    Sheriff: Argonia teen killed himself

An investigation into the death of the 19-year-old found on train tracks shows no signs that anyone else was involved, the sheriff says.

    BY DANA STRONGIN

    The Wichita Eagle

An Argonia teen who was struck by a train in July committed suicide, the Sumner County sheriff has ruled.

A train crew found Jake Allen's body early on July 5.

In a statement released Thursday, Sheriff Gerald Gilkey said that Allen, 19, killed himself but tried to make it look like a crime.

"The death was staged to give the appearance of a homicide," the statement said. "There is no evidence that any other person or persons took part in or were present at Mr. Allen's death."

News reports have quoted unnamed officials saying that Allen's body was tied to the train tracks. Gilkey has not denied that report. He did not return calls Thursday evening.

Gladys Buresh said she heard about the announcement as she was leaving her job as Argonia's city clerk. An hour later, she still struggled with what to say or think.

"It is very hard, and I know that it will hit everyone here very hard," Buresh said, sighing.

Allen graduated in May as valedictorian of his class. He was a football player and the homecoming king. He was a member of the National Honor Society and had won speaking awards. He worked on local farms and volunteered to help with the city recycling program.

The more than 100 students at Allen's school will be brought together this morning, said Julie Dolley, superintendent of Argonia schools.

A handful of crisis counselors will be available to talk to students.

"We will bring everyone together and get the information out there, let them know that it's OK to talk about it," Dolley said.

"It's going to be a rough day, but we'll get through it."

The people of Argonia, population 535, have had a tough time dealing with Allen's death and the investigation, which continued for 13 weeks with little information released to the public.

As the weeks passed and rumors flew, residents said they wanted to know more about the investigation and its progress. Some wondered whether their safety was at risk.

Buresh said she supported investigators for taking their time.

"It created some tension, mostly because people were frustrated. They needed to know what was going on," she said. "There are just times when that isn't what happens -- they don't get to know when they want to know."

The investigation included help from the Kansas Bureau of Investigation, the FBI's Behavioral Science Unit and the Sumner County Mental Health Center, the sheriff's statement said. Forensic examinations included handwriting analysis, tool mark identification, fiber comparison, blood analysis and DNA matching. Two computers were also searched.

Investigators kept school officials well-informed, Dolley said, and she said she thinks they did a thorough job.

"It's not what we wanted to hear; it was hard to hear and accept," she said. "They had reasons for making that determination."

Although the sheriff's finding may raise a new set of questions in Argonia, Buresh hopes residents will be able to focus on what she sees as most important: Allen's family.

"I think they will probably get past this stage, I hope, and think about Jake, say their prayers for Jake," she said.

Allen's parents, Joe and Brenda, are "good people," she said, and they will continue to need support.

Family members declined to comment Thursday.

"Yes, we are going to miss Jake, and we loved Jake, but I did not see him on a daily basis," Buresh said. "His parents did, his family did. They are the ones who are going to miss him for the rest of their lives."

Dolley said she hopes the sheriff's statement puts an end to rumors, for the sake of Allen's family and the students.

"We need this to be resolved and over," she said.

Search warrants issued, no details given in case

WELLINGTON -- The Sumner County Sheriffs Department released new information in a press release late Tuesday afternoon as the investigation into the death of an Argonia teenager continues.

Jake Allen, 19, was struck and killed by a Burlington Northern Santa Fe train near Milan during the early morning hours of July 5.

New information in Tuesday's statement said investigators have issued two search warrants resulting from the investigation, but as to where and what investigators were looking for are not detailed.

Sumner County Sheriff Gerald Gilkey was unavailable for comment surrounding the search warrants this morning.

Investigators say they are maintaining an investigation, "pursuing all aspects and possibilities of this case," the release said.

Investigators at this point have completed 104 interviews, executed the two search warrants, and have followed-up 49 tips or leads.

There have also been four polygraphs given to subjects who had been rumored as being suspects in the case, but never directly called that by investigators.

Findings of the those polygraphs and the investigation into these subjects have given no indication that they were involved with this incident.

Results from evidence testing are also pending from the Kansas Bureau of Investigations lab, the sheriffs department said.

The sheriffs department has also received assistance from numerous agencies including the KBI, Burlington Northern Santa Fe and the Federal Bureau of Investigations Behavioral Science Unit.

Investigators say they have and will continue to communicate with the Allen family and brief them on all findings associated with the case.

