Then we can start up a Department of Homeland Sexual Morality, and enlist a bunch of citizen spies to peek in their neighbor's windows, and see if they can see anything icky going on.

Then all they have to do is call in a complaint on the homeland-homo-hotline, and the government will send agents to take them away.

Everyone poking around in everyone else's business.

Privacy is guaranteed by the fourth amendment, as we are to be secure in our homes, papers, etc. But, it sounds like privacy's not an issue with you. So, I take it that you'd be OK with the government folks coming into your house to see what you've been doing on your computer and whether you're feeding your children healthy meals?

Insurance companies should be able to refuse to issue policies, or should be able to charge appropriate premiums to homosexuals.

"Sexual preference" should be eliminated from discrimination laws. (The Libertarian position would be to eliminate all discrimination laws except those prohibiting discrimination by the government.)

Were people allowed to act more freely, I suspect homosexuals would either stop clamoring for "celebration" and keep their business private, or they'd gather in enclaves.

Where in the Constitution are States granted the right to legislate the private everyday conduct of citizens based on sexual preference? The law in question bans homsexualy sodomy but not heterosexual sodomy.

Is not a person's sexual behavior part of their life and is it not also a liberty and a "natural right" as defined by the term liberty?

If the USSC had issued a specific ruling making 'sexual conduct' a private right that is guaranteed protection from state rights, THEN you are opening the door to rulings on incest, child porn, etc.

They did not do this and I so no reaon why incest, statuatory rape laws or child porn laws are somehow in jeopardy as a result of this ruling.

I'm pretty sure that was how this case came about. They liked to scream and yell and make a lot of noise to annoy the neighbors so one day one of the neighbors called police and said there must be a burglary or a murder going on there.

The issue is the IMMEDIATE danger it presents to the rest of us.

There is a real danger, but its IMMEDIACY is questionable in my mind.

Which is precisely why banning smoking in bars and taverns for owners who want to have smoking is SO STUPID when compared to this ruling. You don't have to go into the bar. Reasonable precautions will prevent NON-IMMEDIATE danger to anyone who doesn't want to choose the danger.

Using that train of thought, should do away with child abuse, since that mostly happens behind closed doors.

Child abuse is usually discovered because of injuries to the child. Also has nothing to do with consenting adults. Different situation entirely.

The issue is this: laws define the morals of a society. When we ban sodomy, we are saying that homosexuality activity is immoral and ought not be encouraged, much like we ban prostitution (sex for money), but not sex for free.

Unmarried sex for free has also been illegal. Problem is, how are you going to enforce it?

You don't have to "spy" on a neighbor, which is what the 4th Amendment is for, but for when the crime is observed or come upon, like the vast majority of witness-associated crime occurs.

How are you going to enforce sodomy laws?
