Court lifts block on Trump order to strip federal workers of union rights

A federal appeals court on Friday lifted a block on an executive order from President Donald Trump that seeks to strip union rights from federal workers at dozens of agencies and offices.

Trump in March issued an executive order that said that parts of the United States Code that protect federal workers’ rights to organize and collectively bargain would no longer apply to agencies including most or all of the Departments of Treasury, Defense, Veterans Affairs, State and Justice. The executive order covers about two-thirds of the federal workforce, according to the National Treasury Employees Union (NTEU), which filed a lawsuit challenging it.

It had been blocked by a federal judge last month as part of the NTEU lawsuit, but that block was lifted Friday by the U.S. Court of Appeals for the District of Columbia Circuit. In its order canceling the injunction, the appeals court’s 2-1 majority said the union had not proved it would suffer “irreparable harm” if the executive order was executed while the lawsuit challenging it was ongoing.

Please note the previous block was pursuant to a specific lawsuit, not one of those general pronouncements.

But it comes out OK in the end.

No public service group at any government level should be allowed to unionize. When public service unions are at the table trying to extort more money and benefits from the taxpayers, the taxpayers do not have a seat at the table hence they cannot protest the amounts being discussed.

Both the union and the government reps consider the amount of money available (from the taxpayers or the printing presses) to be infinite.

The whole point is to obstruct Trump’s agenda until the Midterms. Then the Dems take Congress and impeach Trump for the 3rd time.

We seriously need to get back to understanding the difference between a “right” and a “privilege.”

Rights are rights because they’re innately possessed. Everybody has rights and those are not “given” nor are they “taken away,” but they can be violated.

If something can be granted or taken away, it is not a right. It’s a privilege.

So JFK signed an EO at one point to grant the privilege of collective bargaining to these people. And now Trump is rescinding that privilege. No rights are being “stripped” from anybody.

The day that this is widely understood is the day that the political Left is consigned to irrelevance. Thus, I’m skeptical that the political Left will ever allow this to happen.

No government worker should be in a union. They get paid very well and get perks and benefits exceeding the private sector.

It's not the existence of unions that is the problem, as that is essentially a right of free assembly. It is protection of unions from antitrust laws that is really at issue, as the lack of options it presents is a denial of that same unalienable right. Hence, what really needs correction is the NLRA which exempted unions from antitrust laws. Were they associations competing in the business of supplying skilled labor, thus making the most of every associate, they might actually deliver better industrial performance while relieving management of the bureaucracy of "human resources."

But Franklin D Roosevelt believed that traditional collective bargaining as practiced in the private sector was not appropriate for the public sector.

When Dems opened their official campaigns they had a big union rally in a major city. JFK’s was in Detroit with huge crowds cheering.

Later decades, a political writer asked a Dem staff member “What happened lately? Where are all the union members who used to be here for the campaign rally on Labor Day?”
Staffer: “Many of them are up north at their summer homes.”

And the Republican senate and house is letting it happen. It’s so obvious a blind man could see it.
