Can Texas legally secede from the United States?

Hey, Texplainer: Britain voted to leave the European Union. Can Texas secede from the United States?

In the wake of Britain’s historic vote to leave the European Union - nicknamed "Brexit" - speculation of a Texit on the horizon have cropped up once again. The secessionist movement has a long history in the Lone Star state. Delegates for the Texas Republican Party even recently debated adding secessionist language to the party's platform. But is it actually legal for Texas to leave the United States?

Simply put, the answer is no. Historical and legal precedents make it clear that Texas could not pull off a Texit - at least not legally.

Well, Texas has huge refining capability and it has large ports and it is The Place for Oil Industry technology and manufacturing.

This is all a waste of bandwidth. I have never been for Secession. And one of my ancestors was born in TX during the Republic. Others fought in the American Revolution.

But you can take this to the bank. If we cannot overcome the leftist crap soon, all bets are indeed off.

True, but such is the way of people who choose to exercise their God given right to freedom and liberty from oppression.

Life is messy for the individual. Even more-so for a collection of individuals, banded together under the common goal of uniting against a larger collective, which has proven itself to be deleterious to the common good.

I don’t want to see our union of states disolved, but if remedies for what ails us cannot be found or realized via our accepted civil mechanisms, there may be no other choice.

Thanks for the reminder, Inyo. My jocular references to California have apparently touched a soft spot with more than one person and i will be judicious in the future before applying them.

before the Civil War, yes.

since the Civil War, no.

we are all stuck. the tentacles of the feddle gummint are everywhere and they will not allow any states to try leaving ever again. it’s one of the reason (i think) that they’ve become massive landowners all across the country. the founding fathers would be shocked to know how much of the country is owned by the feddle gummint.

The inalienable rights granted by our Creator, supersede the laws of men. Those rights form the very basis of our political union to begin with.

The United States was broke and doomed to failure, upon its achievement of independence from England. At least that’s what the conventional wisdom of the day said.

You’re obviously a skeptic, like so many Loyalists were, back then. That’s fine. You can always run back to Call if it gets too hot for you here.

Texas tried succession once, but it did not turn well. Today, what would succession accomplish unless we deported the all the liberals, illegals and a few other disaffected groups?

And yet they negotiated. Into what exactly? Freedom is an illusion. It is also relativistic. At one point the settlers who became the first white Texans felt that they didn’t have enough freedom and migrated to the territory in order to gain more freedom. They didn’t achieve that relative freedom through battle. They did so by negotiating with Mexico for a mutually agreeable situation.

Years later the Mexicans changed the deal and it was at that point that the Texans raised arms against what they saw as tyranny.

Once they won their war against the Mexicans they were free - or at least freer than before, but the territory was huge and the residents lacked the resources to adequately protect themselves from the indians. so they sought the security of the US. They negotiated first for annexation, then to become a state.

Whole lot of negotiating going on for freedom.

Under current federal law no State may legally secede.

Federal law is NOT the relevant law when dealing with issues involving two or more nation states. (A state that secedes becomes a nation state) International law becomes the relevant law and as we saw in Kosovo the international law allows for the breakup of a nation state should the people of a region of that state decide they want to leave. If California keeps welcoming reconquistiors cali might find itself Mexico again.

The states entered the union voluntarily. There’s no reason they shouldn’t be able to leave voluntarily.

Not exactly true. States that were once territories have no right to secede. Territories were bought and paid for by the federal government and as such are owned lock stock and barrel by the federal government.

It is ironic that Sam Houston was against seceding from the union and in fact refused to swear his loyalty to the rebellion. For this crime he was ejected from office and forced into exile, living as a pariah in the very state he helped create.

I don’t think Texas will secede anytime soon. But, the US Army is as weak as it ever has been particularly at the very top.

I believe there most likely will be “secession by litigation”. IF Texas would enforce the Constitution to the letter, the Feds lose most of their power. With 14 lawsuits filed against the feds currently, and more in the pipeline, arguably that (secession by litigation) is Texas policy already.

One more time,

Prior to becoming a state Texas was an independent nation. An agreement between two or more independent nations is a treaty. Under international law any party to a treaty can nullify/withdraw from that treaty. So yes Texas, under international law recognized by the USA, can secede.

and no Texas did not give up for all eternity it's right to be an independent republic should the people of Texas decide to once again be an independent republic.

In proper war there is a solution to your problem people. I find this whole legal point mute. Does it matter why or if a state leaves but whats the point.

A country that is part of a union is different than a state, even Texas. Could you imagine counties of a state wanting to become a state? If you know your Texas history you know that it was Mexico before illegal immigrants from the USA settled there.

If anything we need to restructure the whole three branches. Hell we cant even think of 70% or more Americans to vote.

All my life in Texas it has been said we could secede due to the fact we were our own republic and it was written in the statehood documents we could secede if we wanted.

I think it the situation got bad enough in the country, we might do it come hell or high water, whether legal or not.

We are the only state that has it’s own electric grid separate from the rest of the states. We sell extra power we generate to Mexico.

You know you can come live with me anytime and I have a vacant house you can live in free of charge.

The consensus no, is supported by legal arguments. The government can do anything it wants to do to you. The bottom line of the legal arguments is the government owns you. Once you opt in you are essentially their slave.

The consensus yes, is supported by moral arguments. The government cannot do as it pleases with you. If the limits upon government are violated you have the right to walk away. The government does not own you. You, are not their slave. I find the legal argument rancid and illustrative of the problems free people face. Know this the thieves will never let their slaves leave peacefully.

If you know your history Texas was Mexico is more fiction than fact. Texas was ruled by Spain for 100’s of years ruled by Mexico for 20. And besides that Mexico has zero ability to govern Texas. Texas was in fact ruled by the Indians that killed anyone and everyone that tried to settle in Texas. That is why the Americans were invited to come to Texas. Mexico could not govern Texas when ever Mexican that came to Texas was killed.
