A Highly Toxic Silicon Valley Meltdown Over Well Documented H1B Visa Fraud Explodes

The Silicon Valley immigration priority was not the topic I thought would explode and fracture the tenuous MAGA alignment with the New Big Tech group represented by Elon Musk and his billionaire network. However, we learn more every day. This is a jaw-dropping moment to watch unfold as a very influential sector of the political discourse begins a full-frontal attack against those who are pointing out how the tech community abuse H1B visas to replace American workers. In the background, of course, is the context of widespread immigration policy fraud being one of the priorities for the average Trump supporter.

The Silicon Valley team do not seem to review discussion of the H1B manipulation/fraud within the larger American economy as a problem, as long as the discussion of the visa fraud does not impact their business models. However, as soon as the H1B abuse started to be framed around Silicon Valley’s participation therein, the New Big Tech group take a nuclear war approach to defending their interests.

Having followed the immigration issue for a long time, yet specifically only having a big picture review of the H1B visa issues, it has been astounding to watch how Elon Musk, Vivek Ramaswamy, David Sacks and the Silicon Valley supporters and influencers are responding to having the H1B visa fraud confronted. The self-interest in their defense is just astronomical to watch unfold.

Empowered by what can only be reasonably defined as their perceived influence over President Trump, the new-era Tech team are quite forcefully telling the MAGA base of Trump-supporting American workers that their concerns, views and perspectives are irrelevant.

Someone recently suggested an H-1B auction program based on salary.

Bids for say a month would have to be submitted 14-20 days prior.

The FICA would have to be pre-paid for 210 weeks’ worth of salary (to block businesspeople from importing relatives).

Microsoft (USCIS FICA prepay account number:0002):
Sam Mumbai, $3,217/week,
....

Google (USCIS FICA prepay account number:0007):
Wang Kwok, $3,136/week,
....

The program might initially start with an allotment of 10,000 openings.

The cutoff for January’s 10,000 winners might turn out to be say $2,713/week.

If the cutoff rises, then the number of openings might be increased by 100 for the following month. If the cutoff falls, then the number of openings might be decreased by 100 for the following month. This would make the system demand responsive.

The person must have at least a four-year degree in a statutorily specified subject from a Secretary of Homeland Security list of selected, respected educational institutions.

The bidder must have paid FICA in excess of $50,000 for the penultimate year per winner (to block out scammers).

There would be no requirement beyond common sense to seek domestic talent (as the idea that no domestic person can be found to do a lawful high-tech job is ridiculous).

There would be a $5,000 USCIS fee per winner. This would encourage paying for a search for domestic talent.

A subsequent employer of a person would have to have a subsequent winning bid for the person.

Allowing an imported person to find a better employer would discourage employer abuse of imported employees.

The previous employer would have a qualified (subject to then current law) right to import a replacement person at the bid salary or higher if the person left within the first 52 weeks.

The previous employer could cancel the right and request a refund of the unused FICA prepayment, which would be issued around February of the following year.

After four years of salary payment at the person’s initial winning bid level or higher, the H-1B person could then be awarded permanent residence subject to the law in effect at the time.

A similar system might be created for visa-holding college graduates but based on wages to be paid on time clock hours, with a 35-hour minimum pay guarantee.

I think it is more DEI and ESG bull$hit than it is H1B abuse.

My son (White, married, Christian male) is constantly being approached by headhunters in the tech field. He’s very good at what he does.

If tech sector needs talent while avoiding the cancel culture. H1Bs allow them to get BIPOCs and still have some modicum of talent.

The whole program as it is is fraudulent in that it allows (and requires) employers to claim no American can be found to do technical work. There might be just 100 openings per year wherein only a foreigner can do the job.

Musk said the companies that made America strong are because of H1-Bs.

But America is only a shell of what it used to be.

One of my former neighbors here in Florida is a recently retired teacher. She and the instruction she provided were excellent.

Any person who thinks that is ignorant. My father employed hundreds of people. I was sent to a public school because my father considered the ability to judge people accurately was the most important skill one could have.

I watched this unfold. Musk called us retarded and racist. He wanted a huge increase in h1b visas. As the backlash grew he changed to just the elite.

He thinks anyone who wants to come to America should be allowed as long as they love America. Uh..what’s the litmus test for that?

Vivek is a condescending jerk. They frame this as Maga wanting to keep out Indians because that is who largely benefits from the Visa body shop.

Musk did delete his retarded post. Probably because someone called him about it.

He melted down with his autism preventing him from seeing how badly he was messing up.

Musk is not here because of the H1-Bs.

He forgot to mention our electrucal infrastructure stock markets and banks, World-class Universities,our *ahem* government subsidies, and buyers for his products.

I wrote about a bunch of this stuff twenty years ago here on FR.

Same bullcrap excuses to throw whitey under the bus, back then it was led by ex-General Electric executives and McKinsey consulting.

Much of the fraud I have found among visa holders is the inability to document degrees and experience from overseas. References just ring to an empty number or sound canned. No contact for companies. You can’t get transcripts of Master’s degrees from foreign universities. We quit sponsoring people because they leave as soon as they get the card.

I don’t know if the Cognizant lawsuit got into that part of it but they did lose the lawsuit against them.
