Michigan Gov. Gretchen Whitmer (D) signed red flag legislation into law Monday despite ongoing questions about whether it will enforced or, if enforced, how such enforcement would occur. The Associated Press reported, “Over half of the state’s counties have passed resolutions declaring themselves Second Amendment sanctuaries,” and through those resolutions have made clear there will be no enforcement of laws that infringe on Second Amendment rights. Additionally, a number of local sheriffs told the AP “that they won’t enforce the law if they don’t believe it’s constitutional.”

What Does Guo Wengui (Miles Guo) Know? Chinese Whistleblower, Mr. Miles Guo knows too much. He can name names of those within the U.S. Justice Department who have colluded with the corrupt Chinese Communist Party (CCP). In fact, Guo has key information Congress must have in its fight to rid the DOJ of CCP infiltration and corruption. It is because of what he knows that Guo is presently sitting in a federal gulag, denied bail and denied due process. Simply put, Miles Guo is a threat to the criminally treasonous among us—a threat to be neutralized at all costs.

Republicans in the Tennessee House of Representatives are signaling defiance of their fellow Republican, Gov. Bill Lee, after he proposed legislation to allow law enforcement officers to temporarily seize firearms from persons if a court agrees that they pose a threat of harm to themselves or others. Tennessee policymakers have considered a number of new laws since the March 27 Covenant School Shooting, in which an assailant killed three children and three employees at a private Christian school in Nashville. In the days after the shooting, Lee proposed a revised state budget that included additional spending for school security. In...
  • Michigan House OKs red flag bills to temporarily seize guns from those deemed dangerous

Just hours after Gov. Gretchen Whitmer signed into law bills expanding background checks for firearm purchases and safe storage requirements, the Michigan House approved a series of bills to enact a so-called "red flag" law that would empower courts in the state to temporarily take away guns from those deemed dangerous. The vote comes after Senate Democrats last month passed similar legislation. All Democratic-backed bills in the state House passed on party-line votes after lawmakers adopted amendments Thursday to address due process concerns raised by law enforcement and modify the process for applying and appealing extreme risk protection orders issued...

The ethics of Brady v. Maryland By: Commentary: March 2, 2023 Due process lies at the heart of American jurisprudence. Sixty years ago, in the seminal case of Brady v. Maryland, 373 U.S. 83 (1963), the U.S. Supreme Court held that a prosecutor’s suppression of material evidence favorable to an accused upon request violates due process. According to the Brady court, the due process violation stems from the failure to disclose, not the reasons for the failure. In practice, however, the reasons behind a Brady violation are important and raise significant ethical issues. The Supreme Court of Maryland has expressed...
  • Mark Levin on DOJ's move to pierce Trump's attorney-client privilege: This is the unraveling of our liberties

Justice Department prosecutors asked a federal judge to compel one of Trump's lawyers to testify Fox News host Mark Levin tore into special counsel Jack Smith for going after former President Trump's right to attorney-client privilege. Justice Department prosecutors on Tuesday asked a federal judge to compel one of Trump's lawyers, M. Evan Corcoran, to answer more questions before a grand jury regarding the former president's handling of classified documents. Prosecutors cited the crime-fraud exception as a way to circumvent the attorney-client privilege. This exception, Levin said, is used if prosecutors believe a client is seeking advice from an attorney...

  • Is A Criminal Referral From Congress a Bill of Attainder?

I'm posting a vanity to try to get this discussion going. Congressional committee "hearings" or "investigations" are required to have a discrete legislative purpose (separation of powers). Congress is not a permanent Grand Jury or a Star Chamber. The practice of making "criminal referrals" to avoid breaching the authority of Article II (Executive) or Article III (Judicial) co-equal branches is not one of the "Legislative powers herein granted" when we created Congress. In fact, Congress is FORBIDDEN from Bills of Attainder against individuals for the exact reason that Congress is NOT an Executive or a Judicial body. It appears that...

Below is my column in the Hill on the upcoming filing of the Justice Department on proposed redactions to the affidavit that led to the Mar-a-Lago raid. It will be the fifth chance for Attorney General Merrick Garland to take a modest step to assure concerned citizens over the basis or motivation for the raid. Here is the column: In a three-minute press conference following the FBI raid on Donald Trump’s Mar-a-Lago home, Attorney General Merrick Garland cut a defiant figure, condemning critics of the Department of Justice (DOJ) and the FBI: “I will not stand by silently when their...

