DOJ can 'force' Alito, Thomas to recuse themselves on SCOTUS cases: Dem lawmaker

Top Democratic Rep. Jamie Raskin argued in the New York Times this week that Justices Clarence Thomas and Samuel Alito could, in theory, be forced to step down from cases related to the January 6 Capitol riots.

In a guest essay for the New York Times on Wednesday, Raskin detailed ways Thomas and Alito could be forced to recuse themselves from the upcoming Trump v. United States and Fischer v. United States, both involving former President Trump's role during the Capitol protests.

"Of course, Justices Alito and Thomas could choose to recuse themselves — wouldn’t that be nice? But begging them to do the right thing misses a far more effective course of action," Raskin wrote.

Alito and Thomas, both nominated by Republican presidents and part of the Supreme Court's conservative wing, have come under fire from Democrats and mainstream media in recent months over claims that they cannot objectively rule on matters around Jan. 6.

I never believed Kagan had no interaction with Obamacare before her SCOTUS appointment, it was not plausible. I still think repubs need to force investigation into that.

The executive branch cannot force the judicial branch to neuter itself.

It doesn’t work like that. SCOTUS justices decide for themselves if they should recuse themselves from a case, unlike oher federal judges. This won’t happen, but they are desperate.

Shouldn’t there be some way to prosecute Raskin for leaving out exculpatory evidence in the J6 Committee’s report?

These critters are so so so so slimy. It’s about time they got their just rewards.

They come from the place where Antonin Scalia perished at a time most convenient for the left.

I don’t know if you’ve noticed yet, but the left has reached the conclusion that they can do anything they want without consequence. Nobody’s holding them accountable in any fashion, so unless that changes or the words leap off the Constitution to stop them, are they wrong?

Correct. If there were truly something egregious, the House could impeach and the Senate could remove them. That is the check on SCOTUS abuse.
