Hochul calling New York lawmakers back to Albany next week to address SCOTUS concealed carry ruling

ALBANY - State lawmakers will return to work next week to address the Supreme Court’s ruling striking down a New York law limiting the carrying of concealed firearms, Gov. Hochul announced Friday.

The governor signed an order mandating a special legislative session in response to the court’s 6-3 decision doing away with the century-old statute.

“The Supreme Court’s reckless and reprehensible decision to strike down New York’s century-old concealed carry law puts lives at risk here in New York,” Hochul said in a statement. “My number one priority as governor will always be to keep New Yorkers safe.”

The Supreme Court ruled that requiring residents seeking a license to carry a gun outside the home to demonstrate a “proper cause” was unconstitutional.

New York’s strict concealed-carry law has been on the books since 1913. Essentially, for a gun owner to carry a concealed handgun in public they had to demonstrate a specific need for self-defense when applying for a license.

The governor and legislative leaders have been “working around the clock” since the decision came down to craft new legislation in response, according to Hochul.

On Thursday, the governor said that the state may require applicants undergo firearms training to obtain a concealed-carry permit and New York may try to ban guns at “sensitive” locations such schools, churches and even the subway.

Additionally on Friday, the governor said she is looking at legislation that would prohibit New Yorkers from carrying weapons in businesses unless an establishment proactively allows it.

“New York will not stand idly by,” Stewart-Cousins told WNYC. “We are all prepared to go back, to take a look... at what we can do to adhere to the Supreme Court decision but still make sure that we have the maximum protection for New Yorkers who frankly don’t want to live in fear of every other person carrying a gun on the subway or in a grocery store.”

Does Senate Majority Leader Andrea Stewart-Cousins (D-Yonkers) have armed security wherever she goes? I'm guessing yes.

So, on gun free school zones, GFSZ ...

Congress passed into law. The law was challenegd, and SCOTUS ruled that GFSZ was unconstitutional. That was the Lopez case.

Congress passed the law again, this time with preamble findings of commerce clause effect, following the instructions SCOTUS provided in the Lopez case.

The feds have been diligent to not prosecute, but the law is on the books.

Now, if a STATE were to pass such a law, I believe SCOTUS would uphold it. Every so-called "favorable to RKBA" decision by SCOTUS is very narrow, and by-and-large, Courts are hostile to the RKBA.

All they can really do is try to drag it out or make it onerous for a law abiding citizen to carry by implementing a ridiculously high annual licensing fee and hours of annual training, but even that would probably violate the ruling.

I believe the ruling codifies the fact that if one is legally able to obtain a firearm, they can carry as well without the need for clearing additional burdens such as fees and training, which would probably be akin to a "poll tax" to exercise your right to vote.

That being said, NY will definitely try to slow the process of legal gun owners being able to carry in NY even if they pass legislation that they know will be overturned.

I believe there was specific language in the recent SCOTUS decision stating that very limited restrictions on carrying a gun might be allowable, but that restrictions couldn’t be overbroad and couldn’t be enacted for the purpose of interfering with the right to carry. The politicians are shooting themselves in the foot (pun intended) by holding press conferences and saying they are going to pass laws to get around the SCOTUS decision.

After DC got slapped down in the Heller decision in 2008, the DC politicians passed a bunch of nonsensical laws designed as an end run around Heller. They got slapped down again in court and were told very specifically they couldn’t continue to interfere with the right to own/carry. Look for the same thing to happen in NY.

Her number 1 priority is clearly not keeping new yorkers safe. It is was, she wouldn’t be allowing violent criminals to roam feee. She’d remove the manhattan DA.

This situation proves their not concerned about public safety. This is about disarming the public.

But we already knew that.

What she has “vowed to do” in her foot stompy declaration, is to make every business, every public place a “sensitive venue” where guns will not be allowed. She isnt,, according to,her statement yesterday, just gonna ban them at churches and other major places of business.

Yeah. I heard that. It's going to affect all the permit holders, including the ones that bought or earned government favor in the "may issue" regime.

Unless she plans two classes of permit.

Government really can be an evil thing, as courts and legislatures work in cahoots to corral their chattel humans.

Sounds like she talked to JB Prickster here in HELLINOIS. That's what this state does. Don't matter, I carry every single time I have to go into that shithole Chicago on the train, in the office, and everywhere I go and I don't care. Better safe than dead.

I'm NOT the only one who does.
