The Supreme Court on Monday turned down an appeal from a Catholic hospital in California that was sued after refusing to perform a hysterectomy for a transgender man. The court's denial, issued without comment, sends the lawsuit back to state court for further proceedings against the hospital and avoids, for now, the issue of when claims of religious freedom can trump anti-discrimination laws. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch said the court should have taken the case. The dispute arose when Evan Minton arranged with Mercy San Juan Medical Center in Sacramento to schedule a hysterectomy, which he...

The left thinks its power is so broad as to be essentially limitless, and so singularly vested as to be checked virtually solely at its own discretion.Interested to know what the top liberal legal minds of the United States Supreme Court think about government power and your private property? First, take 10 minutes to read Justice Brett Kavanaugh’s opinion, written for the majority, in the court’s Thursday night decision to stop the ban on rental income; then spend another 10 minutes on Justice Stephen Breyer’s dissent. Here’s a hint: The left thinks its power is so overarching as to impact nearly...

As a labor and employment attorney, I have handled cases before the U.S. Equal Employment Opportunity Commission (EEOC) for almost two decades. This is probably how I got invited to the EEOC-sponsored event, “AANHPI + Pride: Intersecting Identities at Work and Beyond.”For the uninitiated, AANHPI stands for “Asian American Native Hawaiian and Pacific Islanders.” And yes, the presenters repeated the alphabet string “AAHNPI LGBTQIA+ community” many, many times.White House appointee Erika Moritsugu kicked off the presentation by boasting that 14 percent of Biden’s appointees are LGBT. She also touted President Biden’s executive orders on “equity,” which blatantly pander to identity...

For the first time in a generation, there are six conservative justices on the Supreme Court. In time, this sextet will incrementally push the Court to the right. Yet, three of them are already sounding an alarm. Twice this term, Justices Clarence Thomas, Samuel Alito and Neil Gorsuch warned that Justices Brett Kavanaugh and Amy Coney Barrett lack backbone. In an excessive force case, the conservative trio wrote that the two newest Justices were "unwilling to...bear[] the criticism that" denying the prisoner's appeal "would inevitably elicit." And in a religious liberty case, the Thomas-3 charged that Kavanaugh and Barrett lacked...

On Monday, the Supreme Court announced it would not take up the case Gavin Grimm v. Gloucester County School Board (2020), a high-profile case concerning whether or not Title IX of the Education Amendments of 1972 forbids schools from designating bathrooms according to biological sex. The school board had allowed single-user restrooms as an alternative to dropping the sex-specific restroom policy, but Grimm challenged it, anyway. A panel of the Fourth Circuit Court of Appeals ruled in favor of Grimm, a female student who identifies as male and sought to use the boys’ restroom. In the 2-1 ruling, Judge Henry...

President Joe Biden celebrated the Supreme Court ruling in favor of Obamacare on Thursday, promising to expand the law in the future. “Today’s U.S. Supreme Court decision is a major victory for all Americans benefitting from this groundbreaking and life-changing law,” Biden wrote in a statement.

The United States Supreme Court issued their ruling today in a major lawsuit from 18 states that challenged the Affordable Care Act put in place by former President Barack Obama. This might come to a devastating blow to a vast number of Americans paying higher than normal premiums and/deductibles, but the Supreme Court ruled in a decision, 7-2, that Texas and the 17 other states “lacked standing to challenge its constitutionality.” The lawsuit also included two individuals who stood against the healthcare program that many Americans sometimes stated was overpriced and under-performing compared to their previous health insurances. In other...

The U.S. Supreme Court ruled 7-2 Thursday that the Affordable Care Act, better known as Obamacare, remains valid, rejecting a claim by a group of conservative states that a recent change to the law made it unconstitutional. Republicans have long opposed the law, former President Barack Obama's signature legislation. But more than 20 million Americans now depend on it for their health insurance, and there is broad public support for its requirement that insurance companies must cover pre-existing health conditions.

The Supreme Court on Thursday tossed out a closely watched legal battle targeting the Affordable Care Act, rescuing the landmark health care law from the latest efforts by Republican-led states to dismantle it. The court ruled 7-2 that the red states and two individuals who brought the dispute do not have the legal standing to challenge the constitutionality of the law's individual mandate to buy health insurance. Justices Samuel Alito and Neil Gorsuch dissented. Justice Stephen Breyer delivered the majority opinion for the court. The Supreme Court did not address the constitutionality of Obamacare's individual mandate or whether it can...