    Unresolved

In the 11 weeks since the tragic death of Argonia teen Jacob "Jake" Allen, investigators have released little information to the public on the case.

Allen was found dead during the early morning hours of July 5 after being struck by a Burlington Northern Santa Fe train near Milan.

Sumner County Sheriff Gerald Gilkey says they are working on a press release, and anticipates sending it out soon.

Since early reports, the case has drawn national media attention from newspapers, television reports and Internet forums.

What Sumner County investigators have said is when it is all said and done, the actual report will be nothing like the rumors they have heard.

But for Sumner County residents looking for closure on the death of the 19-year old Argonia High School valedictorian and athlete, even official reports have given little insight into the night of Allen's death.

Rumors of both homicide and suicide have circulated in surrounding communities and in the media since Allen's death, but Sumner County detectives have not termed the case as either.

"It seems unaccountable, but something happened to him that has a label instead of just 'pending,'" says Argonia resident Peggy Luinstra, who says "it's still hard to believe this happened."

Early reports were that Allen had been tied to the tracks unclothed when he was struck by the Chicago-bound locomotive.

    However, Hawkins said reports that

Allen was nude when he died were untrue.

At the same time, he refused to confirm whether or not Allen had been tied to the tracks.

Recently, Sumner County Sheriff Gerald Gilkey said interviews had been conducted and polygraphs given to determine more information about the night of and circumstances surrounding Allen's death.

Gilkey never referred to those individuals as suspects, and said everyone in the group had passed the polygraphs.

Forensic results, which were projected to have been completed in six to eight weeks following Allen's death, have not been discussed with the media.

However, the Sheriff's office has released toxicology reports which show "absolutely nothing abnormal," according to Hawkins.

"He wasn't intoxicated. He wasn't drugged," he said in August. "Absolutely, officially, there has been no determination as to the manner of this young man's death."

While Gilkey says the family has remained informed throughout the investigation, as far as the public is concerned, this statement stands true today.

"We need to keep the family still in our prayers because its an unresolved grief," says Luinstra. "And it puts a worry on the citizens because you read about it and have heard about it and know something happened, but you never hear anything about it."

That sentiment has been expressed at Argonia High School, but students are being asked not to be impatient with investigators.

"I do see that sentiment and I also understand why they want to conduct a thorough investigation," says Julie Dolley, Superintendent of Argonia High School. "I don't think this is something that can be solved quickly or easily just because people want it to, and I don't think arguing or discussing it will make the investigation go any faster."

    Police watch Allen video

WELLINGTON -- Investigators with the Sumner County investigators were in Wichita Monday investigating the death of an Argonia teen.

KWCH Channel 12 News Director, Don North, said this morning deputies spent less than half an hour watching a video tape of Jacob Allen.

Allen, 19, was found dead in the early morning hours of July 5. His body was discovered by a Burlington Northern-Santa Fe crew.

North said investigators were interested in a video never aired by the station, where Allen was featured in a "Top of the Class" segment.

The advertising-supported segment features area the top area high school students announcing their plans for the future.

Allen was the 2004 Argonia High School valedictorian and standout athlete.

North said once his station learned of Allen's death and how upset the family would be if it were to air, chose not to run the segment featuring Allen.

According to North, investigators watched the video and then left the station without saying what they were looking for.

Sumner County Sheriff Gerald Gilkey couldn't be reached for comment today. Investigators remain tight lipped about their findings.

Earlier this month, Gilkey said possible suspects in the investigation had undergone a series of polygraph tests.

Gilkey said his department had a "bunch" of polygraphs scheduled and completed on Aug. 6.

    "They all passed," he said.

"With our interviewing and with the polygraphs, we're fully positive about the interview and investigation. We're confident that our findings are accurate," said Gilkey.

Investigators have released few details over the past few weeks related to the case. They have announced toxicology reports show Allen did not have any drugs or alcohol in his system at the time of his death.

Speculation as to the cause of Allen's death has fueled dozens of rumors, some of which have been proven false.

    Suspects quizzed in Allen death

Possible suspects in the investigation into the death of Jake Allen have undergone a series of polygraph tests, according to Sumner County Sheriff Gerald Gilkey.

Gilkey said they had a "bunch" of polygraphs scheduled and completed last Friday.

    "They all passed," he said.

This leaves the Sumner County Sheriff's Department and the Kansas Bureau of Investigations with "still a few rocks to kick over," Gilkey said.

