Florida: Complaints over restaurants not complying with smoking ban

DUVAL COUNTY, FL -- Florida's smoking ban was officially put into place on July 1st but not everyone is abiding. The state has had close to 800 complaints on restaurants that are not complying with the rules.

In Duval County, there have been 19 complaints with the majority coming from customers of RP McMurphy's located in Jacksonville Beach. The restaurant has received a warning and has 30 days to comply.

I love it when people point to the Nazis and say "they were in favor of A, therefore A is bad." Nazis were also in favor of modern, four-lane highways, does that mean the interstates are Nazi? Nazis were big on family and childbirth (they had medals for prolific mothers). Does that means family and childbirth are automatically bad? Nazis were big on the health of the race, so they opposed smoking. Does that mean automatically that smoking is good?

I agree that the owners should be compensated for the taking of their property mrasured by the decrease in profits due to the smoking ban.

Unfortunately two groups disagree with me. The smokers disagree because they really don't gove two craps about the owner, they just want to be able to smoke and compensating the owner doesn't get them the result they want.

The second "group" is the courts who have ruled that this only applies to a full taking of the property. An imposistion of a regulation or law doesn't constitute a complete taking. I happen to disagree but then I'm not the judge.

On what grounds?

Its a taking of property and should be compensated for based on lost profits. The tricky part is calculating lost profits and the length of time.

Untrue. I've never seen a smoker try to enact legislation to force an owner to allow smoking, if he chooses not to have it. Have you? We respect private property rights.

That's great in Florida! They are starting a new ban in Maine come 1 January. ALL bars and taverns. The restaurants in Maine have been smoke free since 1999. Now they are taking away the bars and taverns. Can you imagine trying to smoke outside a bar or tavern in January, February and March? With the sub zero temperatures? That is why I won't be spending my money out anymore for recreation. They can keep it for themselves. I will stay at home, order in and have friends over.

While I support the ban. I do not support the kind of stupid, paper intensive, bureacratic stuff that She Lion is referring to. That mentality, that if it's not documented on paper then it didn't happen, is what is killing the Medical community and driving costs through the roof.

I, personally, don't smoke around children in confined areas. Does this mean I would actually vote for a law that enters someone's private property and disallows legal acts? NO NO NO. If you think a law destroying private property rights is going to somehow increase children's health, or make "abusive" parents "good", I would argue that you are sadly mistaken.

so to put it simply you are for any goverment intervention on Second Hand Smoke period. sorry what what I do in my own home is my business, and not the goverments, if I or my wife smoke in front of our grandkids, I will do that and risk the Suppost jail/fine.

That's fine. But like I said there are a lot of Conservative Smokers in Free Republic. When someone like him comes in and starts to trash his own just because we smoke, well, I won't stand for it.

We are decent people, and I won't stand for the likes of him and Minnie coming into our Smoking Threads and trying to make us look like fools. Many of us have studied this issue for a long time.

We do not take the words of Phillip Morris and the anti-smoking health fanatics to heart. We enjoy a legal commodity. And we are fighting for the rights of the business owner. I see no ill harm in this. If the government continues on, all our rights will be taken from us. Surely, you don't want to see that happen.

Also, I have health insurance. The state won't be taking care of me. I pay my own way!
