That still leaves the shooter in a bad place legally.

Time after time the courts have ruled that leaving a fight for any reason whatsoever and returning to the fight makes him the instigator of the act that resulted in a death.

I am not saying that I agree, only that it is the law.

The view of the prosecutors and judges is that once you have left, you are free of any danger to your life or the lives of those with you. Their view of the law is that you are safe enough to wait for the cops.

“The soldier retrieved a handgun from his home and returned to ensure his family’s safety.”

And the prosecutor would say “You left your family alone while you went into the house? To insure their safety?”

The way these things usually work is that the man of the house comes on the scene and tells the wife to get the kids and herself in the house immediately...and from that point on, it is only the shooter and the bad guy, face to face.

I will admit to knowing that there are quite a few women who would not go to the house. If there is going to be a fight, they will be right in the middle of it, and willingly.

But that is another topic.

The lesson to be learned is that this shooter put himself in a very precarious position by going into the house without taking his family with him and by returning to the scene.

To complicate this even more, the sheriff in this country probably would have done the same and refused to press charges. In the county next door, the shooter would be in jail waiting for trial on a murder charge.

It pays to know the laws but pays even more to know how it is interpreted in those jurisdictions you spend a great deal of your time.

There is an important point that is not discussed here.

North Carolina law specifically refuses to allow a self defense plea in the event you leave the person attacking.or if he leaves you, and you leave for the purpose of obtaining a weapon.

I am not a lawyer, but I have read of several cases in this state where leaving and returning with a weapon resulted in a murder conviction.

Maybe the wife and children were not easily removed from the danger zone....that is not discussed and would make a big difference, but based on the facts given in the story, the shooter is very lucky that he did not have to face a hanging judge and jury.NC law is very clear that once you leave the scene, you must not return as you are considered to be out of danger long enough to wait for the cops.

The lack of a weapon on the body would have been a clincher in court.

I am not attacking, criticizing or in any way blaming the shooter. I am only pointing out that quoting the castle law is a serious error because the castle law does not allow you to break any other NC law and I wish to remind everyone who goes armed in NC to be aware of the legal traps and this particular trap has put quite a few otherwise justified shooiters in prison.

During those years, I carefully studied all accidents where the info was available in an effort to avoid the same mistakes.

Excellent advice. Tere are certain things that you can destroy that can never be replaced. Threatening to leave, divorce, or similar acts burn a bridge that you will never replace.

#2 Threats. “If you break your ....whatever I am not going to nurse you. I’ll put you in a nursing home.”.

There are other examples, but you should get the point Each of the above is a definite threat to end the relationship. Threats are sure death to a relationship.

You may still live in the same house after a serious threat, but remember a house is not a home. The romance is ended.

My error.

I was old enough to know better at the time, but did not get it.

A very busy time in my life...not much time for reflection.

The problem, as I see it after much reflection, was that so many good people ran for office before their time. Gldwater, Michelle Bachmann. Ross Perot, Ron Paul.

And there were many others.

But I do read a lot and had a brother who was a real problem.

In many studies of mental cases, you will se a reference to the subject’s cleverness at hiding his actiona as well as his beliefs.

Knowing his parents to be aware of symptoms, he would be very careful to hide his true character.