A new listing on a federal government job board is raising constitutional questions, as Capitol Police are looking to hire their own prosecutors. The listing for an attorney position, posted July 29 on USAJobs.gov, says in the description that the employee would "serve as a Special Assistant United States Attorney" in the Capitol Police's District Offices. The salary is between $145,094 and $186,368 per year. "This position is to represent the United States Government primarily prosecuting individuals and/or groups who have engaged in threats and/or acts of violence against Members of Congress, their staffs, United States Capitol Police employees, visitors...

Just when the wife of one incarcerated Jan. 6 prisoner believed things couldn’t get worse, the Department of Veterans Affairs (VA) informed her they are going to suspend all of her husband’s benefits. According to United States Representative Louie Gohmert (R-Texas), “this is what you have when vindictive leftists get in charge of major parts of the government.” In an unsigned letter from the VA—dated June 13 and appearing to originate from the “Director Regional Office,”—Angel and Kenneth Harrelson were notified that the administration “received information from the United States Department of Justice” that Kenneth had been “indicted and charged...

The use of red flag laws when it comes to firearms has been brought back to the forefront of the national conversation in the aftermath of the mass shootings in Buffalo, New York and Uvalde, Texas. Both shooters had histories of law enforcement being known to them for disturbing or criminal acts, though the Buffalo shooter was able to avoid New York red flag laws. Criticisms of such laws is that it is ripe for abuse since due process goes to the wayside and language of laws can often be too broad. PolitiFact attempted to debunk gun owners concerns about...

Top House Republicans are demanding answers from the FBI after court-ordered information came to light showing that the federal agency had collected the information of over 3 million Americans without a warrant. In a May 25 letter to FBI Director Christopher Wray, Reps. Jim Jordan (R-Ohio) and Mike Turner (R-Ohio) asked Wray to explain why his agency had wiretapped and gathered personal information on over 3.3 million Americans without a warrant (pdf). Limited authority to gather foreign intelligence information is granted by the Foreign Intelligence Surveillance Act (FISA). Specifically, section 702 of the bill says: “the Attorney General (AG) and...

The Biden Administration’s Department of Education (DOE) is making plans to reverse Title IX regulations that had been implemented by the Trump Administration to more greatly protect free speech rights in education. The Daily Caller reports that the soon-to-be-unveiled rewrite by the Office of Civil Rights (OCR), focusing on Title IX of the 1972 Education Amendments, will roll back the Trump-era rules dictating that public schools, from K-12 to college, must investigate claims of sexual misconduct in a fair an unbiased manner. The rules implemented by President Trump allowed greater rights to both the accused and the accuser in such...

The Supreme Court of the United States on Thursday issued a 9-0 unanimous opinion in favor of a taxpayer and against the IRS in a case about the interpretation of a confusing statutory deadline. In the case stylized as Boechler, P.C. v. Commissioner of Internal Revenue, the taxpayer, a law firm in Fargo, North Dakota, was notified by the IRS that there was a discrepancy in their 2015 tax filings. For one reason or another, Boechler never responded to the initial notice. The agency subsequently issued an “intentional disregard” penalty along with their intent to seize and sell off the...

Ottawa Mayor Jim Watson on Saturday proposed selling trucks seized during the police’s violent dismantling of the Freedom Convoy, stating that it was the Canadian capital’s legal right due to the Trudeau’s government invocation of the Emergencies Act. “We actually have the ability to confiscate those vehicles and sell them,” Watson said. “And I want to see them sold. I don’t want the return to these people who’ve been causing such frustration and angst in our community.” Over the weekend, law enforcement in Ottawa arrested 191 individuals during its violent crackdown on the city’s Freedom Convoy protest. Those who most flamboyantly proclaim that they are fighting fascists continue to embrace and wield the defining weapons of despotism. When it comes to distant and adversarial countries, we are taught to recognize tyranny through the use of telltale tactics of repression. Dissent from orthodoxies is censored. Protests against the state are outlawed. Dissenters are harshly punished with no due process. Long prison terms are doled out for political transgressions rather than crimes of violence. Journalists are treated as criminals and spies. Opposition to the policies of political leaders are recast as crimes against the state. When a government that...

Canadian banks will receive the names of people involved in “Freedom Convoy” protests that have descended on the nation’s capital, a first step in a promised financial crackdown on demonstrators being instituted by the far-left government of Justin Trudeau. Bloomberg reports the Canadian Bankers Association confirmed the Royal Canadian Mounted Police (RCMP) has alerted banks to a list of names and made it available. The institutions are reportedly still seeking clarity from law enforcement on how to handle the alleged protesters’ accounts, according to people familiar with the matter. But Finance Minister Chrystia Freeland said some accounts have already been...