"With our interviewing and with the polygraphs, we're fully positive about the interview and investigation. We're confident that our findings are accurate," said Gilkey.

Gilkey is still not releasing many details of their findings.

    Allen probe continues

Nearly four weeks after the death of an Argonia teen, the Sumner County Sheriff's Department has issued another news release dispelling one more rumor.

The three-paragraph release issued Wednesday afternoon, is in response "to a number of media inquiries" received by Sumner County Sheriff's office regarding the death of Jacob Allen on July 5.

Sumner County Sheriff Gerald Gilkey said "I would like to dispel any rumors or speculation concerning the Jacob Allen investigation. We have no evidence or anything in his background that links the death of Jacob Allen to any investigations in any other jurisdiction."

Allen, a 2004 graduate of Argonia High School and valedictorian, was found dead along the railroad tracks near Bluff Road, just east of Argonia and north Milan.

"We want to bring closure to the Allen family and the community, and are anxious to complete this investigation," Gilkey said in the release.

Gilkey said they are still waiting on physical evidence from the Kansas Bureau of Investigations.

Since Allen's death, dozens of rumors have swirled throughout the county while investigators have remained tight-lipped.

Last week, investigators released information that Allen was wearing clothes and not nude as rumors indicated at the time he was hit by the Burlington Northern Santa Fe locomotive.

    during the early morning hours.

"Many times it has been reported that he was nude," said Jeff Hawkins, chief detective in the case last Friday. "That is absolutely, positively, wrong."

Hawkins said these reports have been "a sore spot" in the investigation for him as well as Allen's family.

Refuting other media reports, investigators have not deemed the death a suicide.

"Absolutely, officially, there has been no determination as to the manner of this young man's death," said Hawkins.

It was also announced last week that toxicology reports indicate Allen was not intoxicated and had no drugs in his system. Allen's parents, Joe and Brenda Allen, sent a letter to the editor of a Conway Springs newspaper that said rumors surrounding their son's death have been "blown way out of proportion."

They said they hoped "no one was hurt or inconvenienced" by the rumors "that spread so rapidly" following the death of their son.

This isn't confirmed, but is typical of how the area is, and is a rumor from people around the area.

They are supposedly interviewing some teens from the Conway Springs area and the Derby area. They are saying that these are "rivals" from different sports that Jacob participated in. Knowing from attending a rival high school of Argonia, we had after a football game, some of the other team members go after our guys with baseball bats and crowbars, so it is a possibility.

    Argonia teen wasn't drunk, drugged

    The Wichita Eagle

WELLINGTON - Preliminary toxicology results in the death of a Sumner County teen who was struck by a train show "absolutely nothing abnormal," a sheriff's investigator said Friday.

"He was not drugged. He was not intoxicated," sheriff's Detective Jeff Hawkins said of Jake Allen.

A train crew found Allen's body early on the morning of July 5 after it had been struck by a train at a crossing a few miles east of Argonia. The crossing, on a busy main line between Chicago and Los Angeles, is a few miles south of his farm home.

Allen, 19, was a top student, athlete and extemporaneous speaker at Argonia High School, where he graduated in May. He was homecoming king and class valedictorian.

The Sheriff's Department has yet to say how Allen died. There have been reports from unnamed sources that he had been tied to the railroad tracks. Investigators have declined to comment directly on those reports.

On Friday, Hawkins said there has been "absolutely no determination as to the manner of this man's death." Hawkins said he was responding to what he called misinformation in a radio report.

Yes, it happened during the morning hours of July 5th, and I remember being up cleaning up our street of fire works at 4 am cause that was the only time it wasn't storming. Those weren't just rain clouds that came through, so I can understand why they didn't search, but I guarantee that there was an officer out there securing the area.

"Law enforcement will have new information Monday.

Several items that belonged to Jacob have been turned in by people visiting the tracks (the cops missed the items apparently)."

I don't think it is what they missed, it is more than likely, before the cops had enough daylight, etc to search the area, the items were taken. It is hard to believe, but living in this area, and knowing that if something happens in a small town, everyone is out there watching and looking. Probably the stuff taken, people thought, oh it's not important, they won't need this, and then come to find out, they do. Plus the railroad isn't exactly the best at cutting the grass in their right of ways. It could be that they mowed, and the people took it before the sheriff could get back out there. It also doesn't help that the sheriff's office only has 17 full time officers and two of those are jail employees. Hinders on what they can do.
