Breitbart News has obtained a promotional booklet produced in 1991 by Barack Obama's then-literary agency, Acton & Dystel, which touts Obama as "born in Kenya and raised in Indonesia and Hawaii."

Yeah but I don’t get it. I lived in Scotland for 3 years starting when I was 35 and I didn’t come back sounding like William Wallace. Never lost my New Yawk accent. How long did the Kenyan live in Chicago anyway? Also has anyone thought of checking out his status with INS? It’s quite possible he could have an expired student visa. But let’s not even look for that, let’s just see his record with the INS or is that shut off as well? I can’t see how due to the freedom of information act.
Somebody needs to ask Ms Goderich if they routinely made stuff up out of whole cloth at that company, without presenting what they wrote to their client for proofreading.
The Harvard Law Review, generally considered the most prestigious in the country, elected the first black president in its 104-year history today. The job is considered the highest student position at Harvard Law School.
The new president of the Review is Barack Obama, a 28-year-old graduate of Columbia University who spent four years heading a community development program for poor blacks on Chicago's South Side before enrolling in law school. His late father, Barack Obama, was a finance minister in Kenya and his mother, Ann Dunham, is an American anthropologist now doing fieldwork in Indonesia. Mr. Obama was born in Hawaii.
''The fact that I've been elected shows a lot of progress,'' Mr. Obama said today in an interview. ''It's encouraging.
''But it's important that stories like mine aren't used to say that everything is O.K. for blacks. You have to remember that for every one of me, there are hundreds or thousands of black students with at least equal talent who don't get a chance,'' he said, alluding to poverty or growing up in a drug environment.'
What a Law Review Does
Law reviews, which are edited by students, play a double role at law schools, providing a chance for students to improve their legal research and writing, and at the same time offering judges and scholars a forum for new legal arguments. The Harvard Law Review is generally considered the most widely cited of the student law reviews.
On his goals in his new post, Mr. Obama said: ''I personally am interested in pushing a strong minority perspective. I'm fairly opinionated about this. But as president of the law review, I have a limited role as only first among equals.''
Therefore, Mr. Obama said, he would concentrate on making the review a ''forum for debate,'' bringing in new writers and pushing for livelier, more accessible writing.
A President's Future
The president of the law review usually goes on to serve as a clerk for a judge on the Federal Court of Appeals for a year, and then as a clerk for an associate justice of the Supreme Court. Mr. Obama said he planned to spend two or three years in private law practice and then return to Chicago to re-enter community work, either in politics or in local organizing.
Professors and students at the law school reacted cautiously to Mr. Obama's selection. ''For better or for worse, people will view it as historically significant,'' said Prof. Randall Kennedy, who teaches contracts and race relations law. ''But I hope it won't overwhelm this individual student's achievement.''
Change in Selection System
Mr. Obama was elected after a meeting of the review's 80 editors that convened Sunday and lasted until early this morning, a participant said.
Until the 1970's the editors were picked on the basis of grades, and the president of the Law Review was the student with the highest academic rank. Among these were Elliot L. Richardson, the former Attorney General, and Irwin Griswold, a dean of the Harvard Law School and Solicitor General under Presidents Lyndon B. Johnson and Richard M. Nixon.
That system came under attack in the 1970's and was replaced by a program in which about half the editors are chosen for their grades and the other half are chosen by fellow students after a special writing competition. The new system, disputed when it began, was meant to help insure that minority students became editors of The Law Review.
Harvard, like a number of other top law schools, no longer ranks its law students for any purpose including a guide to recruiters.
Blacks at Harvard: New High
Black enrollment at Harvard Law School, after a dip in the mid-1980's, has reached a record high this year, said Joyce Curll, the director of admissions. Of the 1,620 students in the three-year school, 12.5 percent this year are blacks, she said, and 14 percent of the first-year class are black. Nationwide enrollment by blacks in undergraduate colleges has dropped in recent years.
Mr. Obama succeeds Peter Yu, a first-generation Chinese-American, as president of The Law Review. After graduation, Mr. Yu plans to serve as a clerk for Chief Judge Patricia Wald on the of the United States Court of Appeals for the Federal Circuit.
Mr. Yu said Mr. Obama's election ''was a choice on the merits, but others may read something into it.''
The first female editor of The Harvard Law Review was Susan Estrich, in 1977, who recently resigned as a professor at Harvard Law School to take a similar post at the University of Southern California. Ms. Estrich was campaign manager for Gov. Michael S. Dukakis of Massachusetts in his campaign for the Presidency in 1988.

