MEXICO CITY, April 16 -- President Obama announced in a visit here today that he will push the U.S. Senate to ratify an inter-American arms trafficking treaty designed to curb the flow of guns and ammunition to drug cartels and other armed groups in the hemisphere. Obama made the announcement after meeting with Mexican President Felipe Calderón this afternoon. The meeting is the centerpiece of Obama's first visit to Mexico, whose government is engaged in a broad war against heavily armed drug cartels threatening the integrity of the state. "The Obama administration's commitment to seek ratification [of the treaty] is important because stemming the number of illegal firearms which flow into Latin America and the Caribbean is a high priority for the region and addresses a key hemispheric concern relating to people's personal security and well-being,"

Even worse, the president can enter into executive agreements with foreign entities which do have the force of law under some circumstances. The question is whether the court will permit our Constitution to be amended by the President and the Senate without reference to the amendment process. The case law in this area is not clear and as I understand it there is no case which permits individual constitutional rights to be abridged by a treaty. I for one, however, am not comfortable leaving the fate of my right to bear arms, for example, to the hopscotch unreliability of Justice Kennedy who will decide the issue.
When the media belittles yesterdays protesters as "tea baggers" who have misconstrued the meaning of the Boston tea party because today's protesters already have " representation" one might ask, how much representation do the tea party protesters really have if Obama succeeds in circumventing the Constitution with the artifice of the treaty making power?

We need to contact our elected federal representatives and let them know that we do not want this treaty to be approved/adopted in the US.
In fact, it would be good to add that it’s time to get the US out of the UN and the UN out of the US...
then the constitutionally honest states must secede, in order to preserve the constitution.
Glenn Beck mentioned this today, he said this is the way libs operate. If they cant get the votes, they go to the courts, if that doesnt work they turn to foreign law and make treaties and then -- your rights are gone.

Obama could rely upon a star chamber of Senators to ratify this treaty. Goodbye 2nd Amendment Rights. I KNOW there are doubters out there, so fire away.
Carryokie has raised on more than one occasion an important warning. Treaties need only 2 out of ANY 3 senators to agree with the president (no quorum necessary), and the treaty is law.
If that is not bad enough, the constitution states that treaties supersede all laws AND the constitution.
I can provide “line and verse” to anyone who wants me to prove this. It can be stopped if enough of us are aware of it. And there’s nothing in the constitution that says we MUST stick with an unpopular treaty forever when enough of us can impress our congresscritters with our dissatifaction.
They put language in there STATING that forcing more unconstitutional regulations on us doesn't infringe on the 2nd Amendment. How freaking nice. I'm all warm and fuzzy, how about you? </sarc>
Treaties only have to be approved by 2/3 of the senate.
He does not have the authority to go around the constitution.
If he tries by treaty and the Senate goes along, it WILL be the 2nd Shot Heard Round the World.

Certainly the matter was finally adjudicated at Appomatox when my grandfather surrendered after four years and several wounds and walked home.
It is sad in a way that the ninth and 10th amendments are being ignored to death and so there is virtually no remedy for Federal usurpation because the courts have ceded the field to the Liberals and simply will not enforce the amendments. Was it Jefferson who said that the tree of liberty must be watered with revolution every generation? Revolution like secession has become virtually illegal and practically impossible in this modern age in which the federal government has a virtual monopoly on military level arms and I space-age surveillance and eavesdropping.
If we're going to preserve our liberties from the tyranny of the Manchurian Marxist, we're going to have to do it on the soap box and in the ballot box.