WASHINGTON—The Supreme Court on Thursday rejected a challenge to the Affordable Care Act, the third time it has preserved the 2010 healthcare law. Texas and other Republican-leaning states, backed by the Trump administration, sought to strike down the law on technical arguments after Congress reduced to zero the tax penalty for failing to carry health insurance. Thursday’s 7-2 decision, written by Justice Stephen Breyer, found that none of the plaintiffs suffered any injury from zeroing out the penalty and thus they lacked legal standing to bring the lawsuit at all. “We do not reach these questions of the Act’s validity,”...

If there were a scintilla of doubt that McConnell did the nation a great favor, that doubt should have been put to rest during Garland’s June 15, 2021, speech on “Violent Extremism and Domestic Terrorism.” The ideological purge will make Lois Lerner blush. Mitch McConnell likes to boast, including recently, that his most consequential achievement in his Senate career was keeping Merrick Garland from filling the Scalia seat after the death of the great conservative Justice. McConnell, with a consistency his detractors refuse to acknowledge, followed historical practice and precedent in refusing to allow the Senate to take up the...

What a dark day for America. Democrats are now allowed to make any changes to election law whenever they feel necessary without consequence. The Supreme Court also threw out Attorney Lin Wood’s election challenge without comment. The Supreme Court turned down EVERY SINGLE election case this year without comment. What a tragedy. It was the Trump Wisconsin case that was dismissed this morning.

President Trump unloaded on the “rigged” and fraudulent 2020 election during his CPAC Speech in Orlando, Florida. Trump slammed the corruption in the 2020 election and the cowardly Supreme Court. President Trump, “The election was rigged and the Supreme Court and other courts did not want to do anything about it!” President Trump was 100% accurate. He was robbed! And now America will suffer!

One year ago, Schumer incited a mob on the steps of the Supreme Court in order to bully justices to rule in Democrats' favor.nsible.” However, Sen. Josh Hawley’s efforts to censure Schumer for his violent threats were scuttled. The Washington Post write-up of Schumer’s threats focused instead on Republican opposition to them. “GOP seizes on Schumer’s remarks” read the headline. Schumer’s threats came just 17 months after the Supreme Court had been besieged and attacked by abortion activists upset at Kavanaugh’s confirmation. Like the Jan. 6 event, the October 2018 siege also involved Vice President Mike Pence being condemned by...

The pants are down and the truth is out "The Five" of the US Supreme Court turned out in reality to be only "The Two". The "Conservative Movement" sales pitch for four "Conservative" justices (Roberts, Gorsuch, Kavanaugh and Barrett) turned out to be a scam... Day 272 Of The Dictatorship of COVID-19: Trump's Shrewd Response Way back in March President Trump put Vice-President Mike Pence in charge of the coronavirus response leading the White House Coronavirus Task Force with its cast of characters including the high-profile Dr. Anthony Fauci and others like Dr. Robert Redfield of the Centers for Disease...

All three of President Donald Trump’s Supreme Court appointees — Justices Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett — joined Chief Justice John Roberts and the three liberal justices in declining to hear Texas v. Pennsylvania. In a short order issued Friday, the Court declared that Texas lacked standing to bring its case against Pennsylvania and three other states whose election rules were changed outside their respective state legislatures, as the Constitution requires. ....... Snip....... The three new Trump appointees voted with their liberal colleagues, whose votes were never in doubt. Roberts has lately moved toward the liberal camp,...

The nerves of the world frayed by an authoritarianism imposed on all of us by the forces of Big Government (All Major Established Political Parties Worldwide) and Big Business in the name of "health and safety" and the drama of politicians demanding money so we can elect US Senators who will supposedly defend our freedom from a "socialist, communist President Joe Biden". The socialism and communism is already here, the whole world is Venezuela... God forbid you would learn of the Danish study of six thousand, a real scientific study. Last night, it was announced that the Supreme Court had put the kibosh on Andrew Cuomo’s clearly unconstitutional COVID regulations. For months now, New York has selectively enforced bans on gatherings, targeting religious institutions while allowing mass protests to occur in the street. Even someone with a passing understanding of the law could ascertain that such was clearly discriminatory and illegal. And while Amy Coney Barrett garnered the headlines for the 5-4 decision, it was Neil Gorsuch who actually did the rhetorical and legal beheading.Justice Gorsuch finally puts words to the thoughts of many. #SCOTUS pic.twitter.com/sXdvtkDm7x— Chaskel Bennett (@ChaskelBennett) November 26,...
