A federal appeals court in New Orleans upheld the constitutionality of the all-male military draft system Thursday, citing a 1981 U.S. Supreme Court decision.
The 5th U.S. Circuit Court of Appeals in New Orleans said only the Supreme Court may revise its precedent.
The case was argued in March and was the result of a lawsuit by the National Coalition for Men and two men challenging the male-only draft. Their arguments had been that the the 1981 case was decided at a time when women were largely absent from combat.
There was no dissent in Thursdays ruling from a three-judge panel. Plaintiffs in the case could seek a rehearing before the full court or go to the Supreme Court.

This shouldnt be a question. Real men obviously dont exist in the National Coalition for Men.
yet women have the right to vote without the same obligation. Smells like BS to me. Either women get drafted or they shouldn’t vote imo.
I think youre being pretty ridiculous to suggest that a real man shuts up and ignores obvious inconsistencies in the application of the law.
Nobody’s touching that hot potato if they don’t have to.
But ‘men’ who have no clue they are ‘men’ are entitled to play women’s sports... We really have some sick twisted minds at work full time.
Personally, I have no problem drafting women... There are plenty of functions women can accomplish outside of ‘combat’...
How about a “male only army” with the primary qualification being to be in enough shape to brutally kill the enemy and break his stuff?
Just waiting for John Roberts to flip because having a vagina is a tax. Or something.
Some of us still believe in chivalry and the God defined roles of men and women, even if some of the women dont. Voting and defending your country by being drafted into combat are two very different things. We (men and women) are not equal, we are complimentary. Those that want to volunteer are welcome, but men should grow a pair and start being men again.
The article says women were largely absent from combat in 1981. Even with the current rules, women are largely absent from combat now, right? A quick google search reveals fewer than 150 women have died in Iraq, Afghanistan, and Syria since 9/11/2001. Ive never met a combat arms veteran who had female squad mates.
See my post 10.
It shouldn’t even be a question... Is chivalry dead?... Or, are men just emasculated to a point of no return? I volunteered and served in the Air Force to protect this nation. Women can if they want to. I would expect there are still enough real men in this country that would stand up and fight so that we would not need to force women to fight our battles for us.
What a pitiful state this country is in today.
I wonder if these ‘men’ will now burn their bras.
But what about the woman who identifies as a man?
Isn’t she (he/it) subject to the draft?
I understand your point.
Realistically, there probably will not be another draft.
It would take months to ramp up the process. It would take months to ramp up any military to take on draftees.
Where in the world would there be a conflict so large that we would need to set up for a draft?
Against Russia? Against China?
Those wars would be over before it got to the point of “invasion.”
And the world would “glow” about it.
I would argue that in the event of a war where the draft again becomes necessary, women will be drafted.
Oh no, I better go take a bullet for a feminist now because some anonymous tough guy on the internet said I’m not a “real man”.
So they don’t have standing because they’re not real men, they’re girly men.
Amen to that
