Vanity – Company will be firing me on Jan 5th if I don’t get the shot

My (extremely liberal) company in New Jersey has issued a mandate based on Biden’s “vaccine” mandate for companies who are also federal contractors.

The originally deadline was October, but kept getting kicked down the road with delays, and court stays. Now it seems like the Jan 5th deadline is it. If my “vax” card is not loaded into their confidential system by the 4th, I will be terminated with no severance on Jan 5th, after 7+ years of impeccable service and dedication. However there’s more to just not wanting to get the shot. I was approved to move out of state (to a popular state in the south with a great gov), which I uprooted my life and moved to earlier this month, so I will be working remotely, however they are mandating it for remote employees as well.

Here’s the real kicker… I applied for a religious exemption in the late summer and was APPROVED. BUT NOW, HR has said in black and white that my religious exemption is not longer approved… that they can “assume”, but not “determine” that I have strongly held religious beliefs... that is their basis for denial. And that working remotely or getting tested would create “an undue hardship” with my company.

Anyone else getting this same BS from their job? What course of action are you taking? I am NOT going to get this shot, so I am weighing all of my options, including submitting a discrimination complaint with the EEOC, and outing the company to local news sources.

New Jersey state law and mandates could be dictating your company’s policies. NJ said no religious exemptions, similar to Maine.

Do you have proof of your application for, and of their approval of, your religious exemption?

Likewise, have you proof of their later recission of the approval?

If I were you, I’d get a lawyer (Liberty Counsel, ICAN)

And apply for unemployment benefits if they let you go.

I’d turn in a complaint to EEOC, and probably contact a lawyer. Forced into court, they might choose to offer ‘something’. HR might discover their lawyer doesn’t want court action and offering you six months of salary might be enough to avoid court.

Depending on my age, I’d review to re-locate (Florida or Texas). Staying in a state like this isn’t much of a priority. Note as well...several hotspots around for jobs (Huntsville, Ala for example).

That’s what’s the company is banking on ... the employee won’t take action. Believe me, most companies don’t want to litigate ... that’s one of their soft sides.

So the ex-employee finds another job, once settled in then shop for a good attorney. There is no easy way out.

My wife works for the VA and they’re trying to get everybody to get vaxxed and she refuses. Her plan is to make them fire her which so far they’ve been reluctant to do. They know there’s going to be a legal mess on the horizon.

I read an article yesterday that many companies (less than 100) are watching this fiasco closely and are capitalizing on the situation by hiring badly needed personnel. All is not lost. Whatever your background, there is a company out there that will put you back to work. Good luck.

The problem is, Title VII of the Civil Rights Act of 1964 supercedes everything else. They’re relying on people being ignorant of this and not willing to sue them in court. The DOJ had meetings about this that got leaked admitting they would lose in court over denying religious exemptions.

Yep, my company is doing the very same. I am being ousted on January 5 after 14 years of exemplary service. My manager said I should try for a medical exemption; however, after speaking with my doctor I have no grounds. She then encouraged me to go for a religious exemption and I told her that I will take it no further. I’ve decided NOT to comply with their “exemptions” as it is no one’s business what my medical history is or my religion. In addition, I decided I do not want to work for a company that is cutting good employees lose without a safety net. It is beyond reprehensible. They only made the mandate known to everyone a week ago. It is disgusting that they are giving those of us will be tossed less than 8 weeks to get things in order. Interestingly, I too, moved South and live a state away from my employer. A fellow co-worker who is appalled at what they are doing encouraged me to see an employment lawyer. I am still up in the air on that. I most likely will just retire, earlier than I wanted though. GO BRANDON!!!!!!

Yes he just did... but does that not matter, since my employer is in a liberal blue state?

I would offer a few thoughts here ...

1. I was never a fan of "work-from-home" arrangements, but this COVID fiasco motivated me to turn my own company into a 100% work-from-home operation. I think it is here to stay, and most companies are never going back to the old model of having everyone show up in the office on a daily basis.

2. Having said that, I'd also point out that a work-from-home arrangement in a large company has a lot of risks for the workers who take advantage of it. First and foremost is: : "Out of sight, out of mind." If you work in a highly specialized field and your employer would have a hard time replacing you, then you can make this arrangement work. If you are just another cog in a large machine doing "commiditized" work that many other competent people can do, then you are not going to have much of a future in that company.

3. Related to the last point in Item #2 ... Is your company facing financial challenges and looking to downsize? I suspect many employers are using this COVID/vaccine debacle to weed out employees without going through the trouble of laying them off due to a declining workload.
