UNREAL. Obama May Allow US Soldiers to be Tried in the Hague

Unreal. Team Obama may allow US soldiers to be tried in the Hague for war crimes. The Wall Street Journal reported, via Jihad Watch:

Secretary of State Hillary Clinton expressed “great regret” in August that the U.S. is not a signatory to the International Criminal Court (ICC). This has fueled speculation that the Obama administration may reverse another Bush policy and sign up for what could lead to the trial of Americans for war crimes in The Hague.

The ICC’s chief prosecutor, though, has no intention of waiting for Washington to submit to the court’s authority. Luis Moreno Ocampo says he already has jurisdiction—at least with respect to Afghanistan.

Because Kabul in 2003 ratified the Rome Statute—the ICC’s founding treaty—all soldiers on Afghan territory, even those from nontreaty countries, fall under the ICC’s oversight, Mr. Ocampo told me. And the chief prosecutor says he is already conducting a “preliminary examination” into whether NATO troops, including American soldiers, fighting the Taliban may have to be put in the dock.

“We have to check if crimes against humanity, war crimes or genocide have been committed in Afghanistan,” Mr. Ocampo told me. “There are serious allegations against the Taliban and al Qaeda and serious allegations about warlords, even against some who are connected with members of the government.” Taking up his inquiry of Allied soldiers, he added, “there are different reports about problems with bombings and there are also allegations about torture.”

It was clear who the targets of these particular inquiries are but the chief prosecutor shied away from spelling it out.

Asked repeatedly whether the examination of bombings and torture allegations refers to NATO and U.S. soldiers, Mr. Ocampo finally stated that “we are investigating whoever commits war crimes, including the group you mentioned.”

Not legally, but don't rule out that he wouldn't. Clinton signed onto Kyoto. In any case they can do with EO's about anything they want, because it takes an act of congress to stop them.

Absolutely true, but who determines what orders are Lawful? Hmnnn?
We seem to have JAG lawyers accompanying troops on missions just for that purpose.

You are absolutely correct, but show me a Career that didn't end, when an Order was questioned. Patton? MacCarthur? Billie Mitchell?

If that fails and one of the numerous powder kegs is sparked, CW II will start and the only way to stop it, before total devastation, would be the military. I wrote about this many times already in the past few years.

If it happened, this is how I would run it. The Joint Chiefs would run the country pro-tem, the Chairman would be acting President, the VP slot would be the next higher up. The executive branch would be cleared out along with all of Congress. Supreme Court, I dunno, I guess I'd keep them, all of our rights under the Constitution will stand and/or be restored. I would keep this system until the 2012 elections, we can elect a new Congress and President/VP. No former executive branch holder, Senator or Congressman would be allowed to run again, this ban will be for life. There will also be investigations for any treasonous activities and for those who have no charges or judged innocent will keep their pensions.

There will be a massive education campaign on what America is about, the PC crap would stop, a lot of entitlements will stop and so on. I'd keep Social Security and Medicare for those on it but make it an option for the rest or eliminate it and make that the province of the States. The States will retain their governments as they are now, the Tenth Amendment will apply unless the Constitution overrules anything they do.

When the New Congress is seated and the new President sworn in, after that, the Joint Chiefs will return to their current role and we will go on from there like always.

Maybe we should learn something from Turkey. There is an army general or a military commission that will warn then remove anyone or any government and declare a new FREE election, if the Turkish Constitution is violated. Including but not limited to, removing clerics or Islamic fundamentalists interfering with or threatening the secular government.

For our peace and tranquility, this type of plague shouldn’t be allowed again, ever. We have a lot of work to do just to rid ourselves of the traitors bestowed on us by our ignorant, idiotic fellow American ACORNers.

He can’t just sign a treaty. Congress would have to ratify it by, if I remember correctly, a 2/3 majority of the Senate. Even with the RINOs, they don’t have that, and there are enough Dems who wouldn’t go along with that to effectively deny the super-majority necessary to ratify, or even shut down debate.

Sounds like a plan to me too...close and delete all new useless gov offices - clean all the old one which were also useless but cost billions. Fire ALL gov workers who are not indispensable. Free all the banks and let them fail or succeed. Close ALL useless expenses until a new plan comes in. Keep the strict minimum for the safety of the country and infrastructure and let all the rest of the system move along by itself - healthcare - businesses - wall street et al. Just clean the dump and free every company. Stop printing money. Either we survive or we don’t but I am sure, if real Americans see something like that, the American spirit will come back, everybody will go back to work and fight hard to save the economy because, in that case, that’s what they will have to know: YOUR TURN TO WORK - Gov does not exist anymore to help. You are free to live or die. We did it in 1940. We still can do it!

First of all the issue wasn’t whether there could be consequences, I was merely pointing out that you saying Officers must obey the CIC unquestionably is incorrect.

Now if you want to change the issue to would there be any willing to disobey we can discuss that.

I think if you could ask any of the officers you cited all of themn would say absoutely it was worth it.
I also think we have officers in our military now that would not hesitate to question the lawfulness of any whacked order.
