For years, North Dakota stood out as one of a couple of states which had Constitutional Carry but did not grant the right to carry without a permit to people who were not residents of the state. Wyoming restricted permitless carry to residents but reformed its law in 2021. In the 2023 legislative session, the North Dakota legislature passed two bills restoring and protecting the right to keep and bear arms. Both bills were signed by Governor Doug Burgum (R) of North Dakota in mid-April. One of those bills, HB 1339 extended the Constitutional (permitless) Carry provisions to people who...

GREENSBORO, N.C. — North Carolina House representatives will be voting on house bill 189 today pertaining to concealed carry permits. Republican lawmakers advanced legislation yesterday to make it to where anyone would be able to carry a concealed handgun without getting a permit from a local sheriff. This comes barely a month after the Republican-controlled General Assembly agreed with gun-rights groups and repealed — overriding Democratic Gov. Roy Cooper’s veto — another kind of permit issued by sheriffs before someone could buy a pistol. Those groups now are lobbying to eliminate the concealed handgun permit mandate, which has been in...

The Nebraska Legislature passed LB77, the Constitutional Carry bill today at 11:28. The vote was 33 to 14 for the third cloture vote. Each closure vote requires 33 votes to move the legislation forward. Nebraska Governor (R) Jim Pillen has said he will sign the bill. Nebraska will be the 26th state to restore Constitutional Carry. Florida has enacted permitless carry. There are 27 permitless carry states. All Constitutional Carry states have permitless carry, but Florida does not allow general open carry, so is not a true Constitutional Carry state.

On February 22, 2023, the South Carolina House passed a Constitutional Carry bill with 75% of the votes, 90 to 30. Constitutional or “permitless” Carry is when a state does not require a permit to carry loaded handguns, openly or concealed, for most adults in most public places, a close approximation of the state of the law when the Second Amendment was ratified in 1791. From abcnews.com (AP): The Republican-controlled South Carolina House voted overwhelmingly Wednesday to allow lawful firearm owners to carry handguns openly or concealed without a state permit. The 90-30 vote brings the conservative state one step closer...

In response to the Bruen decision, a few states have decided to defy the Supreme Court. The first was New York, which took the extraordinary step to declare an emergency, call the legislature into an emergency session, and pass a complicated, extensive statute which criminalized the carry of firearms in such a manner as to render carry outside the home impractical. In spite of several lawsuits contesting the New York law, other states have followed New York’s example. One of those states is New Jersey. Bill A4769 (ACS) was passed into law on December 22, 2022.The lawsuit, KOONS v. REYNOLDS,...

Gov. Gavin Newsom (D) used a press conference Wednesday to make clear his response to recent mass shootings in California will be to limit concealed carry. The Sacramento Bee reported Newsom is rallying behind Senate Bill 2, which tightens concealed carry permit issuance requirements in response to the Supreme Court of the United States’ Bruen (2022) decision. That decision struck down New York’s proper cause requirement for concealed carry permit issuance, which, as result, also gutted California’s “good cause” requirement.

Maryland Democrats are pushing restrictions for licensed concealed carry that would prevent the legal carriers from being armed for self defense in pubic places. WBAL-TV reports that State Sen. Jeff Waldstreicher (D) is pushing the Gun Safety Act of 2023, would bans concealed carry in “schools, hospitals, libraries, synagogues, churches, mosques. Also parks, restaurants, anywhere the public is gathering.” The synopsis of Waldstreicher’s bill says: “Prohibiting a person from knowingly wearing, carrying, or transporting a firearm onto the real property of another unless the other has given certain permission to the person or the public generally; and prohibiting a person...

Alabama passed its Constitutional Carry bill or (permitless carry) in 2022. The bill does not go into effect until January 1, 2023. I consider Alabama’s Constitutional Carry to have been established in 2022. Including Alabama, there are 25 states, half the states in the Union, with Constitutional (permitless) carry laws in effect. Constitutional Carry is defined by the state government as not requiring a permit to carry a handgun, concealed or openly, in most public spaces. In 2023, there are two prime candidates to pass Constitutional Carry bills. They are Florida and Nebraska. Two Decades of Constitutional Carry Progress Governor Ron DeSantis...

