Disorderly Conduct Charges Dismissed (Wisconsin 5)

Last fall five Wisconsin Carry, Inc. members were peacefully enjoying dinner at a Madison area Culvers restaurant. Like thousands of Wisconsin residents, they carry a sidearm for self-defense as a daily practice in the only manner currently provided by Wisconsin law. After a 911 caller inquired as to the legality of open-carry, Madison police arrived en masse and illegally demanded identification from all five. Two members who politely declined to provide ID were wrongfully cited for obstruction of justice. (Wisconsin, a free state, does not require you produce identification when you have done nothing wrong.) Those citations were rescinded 2 days later and all 5 were mailed citations for disorderly conduct despite no evidence of a disturbance. Wisconsin Carry, Inc. filed a federal civil lawsuit against the City of Madison and Police Chief Noble Wray on September 29, 2010. That lawsuit can be viewed here: http://www.wisconsincarry.org/pdf/Madison/MadisonComplaint.pdf

Wisconsin Carry, Inc. also retained, on behalf of our members, notable defense attorney Chris Van Wagner, principal of the Madison law firm Van Wagner & Wood to contest the wrongfully issued disorderly conduct citations.

Today, Wisconsin Carry is pleased to announce that Attorney Van Wagner has informed us that all of the charges against the "Madison 5" have been dismissed. According to Attorney Van Wagner "The Madison City Attorney agreed after a full review of the police investigation and 911 call that there was absolutely no disturbance created by our members and that the disorderly conduct citations were inappropriate". Van Wagner also added that "The ONLY disturbance created on that Saturday evening was by a mass of uniformed Madison police officers and squads arriving to investigate law-abiding citizens having dinner."

Questions about this incident and subsequent actions by Wisconsin Carry, Inc. and our attorney may be directed to Wisconsin Carry, Inc. or Attorney Chris Van Wagner. Wisconsin Carry, Inc. will shortly be filing a second civil lawsuit against Madison Police Chief Noble Wray and the City of Madison to obtain damages on behalf of our members for their wrongful detainment and costs associated with disposing of the citations.

Wisconsin Carry, Inc. is a non-profit organization dedicated to the preservation and advancement of the ability of law-abiding Wisconsin residents to legally carry in the manner of their choosing (open or concealed).

You really want me to believe that thousands of WI residents openly carry a handgun on their hip every day?

Isn’t it more likely that should be “tens of Wisconsin residents” rather than “thousands?”

Still, doing that takes guts. Typical cop is not unlikely to shoot first and ask for an explanation later.

I hear you, but the trouble is that it won't cost the cops a thing, even a civil judgment will be picked up by the taxpayers. Disciplinary action? In Madison? Forget it. The deck is stacked.

Well, that would be only one tenth of one percent of people in Wisconsin. In a lot of states, 1-2 percent of the population have concealed carry permits. Wisconsin does not allow for concealed carry permits, so it is not hard to believe that one tenth to one twentieth of those who would go to some trouble to get a permit might carry daily in Wisconsin.

The right to carry is important enough that the arguments should not have to rely on exaggerations.

Sue under the concept of a violation of federal civil/constitutional rights - 2nd Amendment, even 1st Amendment, 4th Amendment as well.

Hell, throw the Constitution at these leftist bastards and sue them all. Who knows - you might win.

Only if you are out walking around in the woods or on farms like they are. In most rural areas up north people carry sidearms as protection against bears and other wild animals. No need to carry concealed, since the deer don't care if you are armed or not, and in many cases you have little need to carry a firearm around other people due to the very low crime rates.

Here in AZ millions of lawful residents are allowed to carry, concealed, or openly, without a permit.

OTOH, here in AZ, the federal government facilitated drug cartel members to buy guns, and then murder people,

The real question here is...who is the pencil-neck liberal who got his shorts all twisted out of shape that he had to call the police in the first place. That is the guy who is the most dangerous in our society running around claiming that loaded guns are invading our restaurants...Chicken Little style. This moon-beam obviously was prematurely cut off from breast-feeding by his mommy!

Yeah, but even the Liberal morons who run Madison will have trouble explaining the constant drain of cash for these kinds of egregious actions on the part of the cops to their citizens. Sooner or later the Chief is going to get his walking papers if he doesn’t stop the harassment lawsuits agains the “city.” Here’s hoping that Madison has to pay out a bundle on the Federal claim. I don’t feel the least bit sorry for Madison, or Berkeley, or Boulder, and any other of a long list of “university towns.”