The 36-page promotional booklet was exclusively obtained by Breitbart, and was sent out to colleagues within the publishing industry in the early 1990s.
A later biography, which can still be found on Acton & Dystel’s archives, reads: ‘Barack Obama is the junior Democratic senator from Illinois and was the dynamic keynote speaker at the 2004 Democratic National Convention.
‘He was also the first African-American president of the Harvard Law Review. He was born in Kenya to an American anthropologist and a Kenyan finance minister and was raised in Indonesia, Hawaii, and Chicago. I’m definitely not a Bush fan, but when he starts going off on Bush and the liberal stuff, I have to turn him off or tune him out. I also can’t stand it when he brings up Richard Nixon. The man is dead and gone. Get over it. Barack Obama is a million times worse than anything Nixon and Bush ever thought about doing. He IS absolutely great on this Obama stuff though. Just hoping he’s not taking the day off.

But it does provide a SCOTUS’ definition of ‘natural born citizen.’ The Constitution provides all the context necessary to apply that to POTUS and VPOTUS qualifications. No need for the courts to belabor that with those two things in hand.

Come up with any definition of citizen that you wish, but then add the "natural-born" qualifier to it for establishing the qualification for being president. Paine writes that the criterion for being president is that you are a citizen of two citizen parents.
One can be birthright citizen of no citizen parents, but according to Paine, the 1791 understanding was that that citizen cannot become President.

...Political status [citizenship] is a legal term of art which means, “membership in a nation, and nothing more”. Presidential eligibility refers to municipal status. The holding [Minor v. Happersett {1874)] not only determined Virginia Minor’s citizenship, it directly defined “citizen”, and that definition remains the law of the land today.
First, on pgs. 165-166 [SCOTUS case Minor v. Happersett (1874)], the Court defined the meaning of the word “citizen”. Then, on pgs. 167-168, the court defined the class of “natural-born citizens”. The Court left open the issue of who were “citizens” under the 14th Amendment, which the Court wisely avoided by exercising judicial constraint. Instead, the Court construed Article 2 Section 1, Clause 5, the natural-born citizen clause. In doing so, they defined and closed that class to persons born in the country to parents who are citizens.
The Minor Court’s unanimous opinion and definition of natural-born citizen have never been overruled or even questioned. In fact, the very passage defining the natural-born citizen class was re-stated in Justice Gray’s opinion from Wong Kim Ark. Had he intended to take issue with that definition, or to expand it, then his opinion would certainly contain something like this:
Wong Kim Ark is a natural-born citizen eligible to be President.
But no such statement exists. It’s also important to remember at all times that the Court in Minor specifically avoided construction of the 14th Amendment, thereby defining the class of natural-born citizens and identifying Virginia Minor as a member of that class. Virginia Minor directly petitioned the Court to determine that she was a citizen under the 14th Amendment. But the Minor Court declined to construe the 14th Amendment, and thereafter set about defining the class of persons who were natural-born citizens of the United States in determining that she was a citizen.
In 1996, the US Supreme Court’s majority opinion by Justice Breyer in Ogilvie Et Al., Minors v. United States, 519 U.S. 79 (1996), stated that when the Court discusses a certain reason as an independent ground in support of their decision, then that reason is not simply dictum:
“Although we gave other reasons for our holding in Schleier as well, we explicitly labeled this reason an ‘independent’ ground in support of our decision, id., at 334. We cannot accept petitioners’ claim that it was simply a dictum.”
The Minor Court’s construction of Article 2, Section 1, Clause 5, of the United States Constitution was the independent ground by which the Court avoided construing the 14th Amendment’s citizenship clause.
Therefore, such construction is precedent, not dicta, despite POTUS eligibility not being an issue. The Court determined it was necessary to define the class of natural-born citizens, and the definition is current legal precedent.
Had the Court in Wong Kim Ark identified him as a natural-born citizen, there would have been no need to construe the 14th Amendment, just as it wasn’t necessary to construe it to determine Virginia Minor’s citizenship. But Wong Kim Ark was not natural-born, and therefore the Court was required to construe the 14th Amendment to determine his citizenship status...
...The same is true for the Supreme Court’s unanimous opinion in Minor v. Happersett. Had the court intended to say – Some authorities go further and include as natural-born citizens children born within the jurisdiction without reference to the citizenship of the parents – then that is exactly what the US Supreme Court would have said. But they didn’t.

I appreciate that. I am of the same mind. But until SCOTUS can address the issue of natural born citizen as it applies to the Constitution and eligibility to be President we will have the Senate commissioning opinions and issuing resolutions.
The fact is water is wet and exists in 4 states, noe of which has anything to do with the argument. You daughter is not eligible to be President of the United States, but cheer up because at the rate it is going she can be citizen of the world. How cool is that?