On August 19, 2022, the Ninth Circuit Court of Appeals summarily remanded the Young v. Hawaii case back to the District Court for a re-hearing after the Supreme Court granted cert, vacated the previous Ninth Circuit decision, and remanded the case back to the Ninth Circuit for a rehearing. In 2011, George Young applied twice to obtain a permit to carry a firearm for self-defense outside his home in Hawaii, either openly or concealed. Both his applications were denied by the Chief of Police, Harry Kubojiri, who cited Hawaii law.Young filed a lawsuit claiming his Constitutional right to keep and...

New York Gov. Kathy Hochul (D) announced numerous new gun controls going into effect in her state Thursday and made clear her belief that good guys with guns do not stop bad guys. “This whole concept that a good guy with a gun will stop the bad guys with a gun, it doesn’t hold up. And the data bears this out, so that theory is over,” she said, according to Fox News. On August 9, 2022, Breitbart News pointed to an incident in West Palm Beach, Florida, where a 22-year-old man retrieved a gun from his car and allegedly threatened...

On July 5, 2022, the Kenosha County, Wisconsin, Board of Supervisors voted 14 to 7 to remove the ban on the bearing of arms in most county-owned buildings. Kevin Matheson of the Kenosha County Eye reported on the vote. The Kenosha County Eye has graciously granted permission for this correspondent to use the images and text from the article in this article. A famed Democrat politician once said all politics are local. After the chaos of the riots in Kenosha in 2020 and the national attention brought about by the self-defense trial of Kyle Rittenhouse, the Kenosha County Board has...

In two decades, Constitutional Carry has progressed from an ideal pursued by Second Amendment activists and Constitutionalists, to a reality in half of the states of the United States. In 2002, only Vermont had Constitutional Carry. Constitutional Carry exists where most citizens can exercise the right to carry a loaded handgun in most public places, openly or concealed, without special government permission or the worry of being arrested.Constitutional Carry was the state of the law when the Second Amendment was ratified in 1791. This was the only “Regulation” that meets the Nation’s historical tradition. Vermont has 1/4 of one percent...

ALBANY - State lawmakers will return to work next week to address the Supreme Court’s ruling striking down a New York law limiting the carrying of concealed firearms, Gov. Hochul announced Friday. The governor signed an order mandating a special legislative session in response to the court’s 6-3 decision doing away with the century-old statute. “The Supreme Court’s reckless and reprehensible decision to strike down New York’s century-old concealed carry law puts lives at risk here in New York,” Hochul said in a statement. “My number one priority as governor will always be to keep New Yorkers safe.” The Supreme...

On Tuesday, March 1, 2022, the Ohio House Government Oversight Committee voted 8-5 to pass Senate Bill 215 on Constitutional Carry. The bill now moves to the House floor for a vote. If it clears the House, it would then go back to the Senate floor for Concurrence, then on to the Governor for his signature. We are at a historic moment in Ohio legislative history. This is the closest we've ever been to passing a bill to make the licensing process optional for concealed carry of a firearm. Bills have been presented in former legislative sessions, but have not...

Louisiana’s Democrat Gov. John Bel Edwards vetoed constitutional carry legislation on Friday. The Daily Advertiser noted that Edwards vetoed the legislation, Senate Bill 118, claiming current state law requiring law-abiding citizens to get a permit “strikes the right balance.” State Sen. Jay Morris (R) sponsored the legislation. He responded to Edwards’ veto by saying, “I certainly can’t say it’s a surprise; the governor has been clear all along. But I’m still disappointed. This bill is for law-abiding and freedom-loving citizens.”

On 24 May, Monday afternoon, the last significant legislative hurdle for restoring Constitutional Carry to Texas was overcome. After years of toil, time and trouble, of betrayal and loyalty, of primaries and resignations, a significant Constitutional Carry bill has passed the Texas Legislature and is expected to be sent to Governor Abbott.HB1927, in its final form, passed the House 82-62, and reported privately to me, passed the Senate on a straight party line vote.Constitutional carry is a reasonable facsimile of the state of law about the carry of weapons when the Second Amendment was ratified, in 1791. At the time,...
