A controversial suit brought by a U.S. Army reservist has been joined by a retired Army two-star general and an active reserve Air Force lieutenant colonel.
Maj. Stefan Frederick Cook filed the suit July 8 in federal court here asking for conscientious objector status and a preliminary injunction based upon his belief that Barack Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.
But before the issue got to court, Cooks orders to deploy to Afghanistan were revoked. Lt. Col. Maria Quon, U.S. Army Public Affairs Officer, U.S. Army Human Resources Command-St. Louis, said Tuesday that Cook was no longer expected to report Wednesday to MacDill Air Force Base in Florida for mobilization to active duty. Cook, who claims he is now the victim of retaliation due to his suit, received his mobilization orders to report for active duty at MacDill on July 15. From there he was to go to Fort Benning, on July 18, for deployment to Afghanistan.
Cook is an Individual Mobilization Augmentee (IMA). This means hes a reserve soldier assigned to an active component unit consisting of active duty soldiers instead of a reserve unit, which is composed entirely of reserve soldiers. He is assigned to the U.S. Army Element of U.S. Southern Command.
Last week Cook filed a request in federal court seeking a temporary restraining order and status as a conscientious objector represented by California attorney Orly Taitz.
The government, in its response to the suit, claims that Cooks suit is moot in that he has already been told he doesnt have to go to Afghanistan, so the relief he is seeking has already been granted.
The Commanding General of SOCCENT (U.S. Special Operations Central Command) has determined that he does not want the services of Major Cook, and has revoked his deployment orders, the response states.
Taitz argues in a pleading revised following the revocation of Cooks orders, that the application for preliminary injunction is not moot and that retired Maj. Gen. Carol Dean Childers and U.S. Air Force Active Reservist Lt. Col. David Earl Graeff have joined the suit because it is a matter of unparalleled public interest and importance and because it is clearly a matter arising from issues of a recurring nature that will escape review unless the Court exercises its discretionary jurisdiction.
Cooks resubmitted Application for Preliminary Injuction is meant to encompass the possibility of Cook receiving future orders for deployment as well as to address and prevent negative collateral consequences such as retaliation against Major Stefan Frederick Cook ...
As to the retaliation issue, the revised suit states Cook lost his job at Simtech, Inc., a corporation that does Department of Defense contracting in the field of information technology/systems integration, because of the suit and has additionally been subjected to gossip from people who believed Cook was manipulating his deployment orders to create a platform for political purposes.
Taitz, who has also challenged the legitimacy of Barack Obamas presidency in other courts, filed the original suit with the U.S. District Court for the Middle District of Georgia.
In the filing, Cook states he would be acting in violation of international law by engaging in military actions outside the United States under this Presidents command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.
A hearing to discuss Cooks requests is scheduled to take place in federal court here this morning at 9:30 a.m.
Yes, but General Childers is not. His first name is spelled Carroll, not Carol. Taitz couldn't even get that right in her injunction, and that will get it bounced out of court faster than her head can spin.
Missed the letter “L” in someone’s name? That’s a very weak defense.
Two letters actually. And when you file an injunction with a plaintiff who doesn't exist then yeah, the courts tend to take that seriously.

To the best of my knowledge, Orly Taitz is in federal court in Georgia, as we speak, for the Major Cook case.
Misspellings will not result in the case being immediately thrown out. The pleading with the misspelled name will simply be amended. It happens every day.

This retaliation from the DOD for political reasons is par for the course. It's precisely what happened behind the scenes on another high-profile case back in the 1950's -- the case that eventually led to the fall of Joseph McCarthy -- the Case of AF Lt. Milo Radulovich
Although Milo won his case and finally received his Honorable Discharge, his work was in meteorology and that field was all government contractor work back then, so the DOD made sure that he couldn't get a job in working for a government contractor. Milo said that he'd tell potential employers upfront about the original case and they'd say OK, but when it came time to hire him, they'd back off. Once he said that he saw what was written on one of his applications -- "Not Eligible for Government Work" -- even though Milo had had high level security clearances and not one, not even the AF, had ever questioned his loyalty to his country. Milo eventually found a private weather service run by a Frenchman who said that he understood the phony charge of "guilt by association" based on his personal experiences during WWII, and hired Milo.
Ten years later the US Weather Service finally hired Milo when the original Top Brass had been replaced, and ironically, Milo Radulovich became Ronald Reagan's favorite weatherman. When Reagan was governor of California, RR would literally call Milo personally to get the weather, knowing full well who Milo was and what Milo had gone through.
A few years back, the film "Goodnight & Good Luck" featured film of Milo's original Murrow interview.
Point of this is, Lt. Cook and anyone who challenges this birth certificate issue can be persecuted long after the cameras have gone away and even if they win in court. The American people have a short attention span and can be pretty fickle. Lt. Cook and these others are really risking their futures for this, even if they win.

Supposedly, the PI working with Orly to uncover the truth has come across more than 100 addresses for Bara[c]k Obama, Michelle Obama as well as 39 different social security #’s. Apparantly, the one that is really in question, is one that was issued to the same address he lived while attending Harvard (I think that’s right). That #, which I think is the one he still uses, actually belonged to a deceased dude who would be around 119 years old if he were still alive. Supposedly, his grandmother held a government job that had access to these sorts of documents. (do I hear ACORNS?)

In all honesty, I've never followed this "Obama birth certificate" issue until the Major Cook case and I took most of the allegations about "Obama's eligibility" with a grain of salt. Now I am following the Cook case closely and have a whole email list of friends who are following the updates -- including many of whom are retired and currently serving military.
It does irritate the heck out me that the MSM isn't all over this story, but it only serves to reinforce the fact that they are mostly all just Obama's cheerleading squad.

The link indicates that Obama was born at Kapi’ olani, but on November 4, Obama described to UPI that he was born at Queens Medical Center. His grandmother stated that his birthplace was in Kenya.
