Nikki Haley fails the three legged stool test!
(Jan. 30, 2023) — Both of Nikki Haley’s parents were not U.S. Citizens when Nikki was born. Nikki Haley was born to a Citizen of India father (minus one stool leg) and to a Citizen of India mother (minus the 2nd stool leg).
The normal path to becoming a naturalized U.S. Citizen takes five years. Nikki Haley was born in 1972 . Her father and mother emigrated from India to Canada and then to the USA in 1969. Thus there was not sufficient time for either of Nikki’s parents to become naturalized U.S. Citizens when Nikki was born in 1972. It is not known at this time to this writer if Nikki’s father and mother ever became naturalized U.S. Citizens. Nikki Haley is not being very transparent on this issue. Even if one or both of her parents did naturalize later after Nikki Haley was born, it would not change Nikki’s birth status. Given Nikki Haley’s year of birth in 1972, and her parents immigration year of 1969 to the USA, she was thus born in the USA to two foreign nationals and thus inherited their respective birth nation’s citizenship when she was born, in addition to being a basic Citizen by being born in the USA to aliens legally domiciled here. Thus Nikki Haley was born with citizenship and required national allegiance at birth to two countries. The Preamble to the Constitution, which stated the Framers' intent, says that the Constitution was "ordained and established... to secure the Blessings of Liberty... to ourselves and our Posterity."
"Ourselves" means "We the People," the citizens of the United States who established the Constitution and delegated our powers to the states and the federal government.
"Our Posterity" means the children born to We the People, the citizens of the United States.
The "Blessings of Liberty" means that only the Posterity of We the People can ensure Liberty by being allowed to hold the highest office in the land. No other office in the Constitution has this requirement, meaning that the offices of representation are open to all citizens, but the executive office is limited to the Posterity of We the People.
Resident aliens are not "We the People," as they are not citizens and cannot vote for Representation in the House. Therefore, the children of resident aliens are not the "Posterity" of "We the People."
Since resident aliens are expected to be here for a long time, it is reasonable to assume that they will have children. Their children may be born here, but they are not citizens descended via parentage, as their parents are still citizens of their home countries. They are not the Posterity of We the People.
It gets even murkier when the parents aren't even resident aliens, but people on temporary visas, such as tourists, students, and specialty or seasonal workers (L1, H-1B, H-2B). These people had no legal expectation to remain here, so their children born here should have no legal expectation of being natural born citizens here. They are not the Posterity of We the People, but the offspring of passers-by.

There were thousands of non citizens in Revolutionary War times. Most took oaths of allegiance. to fight in the war etc..

He wrote a book called “Fear God and Take Your Own Part (1916). Chapter 9 is titled “When is an American not an American?” He discusses Mr. P. A. LeLong who was born in New Orleans in 1880 to an alien father (citizen of France) and an American citizen mother. LeLong wrote to the Secretary of State William Jennings Bryan about whether on a trip to France, LeLong could be drafted into the French military. The State Department wrote back that as a dual citizen, he would be subject to French laws if he went there.
Roosevelt wrote about the LeLong case in a discussion of dual citizenship (he was opposed to it). On LeLong he wrote:
“Mr. LeLong was born in this country, when he became of age he elected to exercise his birthright granted to him by the Constitution of the United States; he took an oath to support that Constitution; and he has held military office under its authority, and under the authority of two states of the American Union. He is eligible to the Presidency of the United States. He is a citizen of the United States, …”
so what makes teddy roosevelt, a law school dropout, an expert in citizenship law?
He would have had access to guys like Justice Oliver Wendell Holmes (Roosevelt nominated him to the Supreme Court).
