting in their faces and raising her middle fingers once again....

Donald Trump said Sunday on Meet the Press that he's looking into paying the legal fees of the 78-year-old supporter who sucker-punched a black protester at a rally in Fayetteville, North Carolina on Wednesday. 'I've actually instructed my people to look into it, yes,' Trump told NBC's Chuck Todd. The Republican frontrunner did a tour of the Sunday shows this morning and was asked questions about the bouts of violence at his campaign events in recent days.

Poster by Oleg Volk Armed citizens a "bad example" for kids? Open carry promoting violence? Open carry of weapons has been legal in Alabama for hundreds of years, but some police officers and judges have used the disorderly conduct statute to disarm those who they wished to discriminate against. Given the history of black codes, and the Klan, this discrimination was practiced mostly against black people. Openly carried guns tend to put a damper on criminal attacks. That is one of the reasons that police openly carry guns. An openly carried gun loudly proclaims to observers: "I am not a...

Author's Note: check out www.letterstoayoungprogressive.com for a free chapter of my latest book. Students and their parents need to be warned about the latest serious threat to liberty on America's college campuses. They have probably already heard of campus speech codes, anti-discrimination clauses, and sexual harassment tribunals. The latest threat takes the form of "disorderly conduct" hearings. Many readers are wondering what exactly constitutes disorderly conduct. The more appropriate question might be "what does not?" Of course, it is natural for students to have conflict in college. Many are away from home for the first time and they are...

The Utah Senate was poised to pass a bill that would prevent open (and concealed) carriers from being charged with disorderly conduct for simply carrying their firearms in public, but the bill died after lawmakers couldn’t agree on a substitute version of the bill that contained objectionable language. In its original version, House Bill 49 (‘Firearms Revisions’) would prohibit a person who is lawfully carrying a firearm in public from being charged with non-firearm related crimes such as disorderly conduct or failure to disperse. The official language of the bill read, ‘… in the absence of additional threatening behavior, the...

A story in today's Philadelphia Daily News shows why it's so important that citizens be allowed to videotape cops - it can be citizens' only way to fight back against police abuse of power. This incident happened several weeks ago in Philadelphia to Mark Fiorino, a 25-year-old IT worker who carries a gun on his hip at all times for self defense. He got the gun after several friends were mugged. But he didn't count on attacks by police: On a mild February afternoon, Fiorino, 25, decided to walk to an AutoZone on Frankford Avenue in Northeast Philly with the...

Last fall five Wisconsin Carry, Inc. members were peacefully enjoying dinner at a Madison area Culvers restaurant. Like thousands of Wisconsin residents, they carry a sidearm for self-defense as a daily practice in the only manner currently provided by Wisconsin law. After a 911 caller inquired as to the legality of open-carry, Madison police arrived en masse and illegally demanded identification from all five. Two members who politely declined to provide ID were wrongfully cited for obstruction of justice. (Wisconsin, a free state, does not require you produce identification when you have done nothing wrong.) Those citations were rescinded 2...

MILWAUKEE -- A Milwaukee man said he thinks it's pretty darn ridiculous that he got fined $500 for swearing on a county bus. Terry Duncan said that he considers it un-American to get slapped with a $500 disorderly conduct fine for saying two words. The words in questions started with the letters "f" and "s." After Duncan uttered them last Tuesday, an undercover deputy ordered him off the vehicle and handed him the ticket. Duncan said he's new to Milwaukee, didn't know about the law and pointed out it's not posted anywhere in the bus. He said he simply cursed...

With no clear definition of what constitutes behavior that is 'disturbing' or 'disorderly', many in law enforcement use such laws as a way to both control and punish citizens for otherwise legal and constitutionally protected behavior. And thus the harassment suffered by five law-abiding members of Wisconsin Carry at a Culver's restaurant in Madison, Wisconsin last Saturday evening should come as little surprise.

One of the greatest threats to the free exercise of civil rights is the promulgation of catch-all offenses such as "disorderly conduct." With no clear definition of what constitutes behavior that is disorderly, many in law enforcement use such laws as a way to control and punish citizens for otherwise legal and constitutionally protected behavior.
