Senate Majority Leader John Thune is blazing forward with a controversial move to repeal California's EV mandate — and Democratic Leader Chuck Schumer is warning it will come back to bite him.
Why it matters: Schumer (D-N.Y.) all but threatened to deploy similar strategies to get around opinions by key, nonpartisan rule makers if and when he grabs back control of the chamber.
Driving the news: The Senate will vote as soon as Wednesday on a Congressional Review Act (CRA) resolution that would overturn California's Clean Air Act waiver, leading to an eventual ban on gas-powered vehicles.

Oh, I think they should just let California go through with this myself (with apologies to those of you in California) as it could serve as a case study on how this won’t work.
Unless I’m mistaken, the Senate Parliamentarian rules on how the Senate conducts itself based on rules on how the Senate sets for itself in the past. Why shouldn’t the Senate vote on changing how it conducts itself? I seem to remember the Senate changing the filibuster rules to allow the Senate to confirm Presidential nominations to the cabinet without needing a supermajority (60 out of 100) of the U.S. Senate. This change took place when Tom Daschle (a Democrat) was the U.S. Senate leader.

And what's with Schumer? That floater is always tossing around veiled threats. He should be brought in by the SS for an "interview".
I am now hoping that Trump will do what he can to promote term limitations for Congress. If passed, that will get rid of Nancy Pelosi, Chuck the Schmuck, Mad Maxine, and other critters in Congress that have been there too long.

Since only a third of the Senators are elected in any given election, the Senate considers itself to be a continuing body with permanent rules that carry over from one Congress to the next. Since the rules are continuously in effect, it requires unanimous consent or a two thirds vote to suspend or change them.
The House reconstitutes itself de novo at the beginning of each Congress with new rules adopted by majority vote at the beginning of each Congress.
As a practical matter, the House rules are generally readopted as is, with minor tweaks — sometimes major tweaks that cause controversy — happening with regularity.
In the Senate, amending the standing rules is much harder because, unless the change gets unanimous consent, it involves a supermajority fight.
If we are going to blow up the filibuster, I’d do it for something much more important than the repeal of a suicidal California stupidity that should be repealed by the Cali legislature.

WAIT. It’s CA’s CAA Waiver that would lead to the ban. So, if the CRA resulotuion overturns the waiver, it also overturns the eventual ban; it doesn’t lead to the ban.

So... the CAA Waiver isn’t a “rule,” because if it were a “rule” then it couldn’t be repealed by the CRA, but it isn’t, therefore it’s fair game. Good for Republicans.

If it means what I think it does, Congress should not have the prerogative of overturning state legislation. States have the right to do stupid stuff to themselves.

Democrats threatened to stack the Supreme Court by increasing the number of justices from nine. Democrats meant it. Trump should propose the same thing so we can come to an agreement now while Democrats are at a disadvantage.
