There was a thread earlier discussing what would happen if hrc was arrested before nov 8 and what that would do to the ticket and if obama could stall the elections while the dnc sought another candidate. Does early voting lock hrc in as the candidate regardless if she is arrested, or dies, or disappears?
“Is the election the kill switch of the Constitution? Is that what people will rise up about?”
Could you re-phrase that? I don’t understand the question.
Well we might like to think that would be the case, but I doubt seriously that it would happen.
I for one would fully expect the Republicans to sell the populace down the river in a skinny minute, and it would be a bi-partisan effort. If Congress did do that, do you see even the Supreme Court siding with us? Obama wouldn't support us for sure. The press certainly would not make anything of it.
At most it would get a small hue and cry, if anything at all. The majority of the population are sheeple who would rather go along to get along. A revolution requires a healthy degree of coordination, of which there is currently none in place, and getting it in place would become impossible, fast.
An election could be postponed with the cooperation of state and local governments. On short notice, may as well herd cats.
Lawsuits over whether political advertising should be paid for, angry political challengers who looked like sure winners; people haven’t thought these things through.
The kicker is that the president’s term expires regardless of whether there is an election as per the 20th and 22nd Amendments. In the extreme case, the Speaker of the House would become Acting President.
Assange uses the term ‘killswitch’ to say if something happens to him, he has it set up thru a lawyer or associates to make sure all the emails are released without him having to give the go ahead. Regarding the Constitution, we’ve seen a lot of eroding of our rights and while loss of free speech or impingement of the second ammendment pisses a lot of people off, does the elimination of an election cause the citizens of the nation to rise up against its govt? Not necessarily with arms and ammo as some have suggested but from plain outrage from 90% of the American people. Iope this makes more sense.
Check your History.
There is no Constitution of the United States before 1787, and no ratification in force until June, 1788.
Now double-check your Constitution, because there is no requirement in the Constitution except that electors must be chosen before the safe haven date. In fact, there is not even a requirement that the states choose their electors by a popular vote.
An excerpt from a long article to refresh your memory:
No federal law regulated the 1788 federal election. In 1792, federal law permitted each state to conduct presidential elections in the state (i.e., to choose their electors) at any time in a 34-day period before the first Wednesday of December, which was the day set for the meeting of the electors of the U.S. president and vice-president (the Electoral College), in their respective states.
More detail at many places, among them Wikipedia: https://en.wikipedia.org/wiki/Election_Day_(United_States)#cite_note-2
Thanks for the refresher, Fred. I’ll pull out the Constitution and review it again today.
Bottom line here though, is this whole question is nonsense. It's not going to happen. Hillary will not step down for any reason. Even if they dragged her away in handcuffs she would not step down. Nor do I believe that Comey would move to arrest her until after the election if that were the case. So mostly my comments were more in jest than a real answer. Instead I was offering up my belief of what the weak kneed Republicans would do, that being to bend over for the Democrats.
No, it cannot be.
The Constitution requires states choose their electors by a date certain: the very first Wednesday in December.
In Bush v. Gore the Supreme Court reaffirmed that this is a "hard date" which may not be overriden by statute, by the individual states, nor by any court.
[
By the way, so many libtards claim the Supreme Court ruled against Gore in a 5-4 decision. Nope. Didn't happen. The Supreme Court ruling against Gore was 7-2, not 5-4. But two of the liberals who had found against Gore ruled on the basis of an Equal Protection violation, which they felt could be obviated by a statewide recount, rather than just one in Gore's cherry-picked Democrat heavy counties. In the 5-4 ruling the majority held this could not be accomplished by the Constitutionally mandated deadline.
]
The date of the Federal election is set by law. Congress would have to convene and change the law, and it still cannot be later than the first Wednesday of December, when the Constitution requires the electors for the Electoral College to meet.
“Assange uses the term killswitch to say if something happens to him, he has it set up thru a lawyer or associates to make sure all the emails are released without him having to give the go ahead.”
That’s commonly referred to as a ‘dead man’s switch’. It comes from old railroad industry terminology. Yes, Assange has said that he has such an arrangement in place, which is probably why he’s not already dead.
“...does the elimination of an election cause the citizens of the nation to rise up against its govt?”
I don’t think anyone has suggested that Hussein would try to “eliminate” this election, but plenty have feverishly worried that he might postpone it and declare some kind of national emergency.
All I can say about that is, if he tries it, he’ll be the first president to ever be frog marched out of the White House in handcuffs and shackles by the U.S. Marines.
“I doubt seriously that it would happen.”
Then you’ve lost all hope in your country and faith in your countrymen.
There’s no point in me arguing with someone who’s surrendered that completely.
Peace be with you.
Well, yes, except I thought the date was by US Code, while the requirement it be the same throughout the states is in the Constitution. Presuming that Congress would just change to a later date, but a GOP Congress might not change the date for choosing Electors, leaving it to quick action by state legislatures. Yet another reason it ain’t happening.
The real point is; the president gets no say whatever. DHS has even complained about that.
Not all, just the majority.
Lincoln couldn’t could not cancel the election in 1864 when he had zero chance to win. He had already canceled the Constitution to wage a Civil War. This election will go forward, come what may.
Otherwise, what you say is correct, and it would not surprise me in the least if Congress called an emergency session and the Republicans would capitulate, because that is what the Republicans always do. But honestly, it was meant more as a dig on the Republicans in Congress than it was meant as an honest guess at what they would do. Yet at the same token, it wouldn't surprise me in the least if it went down just like that.
What IS the story behind that picture??
I guess you shouldn’t have a problem then.
“I guess you shouldnt have a problem then.”
But apparently, you do. That’s unfortunate.
Yes. Thank you for the correction. Wednesday after the first Monday. I thought the first Wednesday might be a little soon, especially in 1792.
